Councilman Kurbitz absent on 'roll call but present after 3:17 P.M. for the balance of this meeting. Moved by Brazier, seconded by Munger that Councilmen.- Lambert and Robinson be excused from this meeting: carried, Brazier, Larson, Lvnch, and Munger voting aye by voice vote.' The invocation was given by Councilman Lynch. The minutes of the regular meeting of June 15, 1964 and June 22, 1964 were approved as read. This being the time fixed for the hearing on Petition No. 264 as filed by Jack Cahoon for Lincoln Center, Inc., and others, praying for the annexation of certain property north of Lincoln Avenue between Wright Avenue and 22nd Avenue, it was MOVED by Brazier, seconded by Munger that Ordinance No., 536 providing for said annexation and the zoning of said property, be passed as read: carrie Brazier, Kurbitz arson, Lynch and Munger voting ave on roll call. Councilmen Lambert and Robinson absent. ✓ protests'.filed June 22, 1964 were reviewed. Mr. Curt Heath, 420 Wright Avenue could not attend this meeting but Mrs. Ralph Jackson, 419 North 21st Avenue was present an indicated that she and Mr. Heath wished to protest the zoning of their property stating that they believed they should be zoned B -2 since it joins the Cahoon property which is already a business zone. Councilman Lynch suggested that hlrs. Jackson and Mr. Heath make application for business zoning when they have more complete plans for the development of their property. The written protests filed by .her. Jim Brunner and Mr. & Mrs. James Sharples were noted and Mr. Sharples being present indicated that he does not wish to be annexed. ORDINANCE NO. 5361 AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning said property. This being the time fixed for the hearing on Petition No. 265 as filed by the Corporation of Catholic Bishop praying for the annexation of certain property east of Broadway and South of Pierce, it was MOVED by Brazier, seconded,by Munger that Ordinance No. 537 providing for said annexation and zoning said property, be passed as read: carried, Brazier, Larson, Lvnch, and Munger voting aye on roll call. Councilmen Lambert and Robinson absent. ,Discussion indicated that there are no protests in writing or otherwise to this action. Mr. Harry Hazel, attorney representing the Corporation of Catholic Bishop, assured the Council that adequate r/w will be made available for streets and city services when plans for the property are determined. ORDINANCE NO. 537, AN ORDINANCE, providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima, and zoning the same as R -2, Two - Family Residence Zone. This being the time for the hearing on Petition No. 266 as filed by Max Seals and others praying for the annexation of certain property North of Englewood between Scenic Drive and North 51st Ave3 and there being no protests in writing or otherwise, it was MOVED by Munger, seconded by Lynch that Ordinance No. 538 providing for said annexation and zoning; said property, be passed as read: carried., Brazier, Kurbitz, Larson, L,rnch, Munger voting aye on roll call. Lambert and Robinson absent. ORDINANCE NO. 538, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima, and Zoning the same as R -1, Single Family Residence Zone. Construction of L.I.D. No. 910, Sutor Addition Domestic Water District, having been completed and due notice of hearing on the assessment roll having been .given for this date, and there being no protests in writing; or otherwise, it was MOVED by Lynch, seconded by Munger that Ordinance No. 539, confirming said assessment roll and every part thereof, be passed as read: carried, Brazier Kurbitz, Larson, Lynch and Munger voting aye on roll cal-1. Lambert and Robinson absent. ORDINANCE NO. 539, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 910 as .created and established by Ordinance No. 454 of the Ordinances of the City of Yakima. Due notice of hearing having been given for this date for the rezoning of certain property locat- ed at 213 and 215 South llth Avenue as requested on Petition No. 267 and filed by Ralph A. Haight and Rolf Havenga, it was MOVED by Brazier, seconded by Kurbitz that Ordinance No. 540 providing for rezoning, be passed as read. carried, Brazier, Kurbitz, Larson:, Lynch and Munger voting; aye on roll call. Lambert and Robinson absent. Mr. Hayenga, Mr. Haight and Mr. Henry Savage being present spoke for this action. ORDINANCE NO. 5401 AN ORDINANCE accepting the recommendation of the Planning Commission to re- zone certain property located at 201 through 215 South 11th Avenue in the City of Yakima, Washing from R -3, Multiple- Family Zone, to B -1, Modified Business Zone. Petition No..273 having been filed with the City Clerk on June 19, 1964 by Richard M. Miller re- questing the rezoning_ of certain property located at the Northeast corner of West,Walnut and 40th Avenue, it was MOVED by Brazier, seconded by Munger that said petition be referred to the Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Larson, Lynch and Munger voting; aye by voice vote. Lambert and Robinson absent. A Notice of Intention to commence Annexation Proceedings having been filed with the City Clerk on June 15, 1964 by Paul M. Lewis, Pastor for