Mayor Larson Councilmen Brazier, Kurbitz, Lambert, Lynch, Muriger'`and- Robinson and City Manager Smith present on roll call. City Attorney Andrews absent and on vacation. Councilman Brazier ,gave the invocation. The minutes of the regular meeting of August 10, 1964 were'approved as read. This being the time fixed for the continuation of the hearing on the appeal from the Planning Commission's decision on the matter of rezoning; of the J :,.E-. Laney property located at West Lenox between Lenox and 12th Avenues, it was MOVED by Munger, seconded by Brazier that Ordinance No. 555 accepting the recommendation of the Planning Commission and rezoning said property, be passed as read: carried, Brazier, Kurbitz, Larson, and Munger voting aye on roll call. Lambert, Lynch and Robinson voting nay on roll call. Those Councilmen opposing this action explained that the Council is not being consistent with former decisions and that a precedent is being established which may make it difficult to deal with zoning this type of business in the future. Mr. Fred Velikanji, Attorney representing Mr. Laney and Mr. Laney were present at this meeting. ORDINANCE'N0.555, AN ORDINANCE accepting the recommendation of the Planning Commission and re- zoning property situated on the South side of Lenox Avenue between Pleasant Avenue and 12th Avenue in the City of Yakima from B -2, Local Business Zone to B -3, General Business Zone. Petition No. 292 praying for the annexation of certain property owned by Decoto Brothers and John V. Bolm located West of 24th Avenue and North of Washington Avenue, having been filed with the City Clerk on August 1, 1964, it was MOVED by Robinson, seconded by Munger that said Petition be referred to the City Manager and the Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote: In accordance with action taken by the City Council at their regular meeting of August 10, 1964, it was MOVED by Lambert, seconded by Lynch that Ordinance No. 556 providing for the increase of sewer service charges and amending the Yaki.rr ..a Municipal Code, be passed as read: carried, Brazier Lambert, Larson, Lynch, Munger and Robinson voting aye on roll call. Kurbitz voting nay on roll call Councilman Kurbitz explained that he believes that this increase will have an adverse affe on large users and that he would be in favor of some other rate structure. Mr. Garret Anderson who arrived late and after this ordinance was passed protested this.acti.on. ORDINANCE NO. 556, AN ORDINANCE fixing domestic sewer service charges within the City of Yakima; and amending Section 7.60.020 and 7.60.050 of the City of Yakima Municipal Code. Moved by Robinson, seconded by Munger that Ordinance No. 557 relating to the organization of the Fire Department, eliminating the position of Assistant Chief and adding one Battalion Chief position and amending the Yakima City Municipal Code, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lvnch and Robinson voting ave on roll call. ORDINANCE NO. 557, AN ORDINANCE relating to the organization of the Fire Department of the Citv of Yakima; specifying positions and personnel to constitute such a department; amending Section 1.44.010 of the City of Yakima Municipal Code; and repealing Section 1.44.150 of the City of Yakima Municipal Code. Moved by Robinson, seconded bv.Lynch that Ordinance No. 558 providing for the annexation of certa: property contiguous to the Yakima Municipal Airport and the City of Yakima and amending Ordinance ,No. 545 by correcting the legal description of the property to be annexed, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote. ORDINANCE NO. 558, AN ORDII\TANCE annexing property to the City of Yakima, and amending Section 1 of Ordinance No. 545, passed July 27, 1964, entitled "AN ORDINANCE annexing property to the City of Yakima "; and declaring an emergency. Moved by Munger, seconded by Lambert that Resolution No. D -726 amending Resolution No. D -719 pro- viding for the zonin.7 of,cbr -ta.in property. cnntiguous.to-the Yakima Municipal Airport and annexed by Ordinance No. 545 and 558,r-be passed as- °.read :''.carried`,-Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. RESOLUTION NO. D -726, A RESOLUTION of.the City Council of the City of Yakima declaring its in- tention to rezone real property, and amending Resolution No. D -719. The following bids having been received by a bid board, for the Madera Heights, Schmidt's Upland and L. K. Buchanan Addition sanitary sewers as provided for by L.I.D. No. 928: De Blasio Bros. Gaasland Co. Inc. $11,252.80 $12,880.40 and the City Engineer recommending that said bid be awarded to De Blasio Brothers who is the low bidder, it was MOVED by Lynch, seconded by Lambert that said bid be awarded to De Blasio Brothers and that the City Manager be hereby authorized to enter into a contract with said contractor up- on the filing of the proper-bond and insurance: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote. Their terms of service on the Planning Commission, expiring August 31, 1964, it was MOVED by Lynch, second by Robinson that Miss S. I. Anthon and Mr. Eugene L. Shields be and are hereby re- appointed for a six year term or until August 31, 1970: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote. Councilman Robinson recognizing Dr. A. J. Myers as present at this meeting, explained that Dr. Myers is interested in having his property on Tieton Drive zoned`�`�accordance with the City zoning code and the court ruling handed down in 1960'. After reviewing this case with Dr. Myers, it was MOVED by Robinson, seconded by Munger that the Yakima, City Council hereby give notice of its in- tention to rezone to B -2, Local Business Zone�the Dr. Myers property located near South 36th Avenue and Tieton Drive Yakima 1r�Jashington more fully described as follows• th t h if f th e wes a o e northeast quarter of the northwest quarter of the northeast quarter. of section 27, township 13 north, range 18 E.W.M., EXCEPT the south 125 feet of the north 155{'pdbf the east 125 feet of the west 150 feet and except the north 30 feet and the west 25 feet for road. Also the east half of the northeast quarter of the northwest quarter of the northeast quarter of said section 27, except the west 150 feet of the east 175 feet of the north 130 feet and. except the south 100 feet 'of the north 230 feet of the west 140 feet of the east 165 feet and excep the north 30 feet and the east 25 feet for road, which was involved in litigation in 1960 and requests that the Yakima City Planning Commission consider the matter in glue cnursP_ it IN r a 576 AUGUST 17, 1961 After further discussion as to the'filling station already located on what was formerly a part of Dr. Myers' property, it was MOVED by Robinson, seconded by Munger that the original motion be amended to include "and rezone to B -3, General Business Zone, the property now occupied by a service station, more fully described as follows: the south 125 feet of the north 1.55 feet of the east 125 feet of the west 150 feet; EXCEPT the north 30 feet and the west 25 feet for road; of th�' west half of the nor.theast,qua.rter of the northwest quarter of the northeast quarter of Section 27, township 13 north, Range 18 E.W.M., if the present use of said property is nonconforming to a B -2, Local Business ZoneW. carried, Brazier, Kurbitz, Lambert, Larson, L,Tnch, Munger and'Robins n voting aye by voice vote. Mayor Larson then called for a voice,_vote -,on -the original motion as amended and Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voted aye. Motion carri d.
