The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lambert,
Larson, Lynch, Munger and Robinson, City Manager Smith and City Attorney Andrews on roll call
Councilman Brazier gave the invocation.
The minutes of the regular meeting of April 27, 1964 wer e approved as read.
In accordance with action taken by the City Council at their regular meeting of April 27, 1964
with regard to Petition No. 256 as filed by Mrs. Louis Ulrich and the passage of Ordinance No. 52
rezoning certain property located between 40th and 41st Avenue on Summitview Avenue, Mayor Larson
called on Councilman Brazier, who had given due notice of his intention to move for reconsidera-
tion at the preceeding meeting. Mr. Brazier indicated that he has talked to many people and
checked the property to be rezoned and resolved any question he had regarding the construction of
the highrise condominium apartment planned for this property and that he does not choose to move
for reconsideration but wishes to let the matter stand as voted at the previous meeting of the
City Council.
Mr. E. F. Velikanje, attorney for the property owners in the matter of the continuation of a
hearing on vacating a public utility easement in Weber Square Addition, being unable to attend
this meeting, it was MOVED by Robinson, seconded by Munger that this matter be continued until
the next regular meeting of the Council on May 11, 1964:- carried, Brazier, Kurbitz, Lambert,
Larson, Lynch, Munger and Robinson voting aye by voice vote.
Item r'5 -a" on the agenda pretaining to the Notice of Intention to Commence Annexation Proceedings
as filed by the Corporation of the Catholic Bishop of Yakima, and the Clerk of the Council advis-
ing that Mr. Hazel is in Court but has advised that he will attend this meeting as soon as possib
it was MOVED by Brazier, seconded by Robinson that this matter be dropped to the bottom of the
agenda: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by
voice vote.
A Notice of Intention to Commence Annexation Proceedings having been filed with the City Clerk on
April 30, 1964 by Max Seals and others and Mayor Larson, having determined from Mr. Howard Hettin
Attorney for said signers, having advised that Max Seals and Doris F. Seals were present but that
Mr. John Schmidt and Mrs. Esther Schmidt were unable to attend this meeting but that they have
given their Power of Attorney to Mr. Seals to act and speak for them. City Attorney Andrews ad-
vised that he has checked the Power of Attorney and that this action is in order. It was then
MOVED by Robinson, seconded by Lynch that this date and now be set as the time for a meeting with
the initiating parties who signed the Notice of Intention to Commence Annexation Proceedings
dated April,30, 1964, those initiating parties being Max Seals, Doris F. Seals and John Schmidt
and Esther �chmidt: carried, Brazier, Lambert, Larson, Lynch, Munger and Robinson voting aye by
voice vote: Mayor Larson then declared the meeting in session and`'Mr. and Mrs. Seals and Mr.
Hettinger, being agreeable to assuming their share of the City's indebtedness, it was MOVED by
Lynch, seconded by Munger that the annexation proposed by Max Seals and others be accepted by the
City of Yakima and that the area to be annexed be required to assume its share of the City's ex-
isting indebtedness: carried, Brazier, Kurbitz, Lambert, Larson, Lynch and Robinson voting aye
by voice vote.
Petition No. 264 having been filed with the City Clerk on May 1, 1964 by Jack S. Cahoon, Secretar
for Lincoln Center Inc. and M.D. Brown and others in connection with their Notice of Intention to
Commence Annexation Proceedings duly filed April 10, 1964, It was MOVED by Munger, seconded by
Lynch that said Petition be referred to the City Manager and the Planning Commission for study
and recommendation: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, Munger and Robinson votin
aye by voice vote.
An ordinance appropriating the sum of $51,655.00 from the Water Sewer Revenue Bond Fund to the
1964 Budget for the purpose of paying the 1964 interest on Water Sewer Revenue Bonds, having been
read in its entirety, was ordered laid on the table for one week to be read and considered at the
next regular meeting of the City Council on May 11, 1964.
