SEPTEMBER 14, 1964
The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lambert,
Lynch, Munger and Robinson, City Manager Smith and CitIT Attorney Andrews present on roll call.
Councilman Lambert gave the invocation.
The minutes of the regular meeting of September $, 1964 were approved as read.
In accordance with action taken by the City Council at their meeting of September 8, 1964 and
Manager Smith reporting at this meeting that a letter has been sent to Shell Oil Company request-
ing certain changes be made in their lease form which is to be used for a Service Station at the
Yakima Municipal Airport, and requesting that this matter be continued indefinitely, it was MOVED
by Lynch, seconded by Munger that the matter of authorization and execution of a Lease Agreement
with the Shell Oil Company for an Airport Service Station be continued indefinitely: carried,
Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote._
The matter of a signature petition as filed by Stuart Semon requesting that a certain ordinance
relating to Raw Milk be submitted to the qualified electors of the City of Yakima, being the next
item of business on the agenda for this date, it was MOVED by Robinson, seconded by Munger that
this matter be continued to and considered under No. 7 -b, Resolutions: carrie, Brazier, Kurbitz
Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote.
Petition No. 297 having been filed with the City Clerk on the 9th day of September, 1964 requestiz
the formation of a local improvement district for the construction of Water Mains for the Trinity
Church of the Nazarene at 2801 Englewood Avenue, it was MOVED by Robinson, seconded by Lynch that
said petition be referred to the City Manager and Staff for study and recommendation: carried,
Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote.
Also Petition No. 298 having been filed with the City Clerk on the 9th day of September, 1964 re-
questing the formation of a local improvement district for the construction of sewers .for the
Trinity Church of the Nazarene, 2801 Englewood Avenue, it was MOVED by Robinson, seconded by
Lynch that said petition be referred to the City Manager and Staff for study and recommendation:
carried, Brazier, Kurbitz, Lambert, Larson, Lvnch, Munger and Robinson voting aye by voice vote.
Moved by Munger, seconded by Lynch that Ordinance No. 563 providing for the submission to the
electors of the City at a special election November 3, 1964, a proposition of whether or not.'a to
of $200,000.00 or approximately 3.77304 mills in excess of the maximum tax levy specified by law
shall be made on the taxable valuation of property within the City of Yakima, Washington and the
proceeds used to acquire fire fighting 'and training equipment and facilities, including real
property for the City of Yakima Fire Department, be passed as read: carried, Brazier, Kurbitz,
Lambert, Larson, Lynch, Munger and Robinson voting aye on roll call.
ORDINANCE NO. 563, AN ORDINANCE providing for the submission to the electors of the City of
Yakima, Washington, at a special election, of a proposition of whether or not a tax of $200,000.0
or approximately 3.77304-mills in excess of the maximum tax levy specified br law shall be made
on the taxable valuation of property within the City of Yakima, Washington, and the proceeds ther
of used to acquire fire fighting and training equipment and facilities, including real property,
for the City of Yakima Fire Department; and declaring an emergency.
Moved by Robinson, seconded by Munger that Resolution No. D -731 requesting the Auditor of Yakima
County to hold a special election and submit to the electors of the City of Yakima a proposition
entitled. "Levy for Yakima Fire Department ", be passed as read: carried, Brazier, Kurbitz, Lamber
Larson, Lvnch, Munger and Robinson voting aye on roll call.
RESOLUTION NO. D -7311 A RESOLUTION requesting the Auditor of Yakima County, Washington to hold a
special election.
A petition signed by approximately 2800 residents having been filed with the City Clerk on Septeml
11, 1964, requesting that an Ordinance prohibiting the retail sale of raw milk other than certifi(
raw milk within the City of Yakiria and adding certain sections to Chapter LP.64 of the Yakima
Municipal Code, be submitted to the electors of the City, it was MOVED by Munger, seconded by
Lambert that Resolution No. D -732 providing for a special election on said proposition, be passed
as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by
voice vote. Mr. Stuart Semon, Chairman for the group submitting this petition and Mr. Ted Roy,
Attorney for said group, spoke on behalf of the petitioners and contended that this action is
taken on behalf of public safety and is being submitted on its merrits alone;also that it is
being filed at this time in order that it may be placed on the November 3, ballot and will not
require a Special Election at another time. Mr. Don Tunstall, attorney, representing Mr. Frank
Ranger, the owner of a small dairy spoke against the petition, indicating that it was the work of
the three creameries and the Teamster's Union. Discussion indicated that Mr. Ranger sells raw
milk from 15 to 19 cents less than the creameries, that his milk is inspected as are the others,
but is not '?certified Milk Raw ". Discussion further indicated that to have certified raw milk
would necessitate new inspection boards and higher standards of inspection, none of which are in.
existence in the state at this time. Mrs. Mc Cormick concurred with Mr. Tunstall's remarks and
stated that her daughter can not drink pasturized milk and must have raw milk and that she believ(
that others have this same problem and should therefore be able to purchase raw milk. Members of
the Council protested the manner in which this matter has been handled since-,it is a matter of
long standing and no emergency exists They expressed their favor of the initiative method of
presenting the matter but expressed the belief that more time should have been given for their
consideration of the matter, and that the public is without adequater information.

