HomeMy WebLinkAbout06/08/1964 Business MeetingF, 554 JUNE $, 1964 The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lambert; Lynch and Munger, City Manager Smith and City Attorney Andrews present on roll call. Robinson absent on roll call and until the hour of 4:00 otclock p.m. The invocation was given by Don Brazier. The minutes of the regular meeting of June 1, 1964 were approved as read. In accordance with action taken by the City Council at their regular meeting of May 18, 1964 with regard to the Planning Commissions report and decision on the matter of rezoning certain property located at 27 Kenny Drive as requested by Jake P. Leingang on Petition No. 253, City Clerk, J. A. I Smith, informed the Council that Mr. Leingang has withdrawn his request and asked that this matter be postponed indefinetly. No further action was taken by the Council on this matter. This being; the time fixed by the Council for the hearing on Resolution No. D -690, being a resolu- tion of intention to improve certain property by constructing a domestic water system with its necessary appurtenances in Larson Lots No. 2 and certain lots in Carriage Hill Addition as re- quested on Petition No. 244 and 246 and there bd ng no protests in writing or otherwise, it was MOVED by Brazier, seconded by Munger that Ordinance No. 532 providing for said improvement and creating L.I.D. No. 9,21, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and Munger voting aye by voice vote. Robinson absent. ORDINANCE NO. 532, AN ORDINANCE providing for the improvement of certain property by construdanp the necessary mains, fire hydrants, valves'a.nd other appurtenances for the purpose of supplying water for domestic use and fire protection; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. Petition No. 269 having been filed with the City Clerk on June 1, 1964 by Cecil W. Parker and others requesting; the vacation of a Public Utility easement within Zumwalt's Plat, it was MOVED by Brazier, (seconded by Munger that said petition be referred to the City Manager and staff for study and recommendation: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Munger voting aye by voice (I vote. Robinson absent. Petition No. 270 having; been filed with the City Clerk on the 5th day of June 1964 by Mr. William E. Slaw, requesting the rezoning; of certain property located at 115- North 6th Avenue, it was MOVED by Lynch, seconded by Brazier that said petition be referred to the Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and Munger voting aye by voice vote. Robinson absent. Moved by Lynch, seconded by Brazier that Resolution No. D -695 authorizing the execution of an agreement with Myrlin H. Ackerman d /b /a/ Avalon Service and Airways Rent -A -Car System at the Yakima Municipal Airport, be passed as read: carried, Brazier, Kurbitz; Lambert, Larson and Lynch voting ave on roll call. Munger voting nav and Robinsent absent. Rent -a -car operations at the Airport was discussed and Manager Smith and Airport Manager, Jim Eakin indicated that four such agencies in operation is sufficient because of the space problem. Mr. Ackerman discussed his operations indicating that his contract is with the 4th largest national car rental agency which has 138 firms in their chain. Mr. Bill Janes, operator of Bills Parking Service at the airport complained that no notice was given prior to the consideration of this action. RESOLUTION NO. D 695, A RESOLUTION authorizing the City Manager and Citv Clerk of the City of Yakima to enter into an Agreement with Myrlin H. Ackerman, d /b /a Avalon Service and Airways Rent -A -Car System. Moved by Lynch, seconded by Brazier that Resolution No. D -696 authorizing certain seal coating work on North 48th Avenue from Englewood to Fechter Lane and South 24th Avenue from Washington Avenue to Clinton Wav in connection with Yakima County's work on these streets, be passed as read:' carried , %Brazier, Kurbitz, Lamber, Larson, Lynch, and Munger voting aye on roll call. Robinson absent. J Manager Smith and Public Works Director Mayo explained this action, indicating that with- out such agreements with the County, neither the County or City would take care of border streets,i that the work is done ona cash or trade basis, and that we have a deficit "of some $600.00 with the Co,)nty at this time. RESOLUTION NO. D -696, A RESOLUTION authorizing the performance of certain sealcoating work on certain City streets by Yakima County. Moved by Brazier, seconded by Munger that Resolution No. D -697 vacating a public utility easement in Carriage Hill Addition, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and Munger voting aye on roll call. Robinson absent. RESOLUTION NO. D -697, A RESOLUTION vacating public utility easements in Carriage Hill Addition to the City of Yakima. The Planning Commission reporting on matters of zoning and recommending the annexation of certain property contiguous to the City of Yakima as described in Petition No. 264 and filed by Lincoln Center Inc., and Petition No. 265 as filed by Corporation of the Catholic Bishop of Yakima, it was MOVED by Brazier, seconded by Munger that said petitons be approved as meeting the requirements of law; that the City Manager and the Mayor be authorized to convene a Review Board, as required by law, for a hearing and review of these proposed annexations; and that an order be prepared fixing June 22, 1964as the time for a public hearing by the City Council: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and