HomeMy WebLinkAbout02/17/1964 Business MeetingF_ FEBRUARY 17, 1964 Before the Council proceeded with the regular business meeting, the matter of counting the absentee ballots of the City Primary Election held on February 11, 1964 began at 7 :50 P.M. Councilman Munger and Lemon were appointed by the City Clerk to record the votes. The 7 members of the Council acting as the canvassing Board and began to in- spect the absentee ballots. Mayor Larson called the regular session of the Council Meeting to order at 8 p.m., Larson, Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson, Manager Smith and City Attorney Andrews present on roll call. r Councilman Lemon gave the invocation. The Minutes of the regular meeting of February 10, 1964 were approved as read-.. ".. It was noted that Gerret Anderson and Mr. Ray Munson, Attorney representing Mr. Rex Matthew, were present in the Council Chambers._ Also present were candidates Mrs. Dow Lambert and Mr. Robert Strausz. City Attorney Andrews ex- plained the procedure of counting the absentee ballots to those candidates in attendance, and requested that if there were any questions regarding this matter, or any other objections to the manner-in which the proceedings were being conducted, that they be expressed here and now at this meeting. The Canvassing Board having completed their inspection as to the number of ballots, time received, and proper signatures, they confirmed City Clerk's Smith's count of 74 absentee ballots received-in the clerk's office, two of which were invalid. -Mr. Munson and Mr. Anderson requested permission of the Canvassing Board to examine the unopened envelopes carrying the ballots. Permission having been granted to do so, Mr. Munson and Mr. Anderson inspected the envelopes and Mr. Munson found that one of the envelopes was postmarked February 12, 1964, one day after the due date, which invalidated it. This brought the total of valid absentee ballots to 71. There being no:" further inquiries on this matter, the clerk proceeded to open the ballots and the count was made:. The total count was.recorded as follows: Anderson; 23;-Gilbert, 5; Lambert, 14; Matthews, 22; Perry, 6; Connors, 13; Howard, 3; Kurbitz, 32; Strausz, 21; Cameron, 17; and Robinson, 5C Moved by Robinson, seconded by Munger that Item 8 a on the agenda relating to resolution designating representatives of the City Council as Election Canvassing Board be considered at this time; carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. It was then MOVED by Munger, seconded by Lemon, that Resolution No. D -657, a r so r ution esignating representatives of the City of Yakima, as the election canvassing orc board to conduct proceed g loef o votes cast at the Yakima City Primary election of February 11, 1964, be passed as read; carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger, Robinson voting aye on roll call. RESOLUTION NO. D-657, A- RESOLUTION designating representatives of the City Council of the City of Yakima as the election canvassing board of the City of Yakima, to conduct recount proceedings of votes cast at the Yakima City Primary Election of February ll, 1964. It was MOVED by Robinson, seconded by Lynch, that Resolution authorizing the City of Yakima to hire professional service for appraising Lenox Avenue be amended to read "at such rates proposed by the letters dated February 11 and 13th, 1964 ": carried, Brazier, Kurbitz, Larson Lemon, Lynch, Munger and Robinson voting aye by voice vote. It was then MOVED by Munger, seconded by Robinson that Resolution No. D -658 A.Resolution authorizing and directing the City Manager of the&q1ihy nuoSd Yakima to hire professional services for 1ppraising Right -of - Way of Lenox Avenue be passed as read;'pcarried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting_aye on roll call. RESOLUTION NO. D -658, A Resolution authorizing and directing the City Manager of the City of Yakima to hire pro- fessional services for appraising Lenox Avenue Right -Of -Way. In accordance with action taken by the City Council at their regular meeting of January 13, 1963 on Petition No. 227 as filed by.Lloyd Hammerstad and others for the vacation of Prasch Avenue, it was MOVED by Robinson, seconded by Munger that the Ordinance prepared on this matter not be read until interested parties in attendance as this meeting had expressed their views: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Planning Director Gast stated the Planning Commission recommended the denial of the petition to vacate Prasch Avenue because the access is needed to 28th Avenue and Nob Hill Blvd. Mr. Grandstand, Mr. Woodburn, Mrs. Altmeyer, Mr. Anderson,Mrs. Coglon and Mr. McNeice strongly protested the decision of the Planning Commission, stating that it would encourage truck traffic on Prasch Avenue. They asked the Council to vacate this street. Councilmen pointed out some of the problems resulting from vacation of streets. Councilman Brazier stated that many times when a street reverts back to private ownership, the owners block off the streets in various ways and the area becomes land locked. Councilman Kurbitz suggested that more time be given those protesting to study this matter further. It was MOVED by Kurbitz, seconded by Brazier, that this matter be postponed until the Council's evening meeting on March 16, 1964 so the interested parties could st-lr this further: carried, Brazier, Kurbitz, Lars Lemon, Lynch, Munger and Robinson voting aye by voice vote. In accordance with action taken by the City Council at their regular meeting of January 13, 1_964 regarding setting fees for rezone applications, it was MOVED by Lynch, seconded by Munger that Ordinance setting filing fees for re- zone application and amending Section. 