Councilman Mufnger" absent. Moved by Robinson, seconded by Lynch that Councilman Munger be excused from this meeting. City Manager Smith absent and attending the International City Manager's Conference in Chicago. Councilman Lynch gave the invocation. The minutes of the regular meeting of September 21, 1964 were approved as read. This being the'time fixed for the hearing on Petition No. 283 as filed by the Church of the Brethren requesting the vacation of the South 10 feet of the North 30 feet of the North Half of the Northeast Quarter of the Southwest Quarter of the Northeast Quarter of Section 27, Township 13 North, Range 18, E. W. M., it was MOVED by Robinson, seconded by Lambert that Ordinance No. 567 providing for the vacation of said property, be passed as read: Mr. Howard Hettinger, attorney for Mr. L.O. Beaver, explained that his client is purchasing this property and that an emergency exists since his client needs to build a home before the winter weather sets in. Mr. Hettinger requested that the City Council recognize this emergency and amend the ordinance as read to become effective immediately upon its approval,passage and publication. Discussion indicated that this property will not be needed for streets. All persons having been heard and there being no protest in writing or otherwise to said vacation, it was MOVED by Robinson, seconded by Lynch that Section 2 of the ordinance read, be amended to read "This ordinance is one to provide for the immediate preservation of the public,peace, property, health and safety of the people of the City of Yakima and an emergency is, hereby declared to exist, and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by th)e City Charter. carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye by voice vote. Munger absent. Mayor Larson then called for a roll call vote on the original motion to pass Ordinance No 567 as amended and Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voted aye. Munger absenl ORDINANCE NO. 567, AN ORDINANCE providing for the vacation of a public street in the City of Yakima, Washington This being the timefor the hearing on Petition No. 286 as filed by Donald 0. Rice, d /b /a Trailer Village, praying for the annexation of certain property-located on North lst Street and there bei no protests in writing or otherwise -to said annexation, it was MOVED by Lynch, seconded by Lamber that Ordinance Nk. 56� providing for said annexation, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. Munger absent. ORDINANCE NO. 568; AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima, and zoning the same as B -3, General Business Zone. This date having been fixed for the time for the hearing on Petition No. 292 as filed by Decoto Bros., praying for the annexation of certain property contiguous to the Airport, it wasMOVED by Robinson, seconded by Lambert that Ordinance No. 569 providing for said annexation be passed as re Mr. Howard Hettinger, Attorney representing Decoto Bros., indicated that he believes the Planning Commissions report to be invalid because they did not concern themselves with planning matters but rather spent time on computing assessed valuation. He further stated that his client does not need a reason to be annexed to the City. He also asked that the emergency clause be added to this ordinance since his client is anxious to have water service for fire protection. As to the matter of the emergency, it was established that no emergency exists since this service will be extended to this property immediately. Mr. Doug Peters, attorney representing Lionel Walters a property owner in this area, Mrs. Hattie Folley, Mr. Hertrich, Mrs. George, Mrs. Hardman, Mr. Simpson, all protested the annexation of their property and the zoning of said .property to M -3, Airport Industrial Zone. Those persons protesting indicated that they are doing so because there is not enough information available as to where the by -pass road will be built and whether or not Washington Avenue will be reopened. Council assured those present that they are not interested in annexing any one who does not wish to be annexed and discussed the advantages of becoming a part of the City. Mrs. John Bolm having filed a written request to withdraw from this petition and the Council having given due consideration to the protests made, it was MOVED by Robinson, seconded by Lambert that the ordinance read be amended to coveF flK.e Leland Harris and Decoto Bros., property only, said property more fully described as "Beginning at a point .173.36 feejr North of the South- east corner of the South west quarter of the Northwest, quarter, Section 35, Township 13 North, Range 18, E.W.M., on the East Line of said Southwest quarter of the Northwest quarter; thence North and along said line a distrance of 757.61 feet; thence West and parallel with the North line of the said Southwest quarter of the Northwest quarter a distance of 666.4 feet; thence South and along the West line of the East half of the said Southwest quarter of th'e Northwest quarter to a point x.16.07 feet North of the Southwest corner of the East half of the said Southwest quarter of the Northwest quarter; thence South 700 03' East a distance of 718.25 feet to the point of begin- ning;" carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting ave by voice vote. Mungei,,absent.' Mrs. D. E. Lisk indicated that a right of way for road must be obtained through this property. Mayor Larson then called for the roll call vote on the original motion to pass Ordinance No. 569 as it is amended and said motion carried: Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 569, AN ORDINANCE providing for the annexation by the City of Yakma of certain property contiguous to the City of Yakima, and zoning same as M -3, Airport Industrial Zone. The City Council, at their regular meeting of August 10, 1964, having given due notice of their intention to rezone certain property located between 36th and 38th Avenue owned by Dr. A. J. Myer it was MOVED by Kurbitz, seconded by Robinson that Ordinance No. 570 accepting the recommendatio of the Planning Commission and rezoning certain property located between 36th and 38th Avenue and betweenTieton Drive and Webster Avenue from R -1, Single Family Zone to B -2, Local Business Zone, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye,on roll call. Munger absent. Councilman Lambert qualified her vote stating that she does not believe this to be the best use for- this property. ORDINANCE-N0. 