Munger voting aye by voice vote. Robinson absent. The Planning Commission reporting on matters of zoning and recommending the annexation of certain property contiguous to the City of Yakima as described in Petition No. 266 and filed by PMT Seals and others, it was MOVED by Brazier, seconded by Munger that said petition for annexation be ap- proved as meeting the requirements of law; that the City ('Manager and the Mayor be authorized to obtain waivers of a meeting of a Review Board, as authorized by law; and that an order be prepared fixing June 22, 1964 as the time for a public hearing by the City Council on this petition: carried, Brazier, Kurbitz, Lambert, Larson, Ljnch and Munger voting aye by voice vote. Robinson absent. The Planning Commission reporting on and recommending the reclassification of certain property located between 201 and 215 South 11th Avenue and 1010 West Wglnut as requested on Petition No. 267 as filed by Mr. Ralph Haight and others, it was MOVED by Brazier, seconded by Munger that June 22, 1964 be set as the time for a hearing by the City Council on the matter of the rezone of said property and that the City Clerk give notice of such heasng as required by law. With regard to the Planning UommissionTs report on a resolution of intention to rezone certain properties at 106 North 7th Avenue and 105 Pierce, namely the Ottaiano and Mc Neil properties, Manager Smith informed the Council that this matter has been continued to the July 7th meeting of the Planning Commission, The League of Women Voters having requested the closure of North 3rd Street for a county =wide political street rally, it was MOVED by Brazier, seconded by Kurbitz that-North 2nd.Street to' A Street rather than North 3rd Street to A Street be made available to the League of Women Voters on August 31, 1964 between the hours of 6:00 P.M. and 10:00 P.M: carried, Brazier, Kurbit Lambert, Larson, Lynch and Munger voting aye by voice vote. Robinson absent. Mrs. Patterson, a League member, discussed this .project, stating that it is being co- sponsored by the Junior Chamber of Commerce and the Downtown Merchants Association and indicated that she has letters fro KUTI, Cascade Broadcasting Company, KQOT, the Democratic Party and the Republican Party expressin interest and supporting such a project. She further stated that in view of the fact that every- one is,affected by whoever.is elected and a great deal is said about apathy and the unyormed voter-., it is felt that the best wav to work with the matter is to bring the candidates' tb the voter and they are asking for the use of a city street for approximately 4 hours to promote an informed vote in our community. Mr. Mel Joy, of the JC's and Mr. H. A. O'Riley of Teamster's Local 524 also spoke in favor of this street closure. Mrs. Patterson indicated that the League would be satisfied with the closure of North 2nd Street instead of North 3rd Street as requested. Lighting 1 at 2nd and Yakima Avenue With regard to the Planning Commission's report on Street /Beautification, Planning Director Rudy Gast stated that upon final vote of the Commission it was decided to recommend that the lights and plaits be installed for one year period on a trial basis subject to revocation if the instal lation is found to be unsatisfactory. Councilman Robinson expressed concern as to whether or not we have the authority to compel removal after installation and suggested that we have-some kind of contract to grant the City full authority for removal if the plan is unsatisfactory. It was indica ted that any other street beautification plans would be handled on the same one year plan. With regard to liability on the part of the city if someone is injured, City Attorney Andrews pointed out that the insurance filed with. the City will specifically name the City as an insured. Councilman Robinson stated he would go along with this if it is legally possible to have a one year contract, a binding agreement so that upon vote or resolution the lights would be removed and we could enforce it. Mayor Larson-did not vote on this because he wishes to ear from more people onthe matter before he endorses it. Moved by Lambert, seconded by Lynch that the staff submit a report to the Council regarding the method of accepting bids that is being used by the State and perhaps the County: carried, Brazie Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote. Manager Smith reported that Fire Chief Moore has been asked to participate in a training program to take place in several Alaskan cities, starting June 12, 1964 through July 1, 1964. His expens are to be covered by the State Board of Vocational Education. MOVED by Kurbitz, seconded by Robinson that permission be granted to Fire Chief Moore to participate in said training program: carried, Brazier, Kurbitz, Lambert; Larson, Lynch, Munger and Robinson voted aye by voice vote. Manager Smith reported that Chief Soderstrom has requested permission to attend a meeting of the FBI Academy graduates in Hood River on June 26th and 27th. MOVED by Kurbitz, seconded by Lambert that this request be approved : carried, Brazier, Kurbitz, Larson, Lambert, Lynch, Munger and Robinson voting aye by voice vote. Manager Smith also reported that Cliff Dopps, Chairman of the Water Study Committee has called a meeting for this evening, June 8, 1964, rather than an orientation meeting, and Don Gray is to be the technical advisor. He encouraged Council members to attend if possible.
