HomeMy WebLinkAbout03/16/1964 Business Meeting525 MARCH 16, 1964 re The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman Munger gave the invocation. The minutes of the regular meeting of March 9, 1964 were approved as read. There were some 150 persons in attendance at this meeting and since the Council Chambers will not accommodate this number, Councilman Brazier requested Manager Smith to investigate the possibility of useing the Library Auditorium.facility. While Manager Smith was doing this, Mayor Larson explained that the City Clerk has received two 0 absentee ballots which should be canvased at this time. City Clerk,Jim Smith reported that one of the ballots received is invalid since it was post marked March 13, 1964 instead of March 10 and the Council verified this information by physical check. e Clerk then proceeded, with the #�,�sentee help of Councilmen Lemon and Munger to canvas the one remainii ballot which recorded a additional vote for Mr. Rex Matthews, one for Mr. Robert Strausz and one'for Mr. Walter Robinson, Jr., Councilman Kurbitz comented favorably on the attendance of the public at this meeting, pointing out that this is an indication that the public is in favor of and will attend eveing Council meetings and further indicated that all regular meeting of the City Council should be held in the evening and it was MOVED by Kurbitz, seconded by Brazier that all Council meetings be held in , the eveing.. In discussion Councilman Robinson indicated that he is opposed to all evening meet and expressed doubt as to the desirability or need for all eveing meetings since matters of publi interest are now scheduled for the one regular evening meeting held by the Council. Councilman Lynch indicated that it would be more difficult for him to attend evening meetings and further stated that he would hesitate to ask the staff to attend eveing meeting after working all day without increase in pay. Mayor Larson concurred with Mr. Lynch and pointed out that matters of hearing and concern to the public are now being placed on the agenda for the one eveing meeting a month as now scheduled. Council members agreeing informally to a roll call vote on this motion, the Clerk of the Council called the roll and Councilmen Brazier, and Kurbitz voted aye. Councilmen Larson, Lemon, Lynch, Munger and Robinson voted nay on roll call. The motion-lost for the want of a majority vote. Manager Smith reporting that the Library Auditorium was available, it was MOVED by Brazier, seconded by Lynch that this Council meeting be recessed for 5 minutes and reassembled at the Yakima Valley Regional Library at 102 North 3rd Street: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. This recessed meeting reconvened at the hour of 8:25 P.M. with all members of the Council, City Manager Smith and City Attorney Andrews present. Also approximately 150 interested citizens were seated. This being the time fixed by the Council for the meeting with J. Grant Mc Daniel, William H. Murray and William Smith with regard to their Notice of Intention to Commence Annexation Pro- ceedings, and Mayor Larson having established that said signers of said notice were present, and each of said signers indicating that he is agreeable to assuming his share of the City's exising indebtedness, it was MOVED by Robinson, seconded by Munger that the annexation proposed by Mr. J. Grant Mc Daniel and others, be accepted by the City of Yakima and that the area to be annexed be required to assume its share of the City's existing indebtedness: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Mayor Larson then instruct- ed these person to proceed with the obtaining of signatures on their annexation petition and file it with the City Clerk when ready. This being the time for the continuation of the hearing on Petition No. 227 as filed by Lloyd Har:imerstad and others requesting the vacation of Prasch Avenue, and Mr; John J. Anderson, propert owner and one of the signers of said petition being present, requested, that said petition be withdrawn stating that the persons having signed this petition.are not really interested in vacating the street but they do feel that with the development which is currently going on in th shopping center that Prasch Avenue will become highly p;ongested with traffic including trucks and will endanger the safety of the neighborhood, will adversely affect property valuds and con- stitute a nuisance, and that alternate routes are available for adequately handling the shopping center traffic and that the use of Prasch Avenue is unnecessary and therefore a new petition has been filed by persons in this area, with the City Attorney and the Planning Director to close to through vehicular traffic that portion of Prasch Avenue extending one -half block eastward from South 28th Avenue to the shopping center developments as a matter of record. `It. _' was then MOVED by Lynch, seconded by Lemon that the new petition as filed with City Attorney Andrews and Planning Director Rudy Gast, be received by the City Council: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Petition No. 253 having been filed with the City Clerk on March 13, 1964 by Jake P. Leingang, requesting the rezoning of property on Kenny Drive between South Summitview and East 39th Avenue, it- was MOVED by Lynch, seconded by Robinson that said petition be referred to the Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting ave by voice vote.' Moved by Munger, seconded by Robinson that Ordinance No. 507, relating to the increasing of speed limits on certain streets and amending the Yakima Municipal Traffic