HomeMy WebLinkAbout05/25/1964 Business MeetingF�� 1 �I L 549 MAY 252 1964 The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll -call. Councilman Munger absent and excused. The invocation was given by Councilman Kurbitz. The minutes of the regular meeting of May 18, 1964 were approved as read. In accordance with action taken by the City Council at their regular meeting of May 18, 1964, Manager Smith-reviewed the matter of the recommendation made by the Action Committee requesting that the proposal of Architects Associated be considered equally along with those of other firms on a competitive basis -in terms of qualifications and costs involved to undertake a Downtown Study.,-: He' pointed out that,this group has expressed the hope that the City will move as ex- peditiously as possible to make a selection of a consultant to undertake the Central Business District Study and further explained that within 30 days the Architects will submit to the City and expansion of their outlinedproposal to provide greater detail describing the scope of work to be undertaken and requested that the Council authorize the staff to work with this group in order that recommendations can be made as quickly as possible. This matter was discussed by Councilmembers and Councilman L nch expressed the desire for mor information on how much of the 701 project funds can be used and whether or not the staff will be able to assist in this work. Councilman Kurbitz indicated that $50,000.00 for this study is too much and that he feels that h is only authorized to act on off - street parking study since this was the original problem to be considered by the Council and he protested the use of Federal Funds. Mayor Larson and Councilma Robinson indicated that the feasibility study, the planning for such projects as a Civic Auditor and other information regarding the downtown Central Business District, must be determined first before a true traffic pattern can be established and locations for off street parking be determi thus avoiding costly mistakes in the future. All persons having been heard, it.was MOVED by Lynch, seconded by Lambert that the staff be authorized to work with Archetects Associated and the Downtown Business District in order that recommendations and plans can be submitted as ex- peditiously as possible: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. In accordance with action taken by the City Council at their regular meeting on May 18, 1964, th matter of.the continuation -of the hearing on the appeal from the Planning Commission's decision a filed by J. P. Leingang in connection with the rezoning of property at 27 Kenny Drive was brough on for discussion and Manager Smith informed the Council that Mr. Leingang has asked that this matter be again continued for two weeks. It was MOVED by Brazier, seconded by Lynch that this matter be continued to the regular meeting of the Council on June 8, 1964: carried, Brazier, Kurbitz, Lamberts Larson, Lynch, and Robinson voting aye by voice vote. The City Council having continued to this date the hearing on the matter of the Appeal from the Planning Commission's decision in connection with Petition No. 260 as filed by J. E. Laney for Circle L Distributing Company, the resolution affirming the action of the City Planning Commissi in denving the application of Mr. Laney to rezone certain property located on the south side of Lenox Avenue between Pleasant Avenue and 12th Avenue was read and it was MOVED by Robinson, seconded by Lambert that said resolution.be passed as read: Discussion followed. Mr. E. Fred Velikanje, Attorney represented the petitioner in the absence of Mr. Homer Splawn, Attorney who presented this request to the Planning Commission. He discussed the Company's operation as a 5 island super service station which will retail gas & oil but will not have repair services. He pointed out.that this property is on the same side of the street as other business in the area, that this company w ll give property for the extention of Queen Avenue if and when the City needs such property; hat Mr. Laney employs college students. Mr. Velikanje filed with the Council a letter from the Yakima Vallev_Junior College stating that this company has rendered services as a training center for students learning Service Station Operation and a statement signed by 21 persons in the immediate area indicating that they are in favor of the type of structure to be built and the application for rezone. Mr. Thomas a property owner stated that he does not object to this operation but is concerned as to what protection property owners have from a less desireable business locating here in the future. Mr. Chris Mc Donald,, Mr. Donah and Mr. Wm. Anderson spoke in favor of the operation of this company and the rezoning of this property. In discussing the matter of a more restrictive Business Zone it was pointed out that a B -2, Local Business Zone,requires that a service station must be located 150 feet from a residential zone and that this could not be accomplished in this case. All persons having been heard, Mavor Larson called for the roll call vote on the motion to pass