HomeMy WebLinkAbout10/26/1964 Business MeetingF, 596 OCTOBER 262 1964 The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lynch, Munger and Robinson, City Manager. Smith and City Attorney Andrews present on roll call. Councilman Lambert absent. MOVED by Robinson, seconded by Lynch that Mrs. Lambert be excused from this meeting: carried, Brazier, Kurbitz, Larson, Lynch, Munger and -Robinson voting aye by voice vote. The invocation was given by Councilman Lynch. The minutes of October 19, 1964 having been duly read and certified accurate by two councilmen and no one present wishing; to have the minutes read, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the hearing on the assessment roll for L.I.D. No. 911, Clift Plat, Airport Addition No I Sanitary Sewer Project, and there being no protests in writing or otherwise, it was MOVED by Munger, seconded by Lynch that Ordinance No. 580 confirming said assessment roll and every part thereof, be passed as read: carried, Brazier, Kurbitz, Larson., Lynch, Munger and Robinson, voting aye on roll call. Lambert absent. ORDINANCE NO., 5801 AN ORDINANCE confirming the assessment roll covering Local Improvement Districi No. 911 as created and established by Ordinance No. 463 of the Ordinances of the City of Yakima. Petition No. 308 having been filed with the City Clerk on,the 19th day of October, 1964 by Harold R. Sanford requesting the.rezone_of property situated between Crescent and 44th Avenue, it was MOVED by-Robinson, seconded by Munger that said petition be referred to the Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson vot- ing aye by voice vote. Lambert absent. Petition No. 309 having been filed with the City Clerk on the 22nd day of October 1964, by Donald 0. "Rice requesting the formation of a Local Improvement District for the construction of Sewers serving certain property on North 1st Street, it was MOVED by Munger, seconded by Robinson that said petition be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll call. Lambert absent Petition No. 310 having been filed li,-ith the City Clerk on October 23, 1964 by Wayne E. Nott and others requesting the formation of a Local Improvement District for the construction of Water Mains on Grant Street, 18th Avenue to 20th Avenue, it wasMOVED by Robinson, seconded by Munger that said petition be referred to the City Manager and staff for study and recommendation: carried, (Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll call. Lambert absent. Moved by Lynch, seconded by Robinson that Resolution No. D - ?39 authorizing the purchase of material without calling for bids, namely 72 lineal feet of 1611 class 150 ductile iron pipe, cost not to exceed $750.00, be passed as read: carried, Brazier, Kurbit,,, Larson, Lynch, Munger and Robinson voting aye on roll call. Lambert absent. RESOLUTION NO. D -7391 A RESOLUTION authorizing the purchase,of materials without calling for bids! Moved by Lynch, seconded by Robinson that - Resolution No. D -740 authorizing the purchase of real property for the purchase price of $1,571.63 for Lenox Avenue right of way purposes, be! passed as read: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll. call. Lambert absent. M RESOLUTION NO. D 740, A RESOLUTION authorizing and directing the purchase of real property for Lenox Avenue right of way purposes. Moved by Munger, seconded by Brazier that Resolution No. D -741, being a resolution of intention j to improve certain property by constructing water mains and other appurtenances and fixing the date of hearing on said improvement for the 16th day of November, 1964, be passed as read: carrlec Brazier, Kurbitz, Larson, Lvnch, Munger and Robinson votin.g'aye on roll call. Lambert absent. RESOLUTION NO. D -741, A RESOLUTION of.intention to create a Local Improvement District. Damage - -claims raving been filed by Yakima Ice Arena, Inc and L.L,. Buchanan and Laura Buchanan husband and wife and having been duly considered and denied by Resolution No. D -594 and. D -595 as passed by the City Council. on the 26th day of August, 1963 and the plaintiffs having proceeded to sue the City of Yakima for damages under causes No. 47014 and 47016 in the Superior Court of the State of Washington for Yakima County, and the City Attorney and City Manager recommending the payment of $1,500.00 in settlement of said claims, it was MOVED by Robinson, seconded by Munger that Resolution No. D -742 authorizing the payment of $1,500.00 as settlement of said causes, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll call. Lambert absent. RESOLUTION NO. D -7421 A RESOLUTION authorizing the payment of $1,500.00 as settlement of causes No. 47014 and 47016 in the Superior Court of the State of Washington for Yakima County. (Planning Director,Rudy Gast reported on and filed with the Clerk of the Council, a Notice Of In- tention to Commence Annexation Proceedings as signed by William R. Baker. He indicated that this annexation is approximately 55 acres located South of the Congdon Canal and West of Edgecliff Manor Subdivision. Mr. Baker being in attendance at this meeting, it was MOVED by Robinson, seconded by Kurbitz that this date, October 26, 1964, be set as the time for meeting with Mr. Bake: who signed said Notice of Intention dated October 26., 1964: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lambert absent. Mr. Baker indicating that the property to be annexed is owned by himself and Ronald C u11> and that they are willing to assume their share of the City's indebtedness, it was MOVED by Robinson, seconded by Munger that the proposed annexation be accepted by the City of Yakima and that the area to be annexed be required to assume its share of the City's existing indebtedness: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lambert absent. Rudy Gast, Planning Director also reported on and filed with the Clerk of the Council,aa Notice of Intention to Commence Annexation Proceedings as signed by Councilman Albert B. Kurbitz. He indi- cated that said property is located North of Fruitvale Boulevard and East of Wright Avenue. It wasMOVED by Munger, seconded by Brazier that this date and time, October 26, 1964, be set as the time for meeting with the initiating party: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lambert absent and Kurbitz not voting. Councilman Kurbitz indicating that he.is willing to assume his share of the City's existing indebtedness, it was MOVED by Munger seconded by Brazier that the annexation proposed-by Mr. Kurbitz be accepted by the City of Yakima and that the area to be annexed be required to assume its share of the City's existing i.ndebtednes, carried, Brazier, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lambert; absent and Kurbitz not voting. -s 1 7 1 597 October 26, 1964 Councilman Lynch having requested that he be excused from the regular Council meeting to be held on the 2nd and 9th days of November, 1964, it was MOVED by Brazier, seconded by Robinson that Councilman L,Tnch be excused from these meetings: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lambert absent -. City Manager Smith having reviewed matters pretaining to the Yakima Valley Baseball Club, it's use and occupancy of the Parker Field, the written lease with the School District which termin- ates on September 1, 1964 and the litigation of.ownership of Parker Field now pending in Superio Court, pointing out that there is .a legal question as to what interest the City of Yakima has in Parker Field,'pointing out the importance of the Baseball Club to the economy of the City and requesting that, pending the outcome -of the present law suit, the City indicate that it is agree able to have the Baseball Club occupy and use this feild, it wasMOVED by Robinson, seconded by Lynch that the Mayor'be authorized to send a letter indicating that the City is agreeable to having the Yakima Valley Baseball Club, Inc., occupy and use the Parker Field facilities during the 1965 -1966 baseball seasons carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote.- Lambert absent. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Brazier that we do now adjourn at the hour of 3:45 P.M: carded, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote.
