The City Council met in regular session, Mayor Larson, Councilmen Brazier, Lambert, Lynch, Mung
and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman
Kurbitz absent on roll call, but-.,present for the balance of the meeting after 3:10 P.M.
The invocation-.was given by Councilman Munger.
The minutes of the regular meeting of May 25, 1964 were approved as read.
In accordance with action taken by the City Council at their regular meeting of May 18, 1964,
it was MOVED by Munger, seconded by Robinson that Ordinance No. 527 accepting the recommendation
of the Planning Commission to rezone certain property located at 108 and 110 North. 7th Avenue ffy
from-R -3, Multiple - Family Zone, to B -1, Modified Business zone, as req.uested by A. J. Lenz, be
passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lvnch, Munger and Robinson voting
aye on roll call.
ORDINANCE NO. 527, AN ORDINANCE accepting the recommendation of the Planning Commission to re-
zone certain property located at 108 and 110 North 7th Avenue in the City of Yakima, Washington,
from R -3, Multiple - Family Zone to B -1,, Modified Business Zone.
In accordance with action taken by the City Council at their regular meeting of Play 25, 1964 and
full Council being present at this meeting, the resolution affirming the action of the City
Planning Commission in denying the application of J. E. Laney to rezone certain property located
on the south side of Lenox Avenue between Pleasant Avenue and 12th Avenue, was reread.and a
MOTION made by Lynch, seconded by Robinson to pass sameg was made. Matters concerning this case
were reviewed by Mr. Velikanje, Attorney for petitioner. Mayor Larson then called for a roll cal
vote and the motion again lost fbr the want of a majority vote: Lambert, Lynch and Robinson
voting aye on roll call. Brazier, Kurbitz, Larson and Munger voting Nay on roll call. A Motion
disapproving the recommendation of the Planning Commission to deny a rezone of property located
on the south side of Lenox Avenue between Pleasant Avenue and 12th Avenue , from B -2, Local
Business Zone to B -3, General Business Zone was then read and it was MOVED by Brazier, seconded t
Kurbitz that said motion be passed: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and
Munger voting aye on roll call. Robinson voting Nay.
Petiton No. 268 having been filed with the City Clerk on May 26, 1964 by Mr. Howard A. Swanson
requesting the vacation of a Public Utility Easement of the North 10 feet of the West 126.5 feet
of Madera Way as plated in Schafer Addition according to the plat thereof, it was MOVED by Lynch
seconded by Lambert that said petition be referred to the City Manager and Staff for study and
recommendation: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting
aye by voice vote. ;.
Moved by Robinson, seconded by Munger that Ordinance No. 528 fixing the time of delinquency and
prescribing the form of Installment Notes for the payment of the unpaid portion of L.I.D. No. c
Edgecliff Manor Sewer District, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson,
Lynch, Munger and Robinson voting aye on roll call.
ORDINANCE NO. 52$, AN ORDINANCE fixing the time of delinquency of installments of assessments 1
levied for the payment of the cost of the improvement in Local Improvement District No. 904, and
providing for the issuance -of Local Improvement District Installment Notes for the payment of
the unpaid portion thereof.
Moved by Munger, seconded by Lambert that Ordinance No. 529 fixing the time of delinquency and
prescribing the form of Installment Notes for the payment of the unpaid portion of L.I.D. No. 908
Horizon Heights Sewer District., be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, L nch
Munger and Robinson voting aye on roll call.
ORDINANCE N0. 529,. AN ORDINANCE fixing the time of delinquency of installments of assessments
levied for the payment of the cost of the improvement in Local Improvement District No. 908, and
providing for the issuance of Local Improvement District Installment Notes for the payment of the
unpaid portion thereof.
Moved by Munger, seconded by Robinson that Ordinance No. 530 relating to an Administrative Dept.
namely the Division of General Accounting and amending the. Yakima Municipal Code, be passed as
read: carried, Brazier, Kurbitz, Lambert, Larson, L,,nch, Munger and Robinson voting aye on roll
call.
ORDINANCE NO. 5301 AN ORDINANCE relating to the Administrative Department of the City of Yakima
called the Division of General Accounting; designatin g the Director of Finance as supervisor of
such division; specifying the duties and functions of such division; and amending Section 1.18.06
of the City of Yakima - Municipal Code.