In accordance with action taken by the City Council at their regular meeting of August 17, 1964,
and the Planninf /�ig�m��� Rini; on and recommending that certain property owned by Dr. A. J. Myers
located between 36th and 38th Avenue between Tieton Drive and Webster Avenue including that part
occupied by the Union Oil Service Station, be rezoned from R -1, Single Family to B -2, Local
Business Zone, it was MOVED by Robinson, seconded by Munger that September 2�, 1964 be set as the
time for a hearing by the City Council on this matter and that the City Clerk give notice.of such
hearing as required by law: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and
Robinson voting aye by voice vote.
The Planning Commission rega.rting on and recommending the annexation of certain property describ-
ed in Petition No. 286 as filed by Donald 0. and June J. Rice d /b /a Trailer Village and that the
property be classified as B -3, General business upon annexation, it was MOVED by Munger, seconded
by Lynch that said Petition as filed be approved as meeting the requirements of law; that the Cit,,
Manager and the Mayor be authorized to obtain waivers of a meeting of a Review Board, as author-
ized by law; and that an order be prepared fixing September 28, 1964 as the time for a public
hearing by the City Council on this petition: carried, Brazier, Kurbitz, Lambert, Larson, Lynch

as described in Petiton No. 292 and filed by Decoto Bros. and others, Planning Director, Rudy Gast
rp orted orally on this matter stating that Mrs. Bolm,one of the signers has indicated that she
wishes to withdraw from said petiton, but to date he has not received a written - request to with-
draw. After discussing this matter, it was MOVED by Munger, seconded by Robinson that said
petition for annexation as filed by Decoto Bros. and others, being_ Petition No. 292, be approved
as meeting the requirements of law; and that the City Manager and the Mayor be authorized to con-
vene a Review Board, as required by law, for, a hearing and review of this proposed annexation;
and that an order be prepared fixing 'September 28, 1994 as the time for a public hearing by the
City Council: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye
by voice vote.-
The Planning Commission having reported on and recommending that the property located at 1208
Fruitvale Blvd, be rezoned from R -3, Multiple Family to B -2, Local Business zone, as requested on
Petition No. 293 and filed by Verne Kukuk, it was MOVED by Robinson, seconded by Munger that
September 28, 1964, be set as the time for a hearing by the City Council on the matter of the re-
zone of said real property as petitioned by Mr. Kukuk and that the City Clerk ,give notice of hear-
ing as required by law: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson
voting a.ye by voice vote.
Manager Smith reported,that the resolution providing for the adoption of the preliminary budget
for 1965 will be prepared for the next regular meeting of the City Council.
Manager Smith also requested permission to send Ed Rumsey, employee of Fire Department, to Portlan
Oregon to attend a Public Safety Officers Communication conference and estimated his expenses to
be approximately $35.00. It was MOVED by Robinson, seconded by Lynch that permission be granted
and that Mr..Rumsey's expenses be paid: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger
and Robinson voting aye by voice vote.
Manager Smith further reported that he has received a firm offer of $140,000.00 purchase price
for certain property located in the 1200 block on South lst Street and owned by Marius, Bertholet.
This amount may be paid at the rate of $800.00 per month the first five years, at which time the
balance may be paid in full or the monthly payments continued. Mr. Smith indicated that this
prs^^ and requested the City Council's permission to decline this offer. It was MOVED
by Robinson, seconded by Kizii�bitz that the City Manager be and is hereby authorized to decline
this offer: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye
by voice vote.
There being no further business to come before the Council,it was MOVED by Kurbitz, seconded by
Brazier, that we do now adjourn at the hour of 4:55 p.m: carried, Brazier, Kurbitz, Lambert,
Larson, Lynch, Munger and Robinson voting aye by voice vote.

THE FOLLOWING TITLE FOR RESOLUTION NO. D -732 WAS INADVERTENTLY OMITTED FROM PAGE 582.
RESOLUTION NO. D =732, A RESOLUTION providing for the submission to the electors of the City of
Y.akima, Washington, at a special election, of a proposition of whether or not the retail sale of
raw milk, other than certified milk, shall be prohibited within the City of Yakima, Washington,
and a criminal penalty be improsed - upon conviction of a violation of such prohibition; and re-
questing the Auditor of Yakima County, Washington, to hold a special election.
These Minutes ordered corrected as follows at the regular meeting of September 21, 1964:
"Manager Smith indicated that the city is unable to find funds for this purchase and requested
the City Council's permission to decline this offer ".