12.80.020 of the Municipal Code as follows: Reclassification fees from $10.00 to $50.00; Variance fees from $10.00 to $25.00; Conditional Use Permits from $10.00 to $25.00; and Special Property Use Permits from $10.00 to $25.00, be passed as read: In discussion Fred Velikanje, Attorney, opposed the increase in fees, stating the new rates were prohibitive and would deter the development of business in the City. Planning Director Gast stated that the present fees do not begin to cover the cost of processing and publishing the necessary legal notices. Approximately 15 hours of staff time is required for the complete processing of a rezone application and this does not include the staff time spent in cases where applications are appealed to the City Council. The costs here are far below those of other cities in the State and in the West. Councilman Lemon opposed the change in rates stating that the increase was too drastic. Councilman Lynch favored the new rates stating individuals desiring rezones should pay their own way as they benefit directly from the rezone. This would also help in re- ducing expenses in City Gaernment and to the taxpayer. Mr. Grandstand also felt the increase would be a deterant to business. Councilman Robinson opposed the increase in rates stating it was not fair to the property owners. Councilman Kurbitz opposed the new rates stating that the Planning Staff is available to do the work and that the increase would prevent growth and expansion of our city. Mr. Gene Gandy concurred with Councilman Lynch stating that the individual property owners should absorb the full cost of processing of the rezone application. All persons having been heard on this matter, Mayor Larson called for a roll call vote on the motion: . Lynch, Munger and Larson voting aye on roll call; Brazier, Kurbitz, Lemon and Robinson voting Nay. Motion was lost for want of majority vote. It was the MOVED by Robinson, seconded by Brazier, that reclassification fee be increased from $10.00 to $20.00, and that Variance, Conditional Uses Permits, and Special Property Use permits remain at $10.00; Brazier, Lemon, Robinson voting aye on roll call, Kurbitz, Larson, Lynch and Munger voting Nay. Motion lost for want of majority vote. _ Petition No. 246 having been filed with the City Clerk on February 14, 1964 by W. R. Johnson and others requesting the formation of an L I D for the construction of water mains, fire hydrants and other appurtenances in Larson Lots # 2, on 46th & 47th Avenues North,of Englewood, it was MOVED by Robinson, seconded by Lemon that petition be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. 1 1 7 1 1 I I FJL BEBRUARY 17, 1964 Petition No. 247 having been filed with the City Clerk on February 14, 1964 by W. R. Johnson and others requesting the formation of an L. I. D. for the construction of Sewer in Larson's Lots # 2, Lots 1 through 9, on 46th and 47th Avenue; North of Englewood, it was MOVED by Lynch, seconded by Robinson that said petition be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Petition No. 248 having been filed with the City Clerk on February,14, 1964 by W. R. Johnson and others requesting the formation of an L. I. D. for the construction-of curb and gutters and surfacing in Larson's Lots # 2, Lots 1 through 9, on 46th and-47th Avenue, North.of Englewood, it was MOVED.by Lynch, seconded by -Lemon that said petition be referred to the City Manager and Staff -for study and recommendation: carried, Brazier, Kurbitz, Larson; Lemon, Lynch, Munger and Robinson voting aye by voice vote. MOVED by Munger, seconded by Robinson that Ordinance No. 499 an ordinance relating to the enforcement of moving traffic regulations of the City of Yakima, authorizing the issuance of citations for violations, and prescribing the form of such citations, declaring a misdeameanor for failure to comply with such citations, and amending the Yakima Municipal Code, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. ORDINANCE N0..499 AN ORDINANCE relating to the enforcement df moving traffic regulation of the city of Yakima. authorizing the issuance of citations for violations thereof, and prescribing the forms of such citations; declaring a misdemeanor for failure to`com`]y with such citations; amending Section 9.16.010, .020 and .030 of the City of Yakima Municipal Code;,repealing Section 9.16.040, .050, 060, .070 and..080 of the City of Yakima Municipal Code; and declaring an emergency. MOVED by Munger, seconded by Lemon, that Ordinance No. 500 An Ordinance relating to stopping, standing and parking motor vehicles; authorizing the issuance of notices for violations, declaring a misdemeanor for failure to comply with such notices, and adding a new section to the Yakima Municipal Code, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch, Lemon, Munger and Robinson voting aye on roll call. RESOLUTION NO. D -659 , A Resolution authorizing and directing the City Manager and City Clerk of the City of Yakima to execute a lease agreement with the Federal Aviation Agency of the United States of America. MOVED by Munger, seconded by Lemon that Resolution No. 660, A Resolution of intention to' create a local improvement district for the construction of water mains, fire hydrants and other appurtenances on South 24th Avenue, and Nob Hill Blvd, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. RESOLUTION N0. 660 A Resolution of Intention to,Create a Local Improvement District. MOVED by Munger, seconded by Robinson, that Resolution No. D 661 , A resolution of intention to create a Local Improvement District for the Construction of;Sewer, on South 24th Avenue and Nob Hill Blvd, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. RESOLUTION NO. D 661, A Resolution of Intention,to create a Local Improvement District. In accordance with Resolution No. D -653, one bid and one bid only was submitted by the Yakima Daily Republic fur the City Printing for the period commencing February 17, 1964 and ending on the Third Monday in February 1963, it was MOVED by Robinson,'seconded by Kurbitz that-said bid be awardedtto the Yakima Daily Republic and'that the City Manager be and is hereby.authorized to enter into an agreement with said Yakima Daily Republic: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Mr. Earl Vadnaise having requested the Council to invite the Veterans of World War I to hold their Annual Convention in Yakima in 1965, it was MOVED by Robinson, seconded by Brazier; that said invitation be extended to the World War I Veterans: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Lynch that we do now adjourn at the hour of 11 p.m. , carried: Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.'