Cornell, Holand, Hayes & Merryfield recommending that payment be made to W. H. Gregory Company
in the amount of $16,954.98 as estimate No. 4 on the Industrial Waste Irrigation System, it was
MOVED by Robinson, seconded by Lynch that CH2M's report and recommendation dated April 29, 1964
be approved and that tl;e progress estimate in the amount of $16
954.98 payable to W. H. Gregory
Company be approved and payment of same authorized:. carried, Brazier, Kurbitz, Lambert, Larson,
Lynch, Munger and Robinson voting aye by voice vote.
Gray and Osborn recommending that payment be made to Jess E. Plc Donald, Jr., in the amount of
$2,293.19 on Schedule I of the Storm Sewer & Irrigation Structures 1964 Street Improvement Projec
immediately following the satisfying of conditions as set forth in their letter dated Ap
1964, it was MOVED by Lynch, seconded by Robinson that said recommendations be followed /proovNing
conditions therein set forth have been met: carried, Brazier, Lambert, Larson, Lynch, Munger and
Robinson voting aye by voice vote.
Gray and Osborn also recommending that payment be made to Fred.Traub in the amount of $1,362.52
on Schedule II of the Storm Sewers-& Irrigation Structures, 1964 Street Improvement Project
immediately following the satisfying of conditions as set forth in a letter dated April 29, 1964,
it was MOVED by Brazier, seconded by Lambert that said recommendation be followed and payment
made providing conditions therein set forth have been metr carried, Brazier, Kurbitz, Lambert,
Larson, L nch, Munger and Robinson voting aye by voice vote.

it was MOVED by Lynch, seconded by Robinson that said report dated May 4, 1964 with re-sp-ect to
the progress on various construction projects of the City of Yakima, be approved and that the
progress estimates thereinset forth be approved and payment of same authorized: carried, Brazier
Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote.

investments be accepted and approved: carried, Brazier, Kurbitz, Lambert, Larson, Lynch, MlunIn
and Robinson voting aye by voice vote.
Mr. Harry Hazel, now being present, attorney for and representing the Corporation of the Catholic
Bishop of Yakima in the matter of a Notice of Intention to Commence Annexation Proceedings which
Was filed with the City Clerk on April 28, 1964, it was MOVED by Robinson, seconded by Munger that
this date May 4, 1964, and now be the time set for a meeting with the duly authorized agent of the
initiating parties who signed said Notice of Intention dated April 28, 1964:- carried, Brazier,
Kurbitz, Lambert, Larson, Lynch, Munger and Robinson voting aye by voice vote./Mr. Hazel indicat-
ing_ that said corporation is willing to assume its share of the city,'s indebtedness, it was MOVED
by Munger, seconded by Lynch that the annexation proposed by Corporation of the Catholic Bishop
of Yakima, a Corporation, be accepted by the City of Yakima and that the area to be annexed be
required to assume its share of the City's existing indebtness: carried, Brazier, Kurbitz, Lambei
Larson, Lynch, Munger and Robinson voting aye by voice vote.
Mr. Les Newlun made inquiry as to when the City is planning to build a trunk sewer line outside
the Citv to serve the area south of the Kiwanis Park and North of the Fair,-Grounds and discussion
indicated that this project will take a lift station and that such a project will cost approximat
$60,000.00 and that this area should first be annexed to the City. Mr. Newlun indicated that he
would take an annexation petition out,for signing-. No formal action was taken on this matter.
Manager Smith reported that he has received a signed offer from the Priors to sell two lots locat
North of the First Christian Church on North Third Street ..for $30,000.00. He recommends that th
City acquire said property by paying cash, and use it for parking City cars which are now parked
adjacent to the City Hall on "B" Street thus making available additional parking--arouhd City Hall
for the public. He also made recommendations as to the appropriation of funds to p tT for said
property. Councilman Kurbitz indicated that additional effort should be made tPuir:caha is prope'rt
for less money. After discussion, it was MOVED by Robinson, seconded by Lambert that the staff
proceed with negotiations to purchase on cash basis of $30,000.00: Lambert, Larson, Lvnch, Munge
and Robinson voting aye by voice vote. Brazier voting nay by voice vote. Kurbitz not voting
There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by
Brazier that we do now adjourn at the hour of 4 :20 P.M., carried, Brazier, Kurbitz, Lambert,,
Larson, Lynch, Munger and Robinson voting aye by voice vote.
