HomeMy WebLinkAbout03/23/1964 Business Meeting527 'MARCH 23, 1964 The City Council met in regular session, Mayor Larson, Councilman Brazier, Kurbitz, Lynch, Munger and Robinson , City Manager Smith and City Attorney Andrews present on roll call. Councilman Lemon having requested by letter to the City Clerk to be excused from attendance at this meeting, it was MOVED by Munger, seconded by Lynch that this request be granted: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lemon absent. Councilman Brazier gave the Invocation. The meeting of the regular meeting of March 16, 1964 were approved as corrected. Petition No. 255 having been filed with the City Clerk on March 17, 1964 by John Schaffgier and others requesting the formation of Local Improvement District for the construction of Curbs , Gutters and Surfacing on South 20th Avenue from Nob Hill Boulevard to West Mead Avenue it was MOVED by Munger, seconded by Lynch, that said petition be referred to the City Manager and staff for study and recommendation : carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lemon absent. MOVED by Robinson , seconded by Munger that Ordinance No. 508 an Ordinance relating to the Uniform Building Code, 1961 Edition by the International Conference of Building Officials and amending the Yakima Muricipal Code, be passed as read: Under discussion it was noted that copies of the Uniform Building Code, Volumes I and III were in evidence at the Council table and available for reference. Mayor Larson stated that the Building Code was explained extensively to Councilmen by Building Inspector McCoy at their study session just prior to this meeting, and that members questions had been answered, and that the Code was understood by the members. Inspector McCoy gave a brief explanation of the code to those present at Council Meeting, stating that a City Board of Appeals, consisting of 5 men, an architect, engineer, contractor and 2 insurancemen, hear all formal appeals presented, and that the recommendations of the International Research Council are used in helping to make decisions on a local level. He further stated that the Uniform Building Code is amended every three years by the Interna_tionhl Conference of Building Officials. Councilman Kurbitz suggested that a new committee to more fully represent the building trades people be formed so that they can review current information on building code and help make reccomendations regarding changes and modifications of the Code. It was then MOVED by Kurbitz, seconded by Robinson that a Committee of five be appointed by the Mayor to work with the Building Inspector in reviewing new building material's and help make recommendations on changes or modifications of the building code: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lemon absent. Mayor Larson then asked for a roll call vote.on the original motion: carried, Brazier, Kurbitz Larson, Lynch, Munger and Robinson voting aye onroll call. Lemon absent. ORDINANCE NO. 508, AN ORDINANCE relating to building regulations; adopting by reference the Uniform Building Code, 1961 Edition, copyright 1961 by the International Conference of Building Officials, regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings or structures in the City of Yakima; providing for the issuance of permits and collection of fees therefor; providing penalties for the violation thereof, amending Sections 11.04.010, .020, and .030 and repealing Sections 11.04.040,.050, .060, .070, .080, .090 and .100 of the City of Yakima Munici0al Code; and declaring an emergecny. MOVED by Munger, seconded by Robinson that Ordinance No. 509 an Ordinance relating to stopping, standing and parking motor vehicles, and prohibiting the parking of motor vehicles on certain streets and Avenues, and amending the Yakima Municipal Code be paseed as read: Under discussion the following persons in attendance opposed the 24 hour parking restrictions on Lincoln Avenue: Mr. Garrett Anderson, Don Monroe, Mrs. Montgomery, Irvin Sampson, Harland Harris, Wes Britt, Steve Razen and Jerry Garrison. Mr. H. A. O'Reilly asked the Council what provisions were being made for delivery trucks on Lincoln and Mr. Neil Salset, representing the motor freight companies stated that if they were allowed to park between 9 to 4 p.m , this would satisfy their needs. A-prbtest in writing with 48 names was filed with the City Clerk against parking restrictions on Lincoln. Those opposing this ordinance felt that removal of parking on a 24 hour basis is,not justified at this time as they felt .traffic is not heavy enough, except during the peak hours when people are driving to and from work. Those protesting also mentioned the fact that there is no alley behind their properties which also limits parking space. They also complained of the fact that a parking lane was not provided for at the time of the street im- provement. Councilmen stated there is a,great deal of traffic on Lincoln, and parking restrictions are necessary to assure the even flow of traffic on this arterial. Public Works Director Mayo reminded the people in attendance that when the citizens voted for this improvement under the bond issue , they voted for a four lane arterial. 