HomeMy WebLinkAbout07/27/1964 Business Meeting1 1 Il 569 JULY 27,'1964 3 p.m. The City Council met in regular session, Assistant Mayor Donald Brazier, Councilman Lambert, Lynch, Munger and Robinson, City Manager Smith and City'Attorney Andrews present on roll call. Mayor Larson and Councilman Kurbitz absent. It was MOVED by Robinson , seconded by Lynch that Mayor Larson and Councilman Kurbitz be excused from attendance at this meeting; carried, Brazier Lambert, Lynch, Munger and Robinson voting aye by voice vote. Larson and Kurbitz absent. The Invocation was given by Councilman Lynch. The Minutes of the regular meeting of July 20, 1964 were approved as read. This being the time fixed for the Hearing on Resolution No. D -708 being a Resolution of Intenti to improveiacertain property located on Nob Hill and South 24th Avenue by the construction of curb, gutters, sidewalks and surfacing, it was MOVED by Robinson, xeconded by Munger that Ordinance No. 544 providing for said improvement and creating L.I.D. 924 be passed as read: in discussion, Mr. & Mrs. Seips asked if the full 30 feet right of way was required for this im- provment as Mrs. Anderson their neighbor had only given 25 feet. Council stated that the full 30 feet is needed for this improvement and that the Anderson right of way was obtained prior to the time it was decided that a sid.ewal)Swould be erected. Mr. & Mrs. Seip stated that they did not wish the erection of a sidewalk presently_ in .'th,ks I'ocatlon� - - -but were willing to agree to some arrangement for releasing this request at some future time. There was discuss as to the method of providing for the Seips to have control over the eatterly five feet of said 30 feet strip until such time as the Seips disposed of the property or gave their consent to the construction of the sidewalk. The staff was instructed to work out such an arrangement wit Mr. and Mrs. Seips. After full discussion of this Matter Assistant Mayor Brazier.asked for a vote on the motion as made: carried, Brazier, Lambert, Lynch, Munger and Robinson voting aye by voice vote. Larson and Kurbitz absent. This being the time fixed for the hearing on the appeal of the J. E. Laney rezone: -for certain property located on the South side of Lenox Avenue between Pleasant Avenue and 12th Avenue from B -2, Local Business Zone to B -3, General Business Zone, it was MOVED by Lynch seconded by Munger that Ordinance accepting the Planning Commission's recommendation be accepted: In discussion Mr. Fred Velikanje, Attorney for Mr. Laney requested that this matter be deferred until a full council was present. It having been determined that full Council would be.opr esen at the August 10, 1964 meeting at 3 p.m., it was MOVED by Robinson , seconded by Munger that this matter be continued until that time: carried, Brazier, Lambert, Lynch, Munger and Robinson voting aye by voice vote. Larson and Kurbitz absent. No action was taken on the original motion made'. Petition No. 289, as filed by Corporation of Catholic Bishop of Yakima with the -tit!t Clerk on July 22, 1964 , to create a Local Improvement District for the construction of Watermains on Lot 11 and the West 100 feet of Lot 10, Phoebe D. Adams subdivision, it was MOVED bybLynch, seconded by Robinson that said petition be referred to City Manager and Staff for study and recommendation: carried, Brazier, Lambert, Lynch, Munger and Robinson voting aye on roll call. Larson and Kurbitz absent. Petition No. 290 as filed by Max Seals with the City Clerk on July 23, 1964 , to create a Local Improvement District for the paving of 52nd Avenue from Englewood Avenue to Madera way, it was MOVED by.Robinson, seconded by Lynch, that said petition be referred to the City Manager and staff for study and recommendation: carried, Brazier, Lambert, Lynch, Munger and Robinson voting aye on roll call. Larson and Kurbitz absent. An Ordinance appropriating the sum of $1,077.00 from the unappropriated moneys of the 1962 street improvement Bond Redemption Fund to Account 5 -20 was read in its entirety w�as� ordered laid on the table for one week to be read at the next regular meeting of the counciy on August 3, 1964. MOVED by Munger seconded by Lambert that Ordinance No. 545, an Ordinance annexing property to the city of akima, Southeast Clear Zone, Airport property, be passed as read: Brazier, Lambert, Lynch, Munger and Robinson voting aye on roll call. Larson and Kurbitz absent. ORDINANCE NO. 545, AN ORDINANCE annexing property to the City of Yakima MOVED by Lynch, seconded by Munger, that Resolution No. D -719, A RESOLUTION of the City Council of the City of Yakima declaring its intention to rezone real property, at Airport SE Clear Zone, be passed as read: carried, Brazier,. Lambert, Lynch, Munger and Robinson voting aye on roll call Larson and Kurbitz absent. RESOLUTION NO. D 719 A Resolution of the City Council of the City of Yakima declaring its intention to rezone real property Moved by Lambert , seconded by Munger that Resolution No. .D -720, a resolution authorizing a contract for work, labor and materials without calling for bids for construction of domestic watermain to serve Holy Redeemer Catholic Church, be passed as read: Brazier, Lambert, Lynch, Munger and Robinson voting aye on roll call. Larson and Kurbitz absent. In answer to a memorandum to the City Council by City Attorney Fred Andrews regarding the city's position in the Parker Youth Fondation suit against the City of Yakima and School District No. 7, it was Moved by Robinson, seconded by Munger, that the City Attorney be authorised to appear for the City in the Parker Field lawsuit and indicate to the court that the City,is desirous of having title to Parker Field vested in the City and is willing to accept title to Parker Field if the court finds that the past actions of the city in conveying that property to the school district is invalid; carried, Brazier, Lambert, Lynch, Munger and Robinson voting aye by voice vote. Larson and Kurbitz absent.
