HomeMy WebLinkAbout11/02/1964 Business MeetingF, 598 NOVEMBER 2, 1964 The City Council met in regular session, Mayor Larson, Councilmen Brazier, Lambert, Lynch, Munger and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman Kurbitz absent on roll call but present a few minutes thereafter and for the balance of this meeting. Lynch absent and excused -, Councilman Munger , gave -the.invocation. The minutes of the regular meeting of October 26, 1964 having been certified. accurate by two councilmen and no one present wishing to have the minutes read, Mayor Larson declared said. minutes approved as recorded. This being the.time fixed for the hearing on Petition No. 296 as filed by Ronald E. Poole praying for the annexation of certain property north of Ferol Lane and along the west edge of -the present City limits and there being no protests in writing or otherwise, it was MOVED by Munger, seconded by Lambert that Ordinance No. 581 providing for said annexation and zoning said property as R -1, One- Family Zone, be passed as read: carried, Brazier, Kurbitz, Larson, Lambert, Munger and Robinson voting aye on roll call. Lynch absent. ORDINANCE NO. 5$1, AM ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the .City of Yakima and zoning the same as R -1, One- Family Zone. Moved by Robinson, seconded by Munger that Ordinance No. 582 relating to business and occupation taxes upon utilities, namely Pacific Power a Light Company, Pacific Northwest Bell Telephone Co., and Cascade Natural Gas Company, fixing tax rates and providing for a surcharge and amending the Yakima Municipal Code, be passed as read: carried, Brazier, Lambert, Larson, Munger and Robinson voting aye'on roll call. Kurbitz voting nay on roll call. Councilman Kurbitz indicated that he believes that this issue should be on -the ballot for the approval or rejection of the electors. Lynch absent. ORDINANCE N0.582, AN ORDINANCE relating.to business and occupation taxes upon certain utilities, fixing tax rates, providing for a surcharge, saving certain taxes and amending Section 5.50.050 of the City of Yakima Municipal Code. Moved by Lambert, seconded by Robinson that Ordinance No. 583 adopting a longevity plan for Polic and Fire Department of the City and amending the Yakima Municipal Code, be passed as read: carri Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye on roll call. Lynch absent Councilman Munger indicated that even though he voted for this ordinance he is against longevity plans and in favor of merit system for pay raises. , ORDINANCE NO. 583, AN ORDINANCE adopting a plan for longevity pay for a certain class of employe of the Police Department and Fire Department of the City of Yakima; authorizing longevity pay and adopting regulations and restrictions governing such longevity pay; amending Section 2.12.010 and 2.24.010, and repealing Section 2.24.04.0, all of the City of Yakima Municipal Code. seconded -by Lambert that Ordinance No. 584 relating.to the classifi Lio -- Compensation Plan for ity mp - - - - - unicipal'-Code, be passe as read: carried, Brazier, , unger and Robinson vo ing ro call. Moved by Munger, seconded by Lambert that Ordinance No. 584 relating to the classification and compensation plan for City Employees of the City of Yakima and amending the Yakima Municipal Code, be passed as read: carried, Brazier, Lambert, Larson, Munger and Robinson voting aye on roll call. Councilman-Kurbitz explained that since this ordinance takes care of the changes and increases in the 1965 Budget and since he voted against said budget he must vote against this ordinance. ORDINANCE NO. 584, AN ORDINANCE relating to the Classification and Compensation Plan for employee of the City of Yakima; adding 'a new Sub - Section called Sub- Section (d), to Section 2.20.0$$ of the City of Yakima Municipal Code; and amending Sections 2.20.100 (a), (b), (g), (h) and (:i), all of the City of Yakima Municipal Code. Moved by Munger, seconded by Lambert that Resolution No. Ii -743 authorizing the execution of a Lease Modification Agreement with Irvin W. Lane for the leasing of City owned property located at 125 North 2nd Street, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye on roll call. Lynch absent. City Attorney Andrews having prepared two modi- fication leases, one giving the Lessee the first right to re -lease the premises, it.,was MOVED by Brazier, seconded by Robinson that the first lease as prepared by the City Attorney which in- creases the rental to $315.00 per month and does not give the first right of re -lease to the Lessee, be used as.the agreement to be executed in connection with Resolution.No. D -575: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote. Lynch absent. RESOLUTION NO. D' -; -7-41 A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a Lease Modification Agreement with Irvin W. Lane. Moved by Robinson, seconded by Munger that Resolution No. D -744. authorizing the City Attorney of the City to participate in the filing of a brief amicus curiae in the Supreme Court of the State of Washington, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Munger and CD Robinson.voting aye on roll call. Lynch absent. RESOLUTION NO. D-744-, A RESOLUTION authorizing the City Attorney of the City of Yakima to partic- ipate in the filing of a brief amicus curiae in the Supreme Court of the State of Washington. Moved by Munger, seconded by Robinson that Resolution No. D -745 authorizing the City Manager to engage Anthony Arntson to perform legal services for the City of Yakima in connection with the Lenox Avenue Right -of -way, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye on roll call. Lynch absent. RESOLUTION NO. D -745-, A RESOLUTION authorizing the City Manager to engage Anthony Arntson to perform legal services for the City of Yakima relating to the acquisition of Lenox Avenue right - of -way. Moved by Munger, seconded by Lambert that Resolution No. D -746 authorizing the'Director of Public Works to contract to furnish work, labor and materials to-the Town of Selah Washington for street striping, be passed as read: carried, Brazier, Lambert, Larson, Munger and Robinson voting aye on roll call. Moved by Robinson, seconded by Kurbitz that Resolution No. D;747 transferring the sum of $3,000.0 in the 1964 Budget for Irrigation Department, be passed as. read:: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye on roll call. Lynch absent. RESOLUTION NO. D- 747, 'A RESOLUTION transferring the sum of $3,000.00 within the 1964 appropria- tion for 51- Irrigation. Moved by Robinson, seconded by Munger that the report dated October 27, 1964 submitted by CH2M, Consulting Engineers, reporting Estimate No. 6 in the amount of $109,690.1$ due the G. R. Leischn Construction Company for work done_ on the Sewage Treatment Plant Additions, be approved and that the estimate therein set forth be approved and payment of same authorized: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote. Lynch absent. Moved by Brazier, seconded by Munger that the report dated October 29, 1964 as submitted by Gray and Osborne,. Consulting Engineers, reporting Estimate No. 5 in the amount of $59,448.97 due Superior Asphalt & Concrete Company for work done on the Summitview Avenue Improvement, be approv ed and that the estimate therein set forth be approved and payment of same authorized: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote. Lynch absent. Mr. Jump representing Gray and Osborne was present at this meeting. Bids having been submitted to a Bid Board on October 23, 1964 for the Airport Well Pump & Pump - house project and the City Engineer having submitted a report dated November 2, 1964 and recom- mending that all four schedules of.this project be awarded to one contractor, namely Picatti Brothers,who have submitted the lowest and best evaluated bid, and-that:the City Manager be authorized to enter into a contract.on behalf of the City of Yakima upon the filing of the proper bond and insurance by said contractor: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote. Lynch absent. Mr. George Picatti, Mr. Donald Picatti, Mr. Henry Decoto and Mr. Cecil White were present at this meeting and discussed the evaluating and awarding of said.bids with Council members. Mr. Henry Decoto protested the awarding of the bid on the basis of the 12% discount offered by Picatti Brothers, indicating that this is not in accordance with the specifications. �. = �VT" There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Brazier, that we do now adjourn at the hour of 4:55 P.M: carried, Brazier, Kurbitz, Lambert, Larson, Munger and Robinson voting aye by voice vote.