Code, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. ORDINANCE NO. 507, AN ORDINANCE relating to traffic regulations; specifying speed regulations on Yakima certain streets within the City of Y�ki.ma; amending Section 9.28.060 (b) of the City of Municipal Code. Moved by Lynch, seconded by Robinson that Resolution No. D -668 providing for proceedings to anney certain property contiguous to the City and calling for an election, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Before a roll call vote was taken on this motion, all persons present wishing to be heard on this matter were heard both for and against. City Attorney Andrews explained the procedure to be followed,., City, Countyi,. after the passage of this resolution indicating that a Board of Review composed of School and State Officials will study this matt er and make recommendation and the Board of Count Commissioners will fix the date of election and give notice by publication of said election in order that the electors in the area can vote for or against the matter. He also ex- plained that persons living outside the area described are not eligible to vote even though they may be property owners in the area. Public Works Director Mayo explained matters of Sewer Servic Sewer Hook -up to homes, Garbage services, street lights, curbs and streets, taxes, Fire InsurancE Police protection, Domestic Water, Schoo District Boundaries and made available to all interestec persons a brochure explaining these matters. Mr. Joe Hadley, Mr. Joe Richards,,Mr. Gordon Ward, Mrs. Wilson, Mrs. Headley, Mr. Bixby, Mrs. Regimbald, Mrs. Freemouth, Mr! Moreford, Mrs. Fred Whitmire, Mrs. lj'horton, Mr. Phillip Raymond, Mrs. Benton, Mrs. & Mr. Giffort, Mr. Bill Ellis, Mrs. Ibeck Mrs. Margaret Lindbeck, Mr. Glen Chandler, Br. Botsford, Mr. Don Simpson, Mr. Cecil Johnson were heard on matter of taxation improvements, bicycle and dog licenses and indicated their protest to the action of being annexed to the city. Mrs. Eugene Smith, Mrs. George Long Mr. Jackson, Mr. Bill Davis and a group of six or eight persons who did not identify themselves but who lived on 8th, 9th and 10th Avenues all spoke in favor of the annexation. Mayor Larson and other Councilmembers emphasized that this action by the City will merely give the people in the area described a chance to vote on whether or not they desire to be annexed and that the majority will rule in the matter and that there'.has been enough requests made and interest expreE to warrant this action. RESOLUTION NO. A RESCLUTIC14 provid ng for the commencement of proceedings to annex to the City of Yakima certain unincorporated territory contiguous to the City, and calling_; for an election on the question of such annexation. Moved by Brazier, seconded by Lynch that Resolution No. D -669 authorizing the acceptance of an easement from Northern Pacific Railway Company for the construction of the Lenox Avenue Overpass be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. RESOLUTION NO. D -669, A RESOLUTION authorizing and directing the City Manager and City Clerk of the Cit ,'T of Yakima to accept an easement from the Northern Pacific Railway Company for the Lenox Avenue Overpass. Moved by Robinson, seconded by Lemon that Resolution No. D -670 authorizing the hiring of work, labor and materials for the repair of a sanitary sewer on Prasch Avenuelbetween 20th and 21st Avenue, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Discussion pointed out that the iniating Resolution'on this project was D -454 passed in 1963 and that the cost of said project�_is $989.59 in excess of the amount authorized by said resolution, thus the necessity of this amendment. RESOLUTION NO. D -670, A RESOLUTION authorizing and ratifying the hiring of work, labor and materials without calling for bids, and amending Resolution No. D -454. Moved by Robinson, seconded by Lemon that Resolution No. D -671 authorizing the purchase of a Ross Pressure Valve without calling for bids, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lvnch, Munger and Robinson voting aye by voice vote. RESOLUTION NO. , D -6715 A RESOLUTION authorizing the purchase of materials without calling for bids. The City Engineer reporti'.g the following_ estimates on work performed on City projects during the month of February, 1964 for payment: Domestic Watermain Wash. Ave.,,& DeBlasio Bros. 94,274.51 So. 24th Ave. Airport Add. & Clift Plat De Blasio Bros. L.I..D. 11226.52 Sanitary Sewer Sch.:II No. 911 it was MOVED by Lynch, seconded by Robinson that the Engineers report dated March 16, 1964 be approved and that the'progress reports therein set forth be approved and pqyment of same authorized: carried, Brazier, Kurbitz, Larson, Lemon, Lvnch, Munger and Robinson voting aye by voice vote. in Superior Court Manager Smith and City Attorney Andrews reported on the matter of Judge Barnett's ruling /on the matter of enforcement of the Building Code in the Payless- Drug case. City Attorney recommended that,since the facts of the case are against the city,and that since the case is not of much importance statewide, it not be taken to the state Supreme Court. They further indicated that a7 ordinance to comply with the courts ruling will be forth coming at the next regular meeting of the C-i_tj. T Council and that the Building Code, Volume's I and III y 1961 Editions, are now on file in the City Clerk's Office. Manager Smith -asked the Council to consider the.matter of selection of delegates to represent them at the Association of Washington Cities convention in order'thgt this information and reservations may be made soon.
