Munger absent. MOVED by'.Robinson, seconded by Lambert that Councilman Munger be excused from this meeti carried, Brazier, Lambert, Larson, Lynch and Robinson voting aye by voice vote. The invocation was given by Councilman Kurbitz. The minutes of the regular meeting of August 3, 1964 wer e approved as read. This being the date fixed for the continuation of the hearing on the J. E. Laney rezone and one member of the Council being absent, it was MOVED by Robinson, seconded by Lynch that this matter be continued to the next regular meeting of the City Council on August 17, 1964: carried, Brazie Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Munger absent. Mr. E. Fred Velikanji wttorney for Mr. Laney was present at this meeting and agreed to this action. This being the time fixed for the hearing or, Petition No. 287 as filed by Dan Davis Corporation requesting the vacation of a portion of Rock Avenue and there being no protests in writing car otherwise to this action, it was MOVED by Lambert, seconded by Lynch that Ordinance No. 55I; providing for said vacation be passed as read: carried, Brazier, Kurbitz, Lambert, Larson,iLynch and Robinson voting aye on roll call. Munger absent. Discussion indicated that a new right of way for street has been obtained_and that this property will not be needed. ORDINANCE NO. 5517 AN ORDINANCE providing for the vacation of a public street in the City of Yakima, Washington This being the date fixed for the hearing on Resolution No. D -716 being a resolution of intention to construct curbs gutters and to surfact Richey Road from 29th Avenue to 30th Avenue, it WAS MOVED by Lynch, seconded by Lambert that Ordinance No. 552 providing for said improvement and creating L.I.D. No. 927, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. Munger absent. There were no protest to this improvement. ORDINANCE NO. 552, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with. asphaltic concrete, constructing concrete curbs and gutters, together With necessary drainage features; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. i Resolution No. D -718 being a resolution of intention to construct sanitary sewers in Schmidt,'s Uplands, Madera Heights and L. K. Buchanan Addn and fixing this date for the hearing on said projects, it was MOVED by Robinson, seconded by Lynch that Ordinance No. 553 providing for said improvement and creating L.I.D. No. 928, be passed as read: carried, Brazier; Kurbitz, Lambert Larson, Lynch and Robinson voting ave bn roll call. Munger absent. Mr. Howard Hettinger, attornE representing Mr. Max seals, petitioner, was present. Mr. Poletis protested this project. ORDINANCE NO. 553, AN ORDINANCE providing for the improvement of certain property by constructing a pipe sewer with the necessary wye branches and manholes; establishing a Local Imp-roveriet Distric providing for the method of payment thereof, and creating a special fund. The City Engineer having reported the completion of L.I.D. No. 906, West Viola, Barge and Mary Lin Paving District and due notice of hearing on the assessment roll having been given for this date, it was MOVED by Lambert, seconded by Robinson that Ordinance No. 554 confirming said assess- ment roll and every part thereof be passed.as read: Brazier, Lambert, Larson, Lynch, and Robinson voting aye an roll call. Munger absent. ,There were no protest filed in writing or otherwise. Discussion indicated that the final assessments are approximately $44.00 higher than the estimated costs and Council members suggested that property owners be advised at the time of hearing if this happens in the future. ORDINANCE NO. 554., AN ORDINANCE confirming the assessment roll covering Local Improvement Distric No. 906 as created and established by Ordinance No. 4.06 of the Ordinances of the City of Yakima. I This being the time for the hearing on the appeal from the Planning Commissions. decision onithe matter of rezoning certain property at 111, 113 and 1151 North 6th Avenue as requested by William E. Shaw on Petition No. 270, Mr. Harry Hazel, attorney representing said petition discussed1this matter with members of the Council and indicated that he wished to withdraw his appeal and that he will file a new petition asking for the rezoning of a larger area. It was then MOVED by Robinson, seconded by Lambert that the matter of this appeal be postponed indefinitely: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and Robinson voting ave by voice vote. Munger absent. Petition No. 291 having been filed with the City Clerk by L. K. Buchanan Addition on August 6, 1964 requesting; the formation of a Local Improvement District for the - construction of water:imains in L.K: Buchanan Addition, it was MOVED by Lynch, seconded by Brazier that said petition be refer red to the City Manager and'Staff for study and recommendation: carried, Brazier, Kurbitz ,:Lambe Larson ,Lynch-and Robinson voting aye by voice vote. Munger absent. A Notice of Intention to Commence Annexation