Council- man Robinson present after 3:15 P.M. Councilman Lemon gave the invocation. The Minutes of the regular meeting of January 6, 1964 were approved as read. Moved by Munger, seconded by Lemon that Ordinahce'No. 492-an ordinance placing a parcel of real property located at 602 and 604 South 24th Avenue and owned by Georgia L. Reed, on the irrigation maintenance roll of local improvement district No. 450, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger voting aye on roll call. Robinson absent. ORDINANCE NO. 492, AN ORDINANCE placing a parcel-of real property in the City of Yakima on the irrigation maintenance roll of Local Improvement District No. 450. Moved by Lemon, seconded by Munger that Ordinance No. 493 an Ordinance placing a parcel of real property located at 2002 Tieton Drive, and owned by Paulina Schneide on'the Irrgiation Main- tenance roll on Local Improvement District No. 450, be passed as rea carried, Brazier, Kurbit'z, Larson, Lemon, Lynch and Munger voting aye on roll call. Robinson absent. ORDMANCE NO. 493, AN ORDINANCE placing- a-parcel'of- real property in the City of Yakima On Irrigation Maintenance Roll of Local Improvement District No. 450• Moved by Munger, seconded by Lemon that Resolution No. D -643 authorizing execution of agree- ment with Northern Pacific Railway Company to accomodate the construction of the Lenox Avenue overpass be passed.as.read: carried, Brazier,_.Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call., City Manager-.Smith explained the terms of the agreement to Council members, and Publil7o$igector John Mayo stated that if the railway company execute the necessary documents'promptly; that we will go to bids in February and award contract the latter part of March. RESOLUTION NO. D -643; A RESOLUTION authorizing the City Manager and City Clerk of the City of Yakima to execute an agreement with the Northern Pacific Railway Company. Moved by Lynch, seconded by Munger that Agenda -Item 5b,-a resolution consenting to assignment of Avis Rent A Car system agreement by David-E -.'Campbell to C. W. Terry c /b /a Terry's Rental, and Agenda Item 5 -d authorizing sales of City owned property declared surplus, be held over until the next regular meeting of the Council'-on January 20 ,1964 at 8 p.m.: carried, Brazier Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Manager Smith requested the holdover as he is awaiting additional information - pertinent to these items. MOVED by Robinson, seconded by Munger that Resolution-No. D -644 fixing the date of hearing on Petition No. 227 requesting vacation'of Prssch Avenue -at the regular meeting of the Council on February 17, 1964 at 8 p.m. carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. RESOLUTION NO. D- 644:;; A RESOLUTION fixing the time and place for hearing on petition for vacation of a public street. - Mayor Larson called on Mr. James Cowan, Chairman -of the Yakima Action Committee who read the following motion to the City Council which was adopted by the Yakima Action Committee at their meeting of January 7, 1964. "That sufficient evidence and justification exists for an immediate undertaking of a feasibility study by the City for municipally owned off - street parking facilities in -the Central Business District - such study to be jointly financed by the City of Yakima, the Retail Merchants and'the Downtown property owners and accomplished by a recognigdd consulting firm which is acceptable to the city and bonding firms ". Mr. Cowan asked the Council to undertake this study at the earliest possible date, and stated that the Action Committee would like -to meet with the Council for father discussion on this matter. Councilman Robinson asked Mr. Cowan if the Yakima Action Committee had'a definite figure as to the cost for this study. Mr. Cowan stated no definite figure had been ascertained1 Councilman Lynch stated that he did not know where the city would obtain its share for this study, and asked Mr. Cowan if the property owners and merchants would be able to raise their one third of the costfvery soon. Mr. Cowan °stated that the two groups had given assurance that they would be able to raise their share. Councilman Robinson stated that he did not feel the city had to share in the cost of the study in order to give it authenticity and also said the city would find it difficult to find fuh& -to -share in this study. IT was then MOVED by Councilman Robinson, seconded by Lynch that=we accept the recommendation of the Yakima Action Committee with thanks for the work it had done and hold said recommendation for study by the Council. Under discussion other persons interested in this matter were called on for their views. Mr. George Corbett stated that the property owners and merchants were very generous in their offer to underwrite one third of the.cost, that most cities paid the full cost of such a study. He further stated that the city derives 300 thousand dollars from property tax in the downtown area and in order to maintain this'tax structure, the city should provide for the future development of. the