the resolution affirming the action of the Planning Commission and the motion failed for the want of a majority vote. Councilmen Brazier, Kurbitz and Larson voting nay and Councilmen Lambert, Lynch and Robinson voting aye on roll call. Councilman Munger absent. After due consideration, it was MOVED by Robinson, seconded by Kurbitz that this matter be continued for one week: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Munger absent. This being the time fixed for the hearing on Petition No. 262 as filed by Howard Farnsworth and others including the Bruce Glenwood Corporation, praying for the annexation of certain property between Chestnut and Tieton Drive and West Walnut and 46th Avenue, it was MOVED by Lynch, seconded by Kurbitz that Ordinance No. 525 providing for said annexation be passed as read. Discussion followed and Mr. Lyn Buchanan owner of 5 acres facing on Tieton Drive protested R -1, One Family Dwellings, zoning for his property, explaining that he has been planning with the County, on developing this property under R -3, Mul.tipl.e. Family Dwelling and that he has pulled trees in preparation for building multiple dwelling units. Matters of zoning were discussed wit Mr. Sweitz, who already has a duplex built on his property and Mr. Buchannan, and after due con- sideration, it wasMOVED by Robinson, seconded by Brazier that the ordinance as read be amended i Section 3 by adding sub section c as follows:: "That the following described property is hereby zoned R -2, Two Family Zone: Lot 12, of Sweitz Second Addition, according to the plat thereof re corded in Volume T of Plats, Page 42 records of Yakima County, Washington7.: carried, Bra7Aer, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye by voice vote. Munger absent. VMembers of the Council encouraged Mr. Boggess, Mr. Merchant and Mr. Bubhannan to apply for rezoning when they have more complete plans for the development of their property. Petition No. 267 having been filed with the City Clerk on May 22, 1964 by Ralph Haight requesten the rezone of certain property at 201 through 215 South 11th Avenue, it was MOVED by Robinson, seconded by Lynch that said petition be referred to the Planning Commission for study and recommendation: carried, Brazier, Lambert, Larson, LTnch and Robinson voting aye by voice vote. 4ORDIDXTCE N0.525, AN ORDINANCE providing for the annexation. by the City of Yakima of certain property contiguous to the City of Yakima and zoning said property. ORDINANCE NO. 526, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 900, and providing; for the issuance of Local Improvement District Installment Notes for the payment of th unpaid portion thereof. Moved by Robinson, seconded by Lambert that Resolution N.,. D -691 being a resolution of intention to improve certain property by constructing sewers and fixing the date of hearing on said resolution for June 15, 19 64, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye on roll call. (This improvement requested on Petition No. 212, 245 and�47) �I RESOLUTION NO. D -691, A RESOLUTIONI of intention to create a local improvement district. Dived by Lynch, seconded by Robinson that Resolution No. D -692, being a resolution of intention t improve certain property by constructing concrete curbs, gutters and the surfacing of Summitview Avenue from 40th Avenue to 42nd Avenue and fixing the date of hearing on said resolution for the 15th day of June, 1964, be passed as read: carried, Brazier, Kurbitz, Lambert, Larson, Lunch and Robinson voting aye on roll call. Munger absent. RESOLUTION NO., D_6921 A RESOLUTION of intention to create a local improvement district. The thirty day legal time limit for filing protests in connection with newly formed L.I.Dts, havi expired May 20, 1964 on L.I.D. No. 920, Tie-ton Drive Arterial Street Improvement, the City Engine reported that 18.25% protest has been filed against this project. Public Works Director, Mayo explained that this figure includes the 75% participation of the City. Mrs. Edna Diegel, Mr. Ralph Johnson, Mr. Fred Crosswhite protested this district and Mr. George Sanford read a written protest and filed same with the Clerk of the Council.. No further action was taken by the Council at this time on this project. Cornell, Howland, Haves 8c; Merryfield having submitted Final Estimate No. 5 in the amount of ,13,095.93 as pazrable on the Industrial Waste Irrigation System, it was MOVED by Lynch, seconded by Robinson that said report and estimate dated May 20, 1964 be approved and that payment be made withholding the 10"4) retainage as required by law: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, and Robinson voting aye by voice vote. Munger absent. City Attorney Fred Andrews reported on the various oinnerships and deeds on record in connection w: the ownership of Parker Field and recommended that the City Council take no action in the dispute between the School District and the Parker Youth Foundation. It was then MOVED by Robinson, seconded by Brazier that no action!_obe taken in this matter: carried, Brazier, Kurbitz, Lambert, Larson, Lynch. and Robinson voting aye by voice vote. Munger absent.
