HomeMy WebLinkAbout06/15/1964 Business Meeting1 1 E, 557 JUNE 152-1964 The City Council met in regular session, Mayor Larson, Councilmen Brazier, Lambert, Lynch , Munger and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Clerk of Council having advised that _Councilm_&h Kurbitz has requested that he be excused from this meeting because it is necessary for him to be out of town, it was MOVED and seconded that Councilman Kurbitz be excused and this motion carried: Brazier,. Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote. Councilman Lambert gave the invocation. The minutes of the regular meeting of June,-8, 1964 were approved as corrected. The first order of business considered, was the matter of the petition requesting enforcement of the laws and ordinances prohibiting the sale of cigarette and tabacco to persons under 21 years of age as filed by Kenneth Muth and signed by 199 Franklin Jr. High School Students. This matter was discussed with Kenneth Muth, Tom and Tim Utterback, who represented the students, Paul.Mercy who represented owners and operators of vending machines, Mrs. Brooks, Mrs. Sprague , Mrs. Muth, Mrs. Kirby, representing parrents, Miss Crosslin, a teacher and Oscar Soderstrom, Chief of Police Discussion indicated that our Police staff is inadequate to properly enforce these laws and ordinances and that parents should share the responsibility of enforcement and education. It was also indicated that it is nna b�rt confusing for young people if some laws are to be enforced and others not. No formal action was taken by the Council on this matter. This being the time fixed for the hearin;7 on Resolution No. D -691 being a resolution of intention to improve certain property fully described in said resolution, by constructing sanitary sewers as requested by petition No. 242, 245 and 247, it was MOVED by Lynch, seconded by hunger that Ordinance No. 533 providing for said improvement and creating L.I.D. No. a22, be passed as read: It having been determined that the third line in Section 7, had been inadvertently omitted, it wa MOVED by Robinson, seconded by Lambert that said ordinance be amended and the following line adde to said section, "all sums paid on account,of the aforesaid special assessments, including ": carried, Brazier, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz absent. ,After After discussion with persons present, a roll call vote was taken and the original motio to pass ordinance No. 533 as amended, was carried;- //Brazier, Lambert, Larson, L rich, Munger and Robinson voting aye on roll call. V Mr, and Mrs. Roy Ruckman protested the forma- tion of this district both in writing and orally and matters of procedure and construction were discussed with Mr. Harlan Ross and Mr. John Anderson who were for the project and with Mrs. Regimbal and Kenneth Kenchloe. Interested persons were advised to file protests in writing withi the next 30 days. ORDINANCE NO. 533, AN ORDINANCE providing for the improvement of certain property by constructs a pipe sewer with the necessary wye branches and manholes; establishing a Local Improvement District; providing for the method of payment thereof, and creating a special fund. This being the time fixed by the City Council for the hearing on Resolution No. 692, being a resolution of intention to improve certain property by constructing concrete curbs and gutters ant the surfacing of Summitview from 40th Avenue to 42nd Avenue and there being no protests in writinf or otherwise, it was MOVED by Munger, seconded by Lynch that Ordinance No. 534 providing for said improvement and creating L.I.D. No. 923, be passed as read: carried, Brazier, Lambert, Larson Lynch, Munger and Robinson vot}i.g aye on roll call. Kurbitz 'absent. VIMatters of sidewalk were discussed with Mr. Aubrey Shelton and Mr. Don Tunstall, his attorney. ORDINANCE NO. 5342 AN ORDINANCE providing for the improvement of certain property by grading ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund.. This being the time fixed for the hearing on the assessment roll for L.I.D. No. 899, Peach Ten, Meadow Courts & Sutor Addition Water District, it was MOVED by Robinson, seconded by Brazier that Ordinance No. 535 confirming said assessment roll and every part thereof, be passed as read: carried, Brazier, Lambert, Larson, Lynch, Munger and Robinson voting aye on roll call. Kurbitz absent. Mr. Stan Lebens having filed a. protest in writing with the City Clerk was present and discussed his opposition with the Council. Mrs. Swallow, Mrs. Bierley and Mr. Parson also orally protested being included in this district. ORDINANCE NO. 535, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 599 as created and established by Ordinance No. 317 of the Ordinances of the City of Yakima. Petition No. 271-having been filed with the City Clerk on June 8, 1964 by John E. Mullooly and others, requesting the formation of a local improvement district for the construction of curbs, gutters and the surfacing of an area fronting on Willow Street, it was MOVED by Brazier, seconded by Robinson that said petition be referred to the City Manager and staff for study and recommenda� tion:, carried, Brazier, Lambert, Larson, LTrnch, Munger and Robinson voting aye by voice vote. Petition No. 272 haveing been filed with the City Clerk on June 10, 1964 by Robert W. Mc Gee and others requesting the formation of a local improvement district for the construction of curbs, 2'utters and the surfacing of Walnut.Street from South 39th Avenue to South Glen Drive, it was MOVED by Brazier, seconded by Munger that said petition be referred to the City Manager and staff for study and recommendation:, carried, Brazier, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote. Moved by Lynch, seconded by Munger that Resolution No. D -698 vacating a portion of Madera Way as platted in Schafer Addition, as requested on Petition No. 26$ and filed by Howard A. Swanson and others, be passed as read: carried, Brazier, Lambert, arson, L,,nch, Munger and Robinson voting aye on roll call: carried, Brazier, Lambert, Larson, L rich, Munger and Robinson voting aye on roll call. Kurbitz absent. RESOLUTION NO. D -698, A RESOLUTION vacating a portion of a public utility easement within Schafer Addition to the City of Yakima. Moved by Robinson, seconded by Munger that Resolution No. D -699 providing for the vacation of a portion of Lots 1 and 2 of ' Zumwalt's Plat as described in Petition No. 269 and filed by *Cecil W. Parker and others, be passed as read: carried, Brazier, Lambert, Larson, tlhch., Munger and Robinson voting aye on roll call. RESOLUTION NO. D -699, A RESOLUTION vacating a public utility easement within Zumwalt's Plat within the City of Yakima. F, 5b8 JUNE 15, 1964 Moved by Lvnch, seconded by Lambert that Resolution No. D -700 authorizing the City Manager to accept a federal grant for the Yakima Municipal Airport, for the purpose of relocation South 16th Avenue including new fencing, drainage and lowering ALS Cables: carried, Brazier, Lambert, Larso Lvnch, Munger and Robinson voting ave on roll call. RESOLUTION NO. D -700, A RESOLUTION authorizing the City Manager of the City of Yakima to accept federal grant for Municipal Airport purposes. . Member of the City Coi_lncil indicating that there will not be a quorum present to hold a regular meeting on June 22,. 1964, it was MOVED by Brazier, seconded by Lambert that all matters fixed for hearing; on June 22, 1964 be continued to June 29, 1964 carried, Brazier, Lambert, Larson, Lynch Munger and Robinson voting aye by voice vote. Kurbitz absent. Manager Smith_ reported that Captain Madden of the Police Department has been elected to the posi- tion of 5th Vice President of the National Foot Printers Association. He also reported that a Parks & Recreation Seminar will b e held on Monday,•.June 29, 1964 at the University'of,.,J8hington in Seattle. There being no further business to come before the Council, it was MOVED by Lynch, seconded by Brazier that we do now adjourn at the hour of 10:•45 P.M. carried, Brazier, Lambert, Larson, Lyncl Munger and Robinson voting aye on roll call.