Central Business District. In answer to Don Connors inquiry as to whether the City Planning and Engineering staff might do this - study, Manager Smith reiterated Councilman Kurbitz's statement that bonding companies purchasing bonds require that these studies be made by recognized firms in this - field. Mr. Connors also posed the question as to whether the idea of. private enterprize had been looked into extensivly. In answer to Mr. Tom Hargis statement that,he was concerned about C. Robinson's motion as stated as it appeared to infer that the matter might be tabled indefinitely, Councilman Robinson assured Mr. Hargis this was not so, but that the motion as stated was made in order to be able to obtain complete information regarding this matter, such as to what the cost might be, and to determine if the city can finance the one third of the cost. Mr.-Brad Emery suggested that this might be financed through_a local improvement district. He further stated that the problems in the business district is partly the fault of property, owners who demand high rent and do nothing to improve their buildings. Councilman Kurbitz stated he favored thisstudy, that it would be money well spent and that we must help prevent our central business area from deteriorating. 1 1 1 1 0 1 1 1 �._., JANUARY 13, 1964 56 -5 Councilman Brazier stated that he..did not know whether he would favor or oppose this matter, but that he would like to know how the citizens of Yakima feel about municipal owned parking facili- ties, and suggested that all interested persons attend the ne�.xt council meeting and express their views on this matter. Mr. Michaels suggested that.a poll might be taken as to the views of the people of Yakima through a coupon in the local newspaper. Councilman Lemon stated that he did not think the ills of the downtown area can be'entirely contributed to the parking problem.- Mr. Hargis stated that this is the one important problem. and we should not be content to stand still on this matter. Mr. Cowan stated that this study might indicate if other factors were contributing to`th'e downtown area problem. A11- ib6rsons having been heard , Mayor Larson, asked for a vote, of the"Council on the motion as made by Councilman Robinson and seconded by Councilman Lynch:,Motion carried, Brazier, Kurbitz,.Larson, Lemon, Lynch, Munger and-Robinson voting aye by voice vote. The Planning Commission reporting on'Petition No. zh229 as filed by J,. J. Anderson requesting the rezone of certain property located at. 28th and Nob Hill from R -2, Two Family zone,.to B -2, Local Business zone, it was MOVED by Lynch,'seconded by Lemon that a Public Hearing "beheld on this. matter at the regular meeting of the ;Council on February 3, 1964 at 3 p.m. and that due notice be given by publication, carried, Brazier, Kurbitz,-Larson,-Lemon, Lynch, Munger and Robinson voting aye by.voice vote. The Planning Commission reporting on the Intention to amend zoning code regarding filing fees it was MOVED-by-Brazier, seconded by Robinson that a public hearing be held on this matter at the regular-meeting of the Council on,'Feb.ruary.17; 1964 at 8 p.m. and that due notice be given by publication; =carried, Brazier, Kurbitz,-,Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.-- The Planning .Commission having reported'on the intention to amend Code regarding 'B -1 Modified Business Zone,-it was MOVED by Lynch, +'seconded by Munger, that a public hearing be held on this matter at the regular meeting of the council on February 3; 1964 at ,3 p.m. and.that due notice be given by .publication: carried., Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye,by voice vote. The City Epgineer having submitted the final-estimate on the 1963 Street Paving project, South 38th Avenue and various others,_L.I.D'. 909, in the amount of $3;756.$0 payable to Superior Asphalt and Concrete, it vas-MOVED by Lynch, seconded by Munger that said engineer's report dated January 13, 1964 be approved and payment of final estimate therein set.forth be authorized: carried Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye bynvoice vote. Manager Smith having reported to the Council the need for the'sale of the 1.6 million dollar street bonds for the Lenox - Avenue Overpass and Su.mmitview projects, it was MOVED by Robinson, seconded by Munger that the City Manager be'authorized to prepare the necessary documents for the sale of these bonds: carried, Brazier, Kurbitz, Larson, Lemon, Lynch,-Munger and Robinson voting aye by voice vote. Public Works - Director Mayo presented to the Council a 24 hour traffic count on 40th Avenue from December 2, 1963 through January 8, 1964 stating the maximum traffic count for a 24 hour period was 5,097 cars. Manager Smith reported to the'Council that the meeting set up by Mr. Cavanaugh, of Ebasco Co. Consulting,Engineers for a second progress report on January:16, 1964, has been postponed to January 23, 1964 at 3 p.m. , Councilman.Lynch requested that the City Manager set up a meeting with Grey and Osborne so that the Council could review the water report.
