HomeMy WebLinkAbout02/03/1964 Business Meeting1 1 1 51 FEBRUARY 3, 1964 The City Council met in regular. session, Mayor Larson, Councilman Brazier, Kurbitz, Lemon, Lynch Munger and Robinson, Manager Smith and City Attorney Andrews present on roll call. Councilman Brazier gave the invocation. The minutes of the regular meeting of January 27, 1964 were approved as corrected: In accordance with action taken by the City Council at their regular meeting of January 27, 1964 requesting that an Ordinance regulating ambulance service with the City of Yakima be revised, it was MOVED by Robinson, seconded by Munger that the additional sentence in Section 5.09.030 amending said ordinance be read as follows "Nothing in this Chapter shall be construed so as to require any applicant for a license hereunder to be the owner of any equipment or premises intended to be used in such business or to have hired any personnel, prior to the time such license is granted" : carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz voting Nay. 4 In discussion Councilman Kurbitz stated that he felt the ordinance was too lengthy, had too many restrictions, and that it was an invasion of the rights of the owners. City Manager Smith explained that the public is directly involved in emergency ambulance service and regulations are necessary to protect the public. He further stated that most cities have minimum regulations for private ambulance service. Manager Smith also stated. that this ordinance had the approval of the Yakima Medical Service, Yakima Funeral Directors and the owner of the Ambulance Service and his Attorney. Fire Chief Pete Moorestated this is not excessive regulations, that it is needed for the health and welfare of the community. Mr. Howard, Candidate for Council, favored tl:is Ordinance, and Councilman Robinson stated that after careful study -of this Ordinance, he felt it was necessary in the public interest. It was then MOVED by Lynch, seconded by Brazier that Ordinance No. 496 be passed as read and amended: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Kurbitz voting Nay. ORDINANCE NO. 496, and ordinance regulating ambulance service within the City of Yakima, requiring licenses and permits for ambulance service businesses and ambulance drivers and attendants, specifying requirements for the issuance of such licenses and permits, and pro- viding for the revocation thereof; setting forth rules and regulations for ambulance services, drivers and attendants; declaring violations to be misdeameanors and providing a penalty; and creating a new chapter to the City of Yakima Municipal Uode to be known as Chapter 5.09, Ambulances. This being the time fixed by the Council for the hearing on the matter of the appeal from the Planning Commissionts decision regarding the rezoning of property at 1102 South 28th Avenue and 2804 Nob Hill Blvd. as filed by J. J. Anderson, it was MOVED by Brazier, seconded by Lemon to read the Ordinance.accepting the recommendation of the Planning Commission regarding this matter: carried, Brazier, ,Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. It was than MOVED by Lynch, seconded by Kurbitz that Ordinance No. 497, and Ordinance acce ting the recommendation of the Planning Commission to rezone this property from R -2, Two amily Residence to B -2, Local Business. Zone be passed as read. In discussion, Mr. Howard Elofso n, attorney representing Mr. Anderson reviewed the reasons why the Council should approve the application for rezone. Councilman Robinson was opposed to this rezone, stating that business on both sides of Nob Hill would create hazard for-traffic and pedestrians which could re -sult in serious accident. C. Kurbitz stated he couldnnot see where any appreciable change in traffic would occur. Mr. Herman Seipp, in attendance, stated to the Council that at the time he applied for a business rezone of his property in the Nob Hill area, that he was told a proposed plan for the development of the property was necessary, and he noted that this information was not presented to the Council for the Anderson rezone. Mr. Seipps wondered if this requirement had been changed. Councilman Lynch stated that Mr. Seipps had asked this question at the Planni Commiss on meeting last month, and they had informed him that although a proposed plan is de- sirableis not mandatory. Councilman generally agreed that proposed plans were helpful to the Council when making decisions on the matter of rezones. Mayor Larson than asked for a roll call vote on the motion to adopt the ordinance: carried, Brazier, Larson, Lemon, Lynch, Kurbitz, voting aye on roll call. Munger and Robinson voting Nay. ORDINANCE NO. 497, an ordinance accepting the recommendation of the Planning Commission and re- zoning certain property located at 1102 South 28th Avenue and 2804 Nob Hill Bbulevard, in the City -)of Yakima, Washington from R -2, Two Family Residence Zone, to B -2, Local Business Zone. This being the time fixed by the Council for the hearing on the matter of the Planning Commission intention to amend zoning code regarding uses permitted in B -1, Modified Business Zone, it was MOVED by Lemon, seconded by Munger that Ordinance No. 498, relating to use regulations in,B -1, Modified Business Zone and amending the Yakima Municipal Code be passed as read: carried, Brazier. Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. ORDINANCE NO. 498 , an ordinance relating to zoning of real property within the City of Yakima specifying use regulations applicable to a B -1, Modified Business Zone; and amending Section 12.28.010 of the City of Yakima Municipal Code. Moved by Lynch, seconded by Robinson that Resolution No. D -653, a resolution prescribing a form of contract for City advertising and directing publication of notice for proposals. be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Cornell, Howland, Hayes and Merryfield, Consulting Engineers, having submitted monthly estimate No. 1 on Industrial Waste Irrigation System dated January 30, 1964, recommending that payment in the amount of $9,992.74 be made to W. H. Gregory Co., it was MOVED by Robinson , seconded by Munger that said Consulting Engineers,report be accepted and that the monthly estimate therein set forth be approved and payment of said estimate be hereby authorized: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. City Manager Smith having recommended that the City Council initiate steps to form an L I D for the improvement of streets on 16th Avenue, from Mead Avenue to Lenox, and from Lenox to Broadway and that the property owners in the area assume part of the cost, it was MOVED by Robinson, seconded by Lynch that resolutions be prepared to set date of hearing for proposed L I D to be presented to the Council for action at the next regular meeting of the Council: carried, Brazier,i Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. I 512 FEBRUARY 3 1964 Referring to the Yakima Action Committee's proposal for Downtown Parking Study, Manager Smith reported to the Council that he had received two engineering firms estimates on the Downtown stud which includes parking. One firm gave an estimate ranging from $12,000.00 to 1$,000.00. The 12,000 figure would be for the cost of a 60 day first phase study which would determine whether to proceed further with the study. Another firm quoted $19,750.00 for a two phase study of which $5200.00 would be for a 90 day first phase study. Mr. Smith stated th, -t 2 more firms will be submitting estimates very soon. It was MOVED by Robinson, seconded by Lynch that this information be passed on to the Yakima Action Committee for study: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Mayor Larson asked the staff to arrange a meeting for the Council with the Action Committee to discuss this matter. Public Works Director Mayo reported to the Council on the 1964 Street Improvement Program. He stated that bids will be opened Monday, February 10, 1964 for irrigation canal crossings on Summit view, and the Storm Sewer Projects on Lenox and Broadway ending in the area of St. Elizabe Hospital. Mayo further reported that Summitview Avenue will be closed for several days to allow for the installation of irrigation pipes. City Manager Smith also reported to the Council that he had been informed by our Consulting Engineer that the Auditorium Study as proposed by the Chamber of Commerce does not meet re- quirements to be eligible to apply for federal funds to conduct this study. Council asked that this information be passed on to the Chamber of Commerce.