570, AN ORDINANCE accepting the recommendation of the Planning Commission and re- zoning certain property located between 36th and 38th Avenue and between Tieton Drive and Webster Avenue in the City of Yakima, Washington, from R -1, Single Family Zone to B -2, Local Business Zon This being the time for the hearing on Petition No. 293 as filed by Verne Kukuk requesting the rezone of property at 1208 Fruitvale Blvd., it was MOVED by Robinson,, seconded by LamMh that Ordinance No. 571, accepting the recommendation of the Planning Commission and rezoning property from R -3, Multiple Family Zone to B -2, Local Business zone, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye on,roll call. MR 3 588 SEPTEMBER 28) 1964 ORDINANCE NO. 571, AN ORDINANCE accepting the recommendation of the Planning Commission and re- zoning certain property located at 1208 Fruitvale Boulevard in the City of Yakima, Washington, from R -3 Multiple - Family Zone,,to B -2, Local Business Zone. A Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk, September 18, 1964 by Thecla Regeimbal and Mrs. Regimbal being present at this meeting, it was MOVED by Robinson, seconded by Lambert that this date, September 28, 1964, be set as the time for a. meeting with the initiating party, namely Firs. Regimbal, who signed said Notice which is dated September 17, 1964: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and Robinson voting ave by voice vote. Munger absent. I`•'Irs. Regeimbal indicating that the property:-otp•-ners will assum their share of the City's indebtedness,•it was MOVED by Robinson, seconded by Lynch that the proposed annexation be accepted by the City of Yakima and that the area to be annexed be required to assume its share of the City's existing indebtedness: carried, Brazier, Kurbitz, Lambert, La Larson, Lynch, and Robinson voting aye by voice vote. Munger absent. A Notice of Intention to Commence Annexation Proceedings having been filed with the City Clerk by Robert L. Alderson on September 21, 1964 and Mr. Alderson being unable to attend this meeting it was MOVED by Robinson, seconded by Lynch that October 5, 1964 be set as the time for a meeting_ with the initiating party, namely Mr. Robert L. Alderson: carried., Brazier, Kurbitz, Larson, Lynch and Robinson, voting aye by voice vote. A Notice of Intention to Commence Annexation Proceedings having been filed with the City Clerk by Mary Wakley on September 23, 1964 and Mrs. Wakley being present at this meeting, it was I`fOVED by Robinson,- seconded by Lynch, that this date, September 28, 1964 be set as the time for a meeting with said initiating party, namely Mrs. Wakley: carried, Brar,ier, Kurbitz, Lambert, Larson, Lvnc and Robinson voting; ave by voice vote. Mrs. Wakley indicating that she is will- ing to assume her share of the City's existing indebtedness, it was LOVED by Robinson, seconded by Lambert that the annexation proposed by Mrs. Wakley be accepted by the City of Yakima and that the area to be annexed be required to assume its share of the City's existing indebtedness: carried, Brazier, Kurbitz, Lambert, Larson, Lvnch and Robinson voting ave by voice vote..Munger absent. Hill and others, requesting the formation of a local improvement district for the construction of curbs, gutters and the surfacing of South 8th Street between Central and Le=, Avenues, it was MOVED by Robinson, seconded by Lambert that said petition be referred to the City Manager and staff for study and recommendatio: carried, Brazier, Kurbitz, Lambert, Larson, .Lvnch and Roo bir.so� voting aye by voice vote; Munger absent. Moved by Lvnch, seconded by Robinson that Ordinance No. 572 fixing the time of delinquency of installments and prescribing the _form and providing for the issuance of Installment Notes for the payment of the unpaid portion of L.I. D. No. 910, Sutor Addition Domestic Water, be passed : as read carried, Brazier, Kurbitz, Lambert, Larson, Lvnch, and Robinson voting ave on roll call. Munger absent. ORDINAI`TCE NO. 5721 AN ORDINANCE fixing the time of cblinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement DistrictNo. 910, and pr.ovidin,g for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion thereof. Moved by Robinson, seconded by Lambert that Resolution No. D -735 authorizing the execution of a Lease Agreement with the Shell Oil L'ompany for an Airport Service Station, be passed as read. carried, Brazier, Lambert, Larson, Lvnch, and. Robinson voting aye on roll call. Kurbitz not voti.ng,explained that he felt that he is not well enough informed on this operation to vote. Munger absent. Discussion pointed out that this agreement is updating' and renewing the Shell Oil Company agreement now in existance at the Airport and that this service station is primarily for the servicing of areoplanes. RESOLUTION NO. D 735, A RESOLUTION authorizing and directing the City Manager and.the City Clerk ! of the City of Yakima to execute a Lease Agreement with Shell Oil Company for an airport service station. Moved by Robinson, secr-nded by Lambert that Resolution No. D -736 authorizing the grant; of a right of way easement to the State of Washington over and across certain,real property otined by the Citv of Yakima, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson., Lynch and Robinson voting ave on roll call. Munger absent. Discussion indicated that this ri_rht -of -way is at the sewage treatment plant. RESOLUTION NO. D 736, A RESOLUTION authorizing the grant of a right -of -way easement to the State of Washington. - The City Engineer reporting the completion of L.I.D. No. 911, Clift Plat, Airport Addition No. I, Sanitary Sewer Project, it was MOVED by Robinson, seconded by Lambert that said report be accept- ed and that the City Clerk give due notice of hearing on the assessment roll for said L.I.D. No. 911, by publication and to each property owner as prescribed by statute: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Munger, absent. Gray and Osborne, consulting engineers, submitting their final report and Estimate No. 4 on the 16th Avenue and Tieton Drive Street Project, it was MOVED by Lynch, seconded by Lambert that said report dated September 23, 1964 be accepted and approved and that the estimate in the amount of 14,443.17 therein set forth be approved and payment authorized: carried, Brazier, Kurbitz, ambert, Larson, Lynch and itiobinson voting aye by voice vote.
