HomeMy WebLinkAbout03/02/1964 Business Meeting1 11,`� 1 i i 519 MARCH 2, 1964 The City Council met in-regular session, Mayor Larson, Councilmen-Brazier, Kurbitz, Lynch, Munger and Robinson , City Manager Smith and City Attorney Andrews present.on roll call. Council man Lemon having requested by letter to the City Clerk to be excuded from attendance at this meeting, it was MOVED by Robinson, seconded by Munger that his request be granted: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. The Invocation was given by Councilman Kurbitz. The Minutes of the regular meeting of February 24,.1964 were approved as read. In accordance with action taken by the City Council at their regular meeting of the Council on February 24, 1964, on the matter to continue the hearing on protests for -'the formation of Local Improvement District Sumac Sewer area and the repealing of Ordinance No. 494, Mayor Larson gave the current status on the protests. He stated that .protests with city participation was 53 percent, and protests without city participation, 37.7 percent. An Ordinance repealing Ordinance No. 494 of the City of Yakima passed on January 20, 1964 providing for the improvement of certain property for the construction of sewers and creating L. I. D. 915 having been read, it was MOVED by Kurbitz.seconded by Robinson that said Ordinance be gassed as read: During discussion on this motion, Council was advised that the passage of the proposed ordinance was not mandatory for the reasons that the protests -were insufficient to invalidate the L. I.D. under the 60 percent rule, and a paragraph of the recital in the introduction to the ordinance, which paragraph recited that the protest amounted to more than 60 percent of the cost of the improvement, was deleted by an amendment approved by unanimous voice vote. Mayor Larson called for a vote on the original motion to pass the ordinance. Motion lost for want of majority, Brazier, Kurbitz, Larson, Lynch, Munger, and Robinson voting Nay on roll call. Lemon absent. This being the time fixed by the Council for the hearing on Petition No. 241 as filed by Ray Kooser and others praying for the annexation of property located between Summitview and Chestnut and 44th and 46th Avenue, it was MOVED by Munger seconded by Robinson that Ordinance No. 501 an Ordinance providing for said annexation and zoning the same as R -1, Single Family Residence Zone, be passed as read: In discussion, Manager Smith reported to the Council that he had received a telephone call from Mr. Roy Rosenkranz, 106 N. 4th Avenue, who owns one acre of land in the are opposing this annexation. Mr. Rosenkranz also expressed his opposition of this annexation at the.Planning Commission meeting. There being no other protests either in writing or other- wise, Mayor Larson asked for a roll call vote on the motion. Carried: Brazier, Kurbtiz, Larson, Lynch, Munger and Robinson voting aye on roll call. Lemon absent. ORDINANCE NO. 501, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning the same as R -1;' Single Family Residence Zone. This being the time fixed by the City Council for the hearing on the matter of rezone of.proper!Vy at 1112 South 16th Avenue as per Petition No. 238 as filed by Will Hackett and Marguerite Hackett, it was MOVED by Brazier, seconded by Lynch that Ordinance accepting the recommendation of the Planning Commission be read: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lemon absent. MOVED by Lynch, seconded by Brazier that Ordinance No. 502 AN ORDINANCE accepting the recommendation of the Planning Commission to rezone said property from R -2, Two Family Residence Zone, to B -2 Local Business Zone be passed as read: In discussion it was noted that there was a discrepancy in the legal description of the property as shown on the Ordinance. It was therefore MOVED by Brazier, seconded by Robinson that Planning Consultant Gast obtain the correct description before any further action was taken by the Council: carried, Brazier, Kurbitz, Larson,, Lynch, Munger and- Robinson voting aye by voice vote. Lemon absent. Councilman Brazier suggested that the legal description shown on Petition No. 238 be used as the description in the Ordinance as the correct description inasmuch as Attorney Halvorsen, repre- senting the Hacketts would have verified it.to be so before drawing the petition. Councilman Lynch stated that he was not certain that the description of petition was right either and sugges- ted that the matter be tabled until the.staff can obtain correct description Brazier stated_ he was confident that the description on Petition was correct. Brazier, Moved, seconded by Robinson that Ordinance No. 502 be ammended to carry, the description as shown on Petition No. :- 238: carried, Brazier, Kurbitz, Larson, Munger and Robinson, voting aye by voice vote. Lynch voting Nay. Lemon absent. Mayor Larson called for a roll call vote on the original motion as read and amended: carried, Brazier, Kurbitz, Larson, Munger and Robinson voting aye on roll call. Lynch voting Nay, stating that he favored the Ordinance but voted no because he was still.