4s to the parking lane not provided, Mayo stated the expense to the taxpayer would have been extreme in that the city would have had to purchase rights of way from property owners, and further stated that the construction of such a lane would he high in cost. - Councilman Kurbitz stated that the Council should recognize these protests and stated that a parking lane should have been provided for at the time of the improvement on lincoln. At this time Gordon Hansen, Attorney, protested the parking restric- tions on Tieton Drive stating that this would create a hardship to most of the property owners along that route.and requested the Council to delay this restriction. Councilman Brazier suggested in view of the many protests that parking restrictions might be limited to the peak hours on Lincoln west of 24th and on Tieton west of 16th Avenue. He further stated that this should be on a temporary bai..s only pointing ffitL� @ 13 hen construction starts on Lenox and Summitview that the traffic pattern may change/ an his would require total parking removal. Councilmen stated that a compromise might be justified in view of the many protests. Brazier MOVED , seconded by Kurbitz that Lincoln Avenue from 24th Avenue to 40th Avenue, and Tieton Drive from 16th Avenue to42nd Avenue have parking removed between the hours of 7 a.m. to 10 a.m. and from 4 p.m. to 7 p.m. daily except Sundays and Holidays: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lemon absent. City Attorney Andrews advised that a new ordinance would have to be prepared for next Mondays meeting to carry out and to give effect to this motion and he was instructed to prepare such an ordinance. It was then MOVED by Brazier, seconded by Lynch that Ordinance No. 509 be amended prior to its passage and delete therefrom the parking restrictions on both sides of Lincoln Avenue from 24th Avenue to 40th Avenue and to delete therefrom the parking restrictions on Tieton drive from 16th Ave to 4And Avenue: carried , Brazier, Kurbitz, Larson , Lynch, Munger , and Robinson voting aye iayor, by voice vote. Lemon absent. Larson then called for a roll call vote on the original motions-to adopt Ordinance No. 509 as amended. Carried, Braxier, Kurbitz, Larson, Lynch,Munger, and Robinson voting aye by voice vote. Lemon absent. ORDINANCE N0. 509 AN ORDINANCE relating to stopping, standing and parking motor vehicles; pro- hibiting the parking of motor vehicles on certain streets and avenues within the city of Yakima and amending Section 9.36.070 of the City of Yakima Munk:ipal Code. Lemon absent. RESOLUTION NO. D -672, A RESOLUTION authorizing the temporary closure of certain streets for conducting amusement rides and concession stands. MOVED by Robinson, seconded by Munger that Resolution No. D 673 a resolution of appreciation and commendation for the services performed by George M. Lemon during his tenure as a member of the Yakima City Council be passed as read: carried, Brazier, kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll call. Demon absent. RESOLUTION NO. D -673, A RESOLUTION of appreciation and commendation for the services performed George M. Lemon during his tenure as a member of the Yakima City Council.'b The City Engineer having reported the completion of work for the Edgecliff Manor Sewer District L I D No. 904, and the total cost to be $15,524.46, it was MOVED by Robinson, seconded by Lynch that the City Clerk give notice of public hearing on the assessment roll on April 20, 1964 by publication and to each property owner in the district as required by statute: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll call. Lemon absent. The City Engineer having reported the completion of work for the Horizon Heights Sewer District L I D No. 908, and the total cost to be $6,103.22, it was MOVED by Robinson, seconded by Munger that the City Clerk give notice of Public Hearing on the assessment roll on April 20, 1964 by publication and to each property owner in the district as required by statute: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll call. Lemon absent. City Manager Smith informed the Council that the Annexation Review Board is meeting Tuesday, 3 in regard to the Annexation by election matter.