the Trinity Church of the Nazarene and Pastor,Lewis beinc: present at this meeting, it was MOVED by Brazier, seconded by Lynch that this day, June 29, 1964 be set as the time for a meeting with the initiating parties who signed said Notice of Intention: carried, azier, Kurbitz, Larson, Lynch and Munger voting aye by voice vote. Lamber and Robinson absent.VIt was then MOVED by Lynch, seconded by Munger that this proposed arnexatio be accepted by the .City of Yakima and that the area to be annexed be required to assume its:share of the City's existing indebtedness. Upon instruction by City Attorney Andrews, it was MOVED by Brazier, seconded by Munger that said motion be amended to state further, "except said property t be annexed may be exempted from taxation as provided by law: carried, Brzier, Kurbitz, Larson, Lynch and Munger voting aye by voice vote. Lambert and Robinson absent. Mayor Larson then,calle for a,voi,ee vote on.the original motion as amended and it carried: Brazier, Kurbitz,.Larson, Lynch, and. - Munger voted aye by voice vote. A Notice of Intention to Commence Annexation Proceedings having; been filed by Decoto Bros., on June 24, 1964, and John Decoto and Howard Hettinger, attorney representing said firm, being present at this meeting, it was MOVED by Brazier, seconded by Munger that this date, June 29, 196 be set as the time for a meeting with the initiating paries: carried, Br zler, Kurbitz, Larson, Lynch, and Munger voting aye on voice vote. Lambert and Robinson absent. Moved by Brazier, seconded by Lynch that Petition No. 274 as filed with the City Clerk on June 19, 1964, by A. E. Clift and others,- No.. 275 as filed on June 23, 1964, by Rex E. Sweitz and others No. 276 as filed on June 24, 196 -'by M. J. Herberg and others, No. 277 as filed on June 24, 19 4 as filed by Marvin L. Jones and others and No. 27$ as filed with the City Clerk on June 24, 1964 by Ray Greenup, be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Kurbitz, Larson, L ,.,nch and Munger voting-aye by voice vote. Lambert and Robinson absent. Moved by Brazier, seconded by Munger that Ordinance No. 541 relating to traffic regulations, be passed as read. Public Works Director Mayo and City Attorney Andrews recommending certain additions and corrections, it was MOVED by Brazier, seconded by Munger that said Ordinance be amended as recommended by the City Attorney: carried, Brazier, Kurbitz, Larson, Lynch and Munger voting aye by voice vote. Mayor Larson then called for the roll call vote on the original motion to pass Ordinance No. 541 as amended and it carried: Brazier, Kurbitz, Larson, Lynch and Munger voting aye on roll call. ORDINANCE NO. 541, AN ORDINANCE relating to traffic regulations; prescribing maximum speed limit designating the proper positions for turning motor vehicles; designating certain streets and alle for one -way traffic; regulating and restricting the stopping, standing and parking of motor vehic amending.Sections 9.28.060 (b), 9.28.140 (a), 9.36.050 (h) , 9.36.070, 9.36.120 and 9.36.170 (1), all of the City.of Yakima Municipal Code; and repealing Section 9.36.050 (f) of the City of Yakim Municipal Code. Moved by Munger, seconded by Brazier that Resolution No. D -701 the final payment to the W. H. Gregory Company for work done on the Yakima Industrial Waste Irrigation System Improvement Project and providing that $1,947.84 will be withheld from said payment to satisfy certain leins as filed against this project, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch, and Munger voting aye on roll call. Moved by Munger, seconded by Lynch that Resolution No. D -702 providing for the execution of a Pipe Line Crossing Agreement with the Oregon Washington Railroad & Navigation Company in connecti with the construction of the Lenox Overpass, be passed.as read: carried, Brazier, Kurbitz, Larso Ljrnch and Munger voting aye on roll call. Lambert and Robinson absent. RESOLUTION NO.. D -702 (Union Pacific Railroad Company Form - no caption) Authorizing execution of Pipe Line Crossing Agreement. Moved by Lynch, seconded by Brazier that Resolution No. D -703 approving Street Grades for State Hio;hway Construction through a portion of the City of Yakima in connection with the construction of the Lenox Avenue Interchange, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch, and Munger voting aye on roll call. D- 703,'A RESOLUTION entitled "A RESOLUTION approving Street Grades for State High- way construction through a portion of Yakima, Yakima County, Washington." Moved by Brazier, seconded by Lynch't at Resolution No. D -704 assuring the Department of Highways of the State_ of Washin gton, that :tkeri l not allow further encroachment upon the right.. -of -way of South First Street in Yakima to Lenox Avenue Interchange or install any traffic controls that will affect the free flow of traffic on said streets, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch, and Munger voting aye on roll call. No action was taken o this matter at this time. Moved by Brazier, seconded by Munger that Councilman Lynch be excused from the regular July 6, 1964 meeting:: carried, Brazier, Kurbitz, Larson, Lynch, and Munger voting aye by voice vote.