-not sure that the legal description on Petition was correct. Lemon absent. Marguerite Hackett, petitioner, was present at Council Meeting. ORDINANCE NO. 502, AN,ORDINANCE accepting the recommendation of the Planning Commission and re- zoning certain property Jocated at 1172 ?.South 16th Avenue in the City of Yakima, Washington from R -2, Two Family Residence Zone, to'B -2 Local Business Zone. Petition No. 250 having been filed with the City Clerk's Office on February 27, 1964 by Anna Mary Lamb and. others requesting the formation of Local Improvement District for Curb, Gutter, and Surfacing,.on East Street, from North 7.th 'to Nor.th 4th Street, it was MOVED by Robinson seconded by Brazier,.that said petition be referred to the City Manager and staff for study and recommendation: carried,. Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lemon absent. Petition�No. 251 having been filed with the City Clerk's Office on the 28th ofFebruary, 1964 by Euclid Gamache requesting the formation of Local Improvement District for construction of Sewer to serve Country Store area , it was MOVED by.Robnson, seconded by Munger, that said petition be referred to the'City'Manager and staff for study and recommedation: carried, Brazier, Kurbitz, Larson, Lynch, Munger.and Robinson voting aye by voice vote. Lemon absent. Petition No. 252 having been filed with the City Clerk's Office on the 27th Day of February, 1964 by W. E. Guthrie and others praying for the annexation of'certain property between 16th and 18th Avenue, South of King,Street, it was MOVED by MuhgerY, seconded by :Lynch:; that said petition be referred to the City Manager and Planning Director for study and recommendation: carried, Brazier, Kurbitz,.Larson, Lynch, Munger and Robinson voting aye by voice vote. F, march 2, 1964 Moved by Munger , seconded by Robinson that Resolution No. D -664 A RESOLUTION authorizing a temporary loan of $10,076.00 from the 1964 Street Improvement Construction Fund to the 1962 Street Improvement Bond Redemption Fund be passed as read: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson <�voting aye on roll call. Lemon absent. RESOLUTION NO. D -664 A RESOLUTION authorizing a temporary loan of $10,076.00 from the 1962 Street Improvement Construction Fund to the 1962 Street Improvement Bond Redemption Fund. The City Engineer having reported the completion of work for the flagg addition Sewer District, L. I. D. 902, and the total cost to be $3,538.25, it was MOVED by Lynch, seconded by Brazier that the City Clerk give notice of public hearing on the assessment roll for March 30, 1964 by publication and to each property owner in the district as required by statute: carried, Brazier, Kurbitz, Larson, Lynch, Munger, and Robinson voting aye by voice vote. Lemon absent. Cornell , Howland, Hayes and Merryfield, Consulting Engineers, having submitted their monthly pay estimate report for work accomplished and materials delivered for the construction of the Industrial Waste Irrigation System, between January 24, 1964 through February 21, 1964, in the amount of $27,790.23, and recommending that payment be made to W. H. Gregory Co., it was MOVED by Robinson, seconded by Munger that 4aid report dated February 26, 1964 be approved and that the estimates therein set forth be approved and that payment of said estimates be authorized: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Gray & Osborne Consulting Engineers having submitted progress estimate, 1964 Street Improvement Project, Schedule I, Storm Sewers & Irrigation Structures, in the amount of $11.,026.35, coverin the amount due the contractor for labor and materials, it was MOVED by Brazier, seconded by Lynch, that said report dated February 27, 1964 be approved and that estimates therein set forth be approved and that payment of said estimate be authrized: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Gray & Osborne, Consulting Engineers having submitted Progress Estimate 1964 Street Improvement Project, Schedule II, Storm Sewer & Irrigation Structures, in the amount of $3,120.07 covering the amount due the contractor for labor and materials furnished, it was MOVED by Lynch, seconde by Robinson that said report date February 27, 1964 be approved and that the estimates therein set forth be approved and that payment of said estimates be authorized: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. City Manager Smith having informed the Council that the Post Office Department was experiencing difficulty in the delivery of mail to- Sunset Avenue and Sunset Drive because'of the similarity in the names of the streets, and the Post Office requesting the Council for assistance in this matter, it was MOVED by Robinson, seconded by Munger that the City Staff be authorized to change signs on Sunset West of 40th Avenue to read West Sunset - Avenue: carried, Brazier, Kurbit Larson, Lynch, Munger and Robinson voting aye by voice vote. Lemon absent. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Brazier that we do now adjourn at the hour of 4 p.m. carried: Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote.