Proceedings having been filed with the Citv Clerk on Au:ust 7, 1964 by Decoto Brothers, describing property West of 24th Avenue and North of Washington Avenue and Mr. Howard Hettinger, attorney representing said Decoto Brothers, being present and in- dicating that he has the power of attorney to act in this matter for these signers, it'was MOVED by Robinson, seconded by Lynch that this date and time be set as the time for meeting with the representative of the initiating parties; carried, /,Brazier, Kurbitz, Lambert, Larson, L�Tnch and Robinson voting_ ave by voice vote. Mr. Hettinger having indicated that said signe s of this notice will assume their share of the City's existing indebtedness, it was MOVED by;Robins n seconded by Brazier that the annexation as proposed by Decoto Brothers be acc=epted by the City of Yakima and that the area to be annexed be required to assume its share of the City's existing in- debtedness: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. No. 922, be passed as read: carri , Brazier, Kurbitz, Lambert) Larson, L�7nch and Robinson voting aye by voice vote. Munger absent. Mr. Joe Earhart who was awarded the bid for this project, was present and explained that Mr. McCalla of the 'Mc Calla Excavation Company, Wenatchee, Washington, has worked for him in the past and that il was his intention when he submitted the bid which was figured by Mr. McCalla, that said bid be sublet to him. Public Works Director Mayo approved this action and indicated that the Bonding Company has recognized the sub contractor. RESOLUTION NO. D -7241 A RESOLUTION granting permission to Joe Earhart & Son to sublet a public improvement contract. Moved by Lynch, seconded by Robinson that Resolution No. D -725 designating the site for future installation of water diversion facilities and specifying the use of a 4$" water transmission ma be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. Munger absent. This matter was discussed with Mr. Les Newlun and Mr. Edgar Haynes. RESOLUTION NO. D -725, A RESOLUTION designating the site for future installation of water diversi facilities, and specifying the use of a 4$" water transmission main. The Planning Commission reporting on Petition No. -479 as.filed by.the'Trinity Church of the Nazarene and recommending that said property be annexed and zoned as R -1 Single Family zone, it was MOVED by Robinson, seconded by Lynch that the Peitition for annexation filed by the.Trinity Church of -the Nazarene, being petition No. 279, be approved as meeting the requirements of law; that the City Manager and the Mayor be authorized to obtain waivers of.a meeting of a Review Boar as authorized bylaw and that an order be prepared fixing August 31, 1964 as the time for a publi hearing by the City Council on this petition: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Munger absent. ° The Planning Commission reporting on and making recommendations on Petitions No. 284 as filed by Ralph E. Bates requesting the rezone of property located at 1812 Nob Hill Boulevard; No. 2$$ as filed by Gerald F.-De Zarn requesting, the rezone of property at 811 and 813 North Front Street and on the matter of Ottaiano and Mc Neill rezone at 106 North 7th Avenue and 105 Pierce Avenue, it was MOVED by Robinson,.seconded by Lunch that August 31, 1964 be set as the time for a hearing the City Council on the matter of these rezones and that the .City Clerk give notice of such hear- ing as required by law:- carried, Brazier, Lambert, Larson, Lynch and Robinson voting- aye by voic vote. No. 924: Superior Asphalt Paving Yakima Cement Products 31,353.75 37,267.25 it was MOVED by Robinson, seconded by Kurbitz that the recommendation of the Cit v Engineer be accepted and that this bid be awarded to Superior Asphalt and Concrete Company and that the City Manager be and is hereby authorized to enter into a contract on behalf of the City of Yakima upon the filing of the proper bond and insurance by said contractor: carried, Brazier, Kurbitz, Lambei Larson, Lynch and Robinson voting aye by voice vote. City Manager Smith reported on sewer rates indicating; that he is recommending that the present charge be doubled since the Water Fund is subsidising the Sewer Fund, due to the improvements and expansions being made in connection with pollution control. Nir. Gar.ret­Anderson who was present at this meeting protested this action. After discussion, it was MOVED by Robinson, seconded by Lambert that the necessary ordinance for the recommended increase in sewer rates be prepared for the next regular meeting of the City Council: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Manager Smith having request,,d permission to attend the International City Managers Conference in Chicago on September 27 throu ^h October 2, indicating that it will cost approximately $360.00, it was MOVED by Lynch, seconded by Lambert that permission be granted and that his expenses beipaid: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote.
