HomeMy WebLinkAbout03/09/1964 Business Meetingr 522 MARCH 9, 1964 The City Council met in regular session, Mayor Larson, Councilman Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson, City Manager Smith and City Attorney Andrews present on roll call. The Invocation was given by Councilman Brazier. The Minutes of the regular meeting of March 2, 1964 and the minutes of the special meeting of the Council on March 4 , 1964 were approved as read. This being the time fixed for the hearing on Resolution No. D -654 A Resolution of Intention to create an L. I. Ds ,for the_ cbnstiuction.:,:of curbs;' - gutters ';"and.''the'surfac`in`g'o'f Lenox Avenue' from ,South- ;Th-ird Avenue7.t9 South 16th Avenue, it was MOVED by Munger, seconded by Lynch that Ordinance No. 503 providing for these improvements and creating Local Improvement District No. 916 be passed as read: Under discussion Mayor Larson opened the meeting for hearing and asked Public Works Director Mayo to give a brief explanation of this improvement project to those present. Pub: Director Mayo stated that because of heavy traffic on this street and the possibility of the deve: ment of this area in the future for commercial use that the improvement is necessary for the saEei and betterment of the Community. He stated that the City will assume the major portion of the expense through the half cent gas tax revenue, and that the property owners will assume 30 percent of the expense. The city is participating'in order to create the L I D and make the improvement. Mayo pointed out that heretofor property owners have never been assessed by the City of Yakima for improvements on Lenox Avenue. Mayor Larson then asked to hear from those present in the audience. Mrs. Pratt, Mrs. Krause, R. E. Strom, A. E. Stewart, Luther Jones, C. K. Worrell, and Mr. Dye protested this assessment. Mr.'John Moore, Attorney, protested for property owners as shown on 5 petitions which he filed with the Clerk at this meeting. The general feeling of those protesting was that they were not against the improvement but felt it unfair to be assessed for an improvement which would benefit the whole community. Mr. Phoepe Garbe stated she favored this L. I. D. In answer to an inquiry by Mrs. Krause as to how the students of the college would.be protected on crossing Lenox, Councilman Robinson assured Mrs. Krause that every effort would be made to protect the students and others, possibly by installing a light with button contfol for pedestrian crossing. All persons having been heard, Mayor Larson stated that 30 days still remaix in which to file protests. He then called for a roll call vote on the original motion which passe carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Councilmen Kurbitz, Lynch, and Robinson emphasized the importance of-this 'improvement to meet the growin needs of our city. It was noted that approximately 75 persons were in attendance at this' meeting. ORDINANCE NO. 503, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special.fund. This being the time fixed for the hearing on Resolution No. D -655, A Resolution of Intention'to create an L I D for the Construction of Curbs, gutters, and surfacing on 16th Avenue.from L* �snox Avenue to Mead, it was MOVED by Munger, seconded by Robinson that Ordinance No. 504 providing for these improvemnts and creating,-:.a Local Improvement District No. 917 be passed as read: Under, discussion Mayor Larson opened the meeting for hearing on this matter. Mr. Armand DeB3asio, 1310 S. 16th Avenue, filed protests with the Clerk of the Council stating that this represented approximately 75 percent of the property owners. Mr. DeBlasio criticized the manner in which the L I D was being organized, and also stated that this improvement would create parking problems, as well as be damaging to the area in general. Others protesting this L I D were John Eairwood, Chet Davis and Dr. James'K. Yu. Dr. Yu was represented by Attorney John Moore at this meeting. All persons having been heard, Mayor Larson stated that 30 dpys remain in which to file-protests. He then called for a roll call vote on the motion: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. This being the time fixed by the City Council for the hearing on Resolution No. D -660 a Resoluti of Intention to create an L.I.D. for the construction of curbs, gutters and surfacing on Nob Hill Blvd. and South 24th Avenue and there being.no protests in writing or otherwise, it was MOVED by Lemon, seconded by Munger that Ordinance No. 505 providing for these improvements and creating a Local Improvement District No. 918 be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch,-Munger and Robinson voting aye on roll call. ORDINANCE NO. 505, an Ordinance providing for the improvement of certain.property by constructing the necessary mains, valves and other appurtenances for the purpose of supplying water for domes- tic use and fire protection; establishing a Local Improvement District, providing for the method of payment thereof and creating a special fund. This being the time fixed by the City Council for the hearing on Resolution No. D =661, a Resolu- tion of Intention to create an L. I. D. for the construction of Sewers on Nob Hill Boulevard and South 24th Avenue, and there being no protests in writing or otherwise , it was MOVED by Lynch, seconded by Lemon that Ordinance No. 506 providing for these improvements and creating a local Improvement District No. 919 be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. ORDINANCE NO. 506, An Ordinance providing for the improvement of certain property by constructing a-pipe sewer with the necessary wye branches and manholes; establishing a Local Improvment District providing for the method of payment thereof, and creating a special fund. A Notice of Intention to Commence Annexation Proceedings having been filed with the City Clerk by J. Grant McDaniel and others on March 6, 1964 declaring the intention of the signer to commence annexation proceedings for certain property between West Viola & West kMead and 22nd Avenue and 24th Avenue, it was MOVED by Lynch, seconded by Lemon that March 16, 1964 at the hour of 8 p.m. be set as the time for-the meeting with the initiating parties, namely, J. Grant Mc- Daniel, William McMurray and William Smith. : carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. 