ORDINANCE NO. 531, AN ORDINANCE relating to salaries for employees of the City of Yakima; desig-
nating job classifications and salary ranges for certain city positions; and amending Sections 2. 0.:
100 (b) and 2.20.100 (c) of the City of Yakima Municipal Code.
Moved by- Robinson, seconded by Lynch that Resolution No. D -693 authorizing the purchase of 24
Monument Covers and Bells for use by the Street Department without calling for bids, be passed as
read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye on roll
call.

The follo�.2 ng bids having been received on Monday the 25th day of May, 1964 for the Arterial StreE
Improvement project on Summitview Avenue:

Yakima. Cement & Asphalt Paving Co., '329,717.50
and Gray and Osborne, consulting engineers., recommending that said bid be awarded to Superior
Asphalt &.Concrete Company and City Manager Smith concurring with this recorf- mendation, it was
MOVED by Robinson, seconded by Lynch that said bid be awarded to Superior Asphalt & Concret Co.,
and that the City Manager be authorized to enter into .a. contract on behalf of the City of Yakima,
upon the filing of the proper bond and insurance: carried, Brazier, Kurbitz, Lambert, Larson,
Lynch, Munger and Robinson voting aye by voice vote. Mr. Robert Jump representing Gray and Osborn
was present at this meeting.
The follotiring bids having been received on Schedule I for the relocation of South 16th Avenue

Director of Public Works, John Mayo pointed out that the bid of Superior Asphalt & Concrete Co.,
is the lowest bidder and that it is necessary that a bid be awarded on this contract prior to JunE
6, 1964, in order that certain wage determinations as published in the specifications be covered
by us, but that he could not recommend that this award be made to the Superior Asphalt & Concrete
Company because they have just been awarded the major bid-on the Summitview Project and further
indicated that this contractor is not compatible with city standards :..and:'.spe.cifications on contrac
already held by -them. Discussion of this matter indicated that pre bid qualifications are being
considered by the staff. It was then MOVED by Robinson, Rte, seconded by Lambert that this
bid be awarded to Superior Asphalt & 'Concrete Company and that the City Manager be and is hereby
authorized to enter into a contract with said bidder upon the filing of the proper bond and
insurance: carried, Brazier, Lambert, Larson, Lynch and Robinson voting aye by voice vote.
Kurbitz and Munger voting 'Aky by voice vote. Councilman Kurbitz indicated that he is not against
awarding the bid but is not in favor of this project.
Also Public Works Director Mayo submitted a bid summary on Schedule II for the relocation of
South 16th Avenue for the construction of Fencing, showing the following bids received:

and he recommended the awarding of this bid to the Fencing & Awning Company using Alternate la.
It was then MOVED by Robinson, seconded by Lambert that said bid be awarded in accordance with
this recommendation and that the City Manager be authorized to enter into a contract with said
bidder,on behalf of the City of Yakima, upon the filing of the proper bond and insurance: Carrie
Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote. .
CH2M reporting for payment, Monthly Estimate No. 1 in the amount of $22,815.00 on the Sewage
Treatment Plat Additions, it was MOVED by Lynch, seconded by Robinson.that said estimate dated
May 27, 1964 be approved and payment authorized: carried, Brazier, Kurbitz, Lambert, Larson,
Lynch, Munger an d Robinson voting ave by voice vote.
Gray and Oaborne reporting on and recommending for payment, Monthly Estimate No. 1 in the amount
of $17,079.22 on the 16th Avenue & Tieton Drive Project, it was MOVED by Robinson seconded by
Lambert that said report dated May 28, 1964, be approved and the estimate therein set forth be
approved and payment authorized: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and
Robinson voting ave by voice -vote.

City Attorney Andrews having requested permission to file a motion in Yakima County Superior
Court, asking, for the dismissal of the Broadway Annexation suit, it was MOVED by Brazier,
seconded by Robinson that the City Attorney's recommendation be accepted and permission be grante
to file said motion for dismissal of this matter: carried, Lambert, Lynch,.Munger and Robinson
voting aye on roll call. Kurbitz, Brazier and Larson voting Nay on roll call.
Upon the recommendation of the City Manager, it was MOVED by Brazier, seconded by Lynch that
Clifford Dopps be appointed as Chairman of the Water Study Committee for the City: carried,
Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote.
There being no further business to come'before the Council, it was MOVED by Kurbitz, seconded by
Brazier, that we do now adjourn at the hour of 5:30 P. M: carried, Brazier, Kurbitz, Lambert,