1 tic Works .op- I- I' 1 I 1 523 March 9, 1964 A Notice of Intention to Commence Annexation proceedings having been.filed with the City Clerk by Willie Owens and others on March 5, 1964 declaring the intention of the signer.to commence annexation proceedings for certain property between Adams & Pacific, and Fair Ave. and 13th --St. and said initiating parties being present, namely Willie Owen and Marvin Jennings, it was MOVED by Robinson, seconded by-Munger that the City Council now meet with the said initiating parties, carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. The initiating parties(:Mf. Owen and Mr. Jennings having stated that they are willing to assume its share of the city's indebtedness, it was MOVED by Robinson, seconded by Brazier, that the, annexation proposed by Willie Owen and others be accepted-by the City of Yakima and that the area to be annexed be required to assume its share of the City's existing ihftbtedness :carried, Brazier, Kurbitz,,Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. i Moved by Munger, seconded by Robinson that Resolution No. D -665 a Resolution authorizing the acquisition of real property for right of way for Lenox Avenue be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. RESOLUTION NO. D -665 , A RESOLUTION authorizing the acquisition of real property for right of way for Lenox Avenue. Moved by Lemon, seconded by Lynch that Resolution No. D -666 a resolution authorizing the exe- cution of right of way easement to Pacific Power and Light Co. in the Tahoma Cemetery be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. RESOLUTION NO. D -666, A Resolution authorizing the City Manager and City Clerk of the City of Yakima to execute a right of way easement to the Pacific Power & Light Co. Moved by Robinson, sseconded by Lemon that Resolution No. D -667 authorizing execution of pipe- line crossing agreement with Yakima Valley Trasnportation Co. be passed as read: carried, Brazier, Kurbitz, Larson, Lemon , Lynch, Munger and Robinson voting aye on roll call: RESOLUTION NO..D -667, A Resolution authorizing the Mayor and City Clerk of the City bf Yakima to execute a pipeline crossing agreement with the Yakima Valley Transportation Co. The City Engineer having submitted the following estimate on work performed during the month of February 1964 as follows: Proj ect : Broadway - Lenox Storm Drain Cgntract Awarded & Contractor Feb. 10, 1864 Gaasland Co. The City Engineer having submitted estimate and summary of bids received on the Nob Hill Shopping Center and Various others - Sanitary Sewer and Domestic Watermain, and Gregory Bros. Cement Co. being the low bidder with a total bid of $32,340.88 and the City Engineer recommending that said bidder be awarded the contract for this work,.it was;MOVED by Robinson, seconded by Munger that the City Manager be authorized to enter into a contract with said Gregory Brothers Cement Co. upon the filing of the proper bond and insurance: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by roll call. Richter ,City Treasurer It was MOVED by Brazier, seconded by Lemon, that the City Treasurer report dated Feb. 29, 1964 regarding the investments of the city of Yakima be accepted and approved: carried, Brazier, Kurbit Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. - UNder new business Councilman Lynch brought up the matter of a statement made by Councilman Kurbit in a television interview. Lynch stated that he resented the remark made by Kurbitz which seemed to-infer that other councilmen were missing meetings comparable to his absence. Councilman Kurbit informed the Council that he had checked his attendance record with the payroll department and it showed he was absent 21 percent of the time. Part of this absence was due to the 8 week People To People Tour which he made in 1963. The Council excused him from attendance at meeting during this time. The other reason for absence was necessitated by his being required to take care of his business in Pasco, Washington for a while. During this time he did come in for the evening Council meetings. Kurbitz stated that another Councilman had been absent 16 percent of the time which he considered comparable to his absenteeism. Councilman Lynch stated he was not questionine the absence from meetings but only the remark inferring that other Councilmen were absent as much as he. Councilman Lynch further stated that he should name the Councilman he is referring ti Councilman Munger stated that Councilman must be absent from meetings occasionally because of business commitments. He further stated that if you are running a good business and making your living from that business than your first obligation is to that business. However, he said that the clerk should be informed when a councilman cannot attend meetings. Councilman Kurbitz stated that when Mayor Larson informed him that he should give notice to the clerk when planning to be absent from Council Meeting, he had complied with this request. There being no further business to come before the Council, it was MOVED by Robinson,'seconded by Lynch that we do now adjourn at the hour of 5 :40 p.m.; carried, Brazier, Kurbitz, Larson,, Lemon, Lynch, Munger-and Robinson voting aye by voice vote.
