Councilman Kurbitz absent and "excused. Councilman Munger gave the invocation. The Minutes of the regular meeting of December 30, 1963 were approved as read. This being the time fixed.'for the hearing on Resolution No'..D -632 a resolution of intention to create an L. I. D. for construction of Domestic Water Service in Mt. Vista Addition as per Petition No. 235-as filed-- by-Ted Haubrich,.and there being no protests in writing or otherwise, it was MOVED by Munger, seconded by Lemon that Ordinance No. 489 providing for these improve- ments and creating a Local Improvement District No. 914 be passed as read: carried,�razier, Larson, Lemon, Lynch, Munger-and Robinson voting aye on'roll call. Kurbitz absent. The Engineer's report dated January 6, 1964 showed the toal cost and expense of the improvement estimated at $3,747.09 of which amount it is estimated'that.�$2,96$.52 is to be borne by assess- ment against the properties within the proposed district and the balance $778.57 is to be borne by the Water and Sewer fund. ORDINANCE NO. 489 , AN ORDINANCE` °providing for the improvement of certain property by.. constmtinj the necessary mains, fire.hydrants, valves and other appurtenances for-the-purpose of supplying , water for domestic use and fire protection; establishing 'a Local Improvement District, providing for the method of payment thereof and creating a special fund. Petition No. 28 having been filed with the City Clerk on December 30, .1963- Will J.- Hackett and Marguerite L. Hackett'requesting the rezone of property located at 1112 South 16th avenue between Nob Hill Blvd. and Stone Street, it was MOVED by Robinson, seconded by Lynch, that said petition be referred to the City Manager and Planning Commission for study and recommendation: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. AN ORDINANCE relating to street plantings on City Streets, sidewalks, alleys and other public.ways within the City of Yakima, requiring a,permit therefore and authorizing the City Manager'to issue such permit;.,and amending Section`8.116.010, Section 8.16.020, and Section-8.19-030.(a) of the City of"Yakima- Murtcipal Code,- and °;adding a subsection known as 8.16.040(h)-to the C:bty:,of Yakima Municipal code. In discussion.Chief. Soderstrom informed the, Council that the training.range.,would also be used by other law;`_enforcement groups. In ansti -:er. to` Councilman's Lynch's ir4t iry as to .who would be liable if "'other groups had accidents or damaged the property, City A.ttorney.Andrews :said that since the:_,city .is the licensee, it would _b.e ,responsible, however; he--informed the council that other.per.,sons.using. the range would be:.required to sign.a waiver which`_would; free the city from direct responsibility for damages or.persorial injuries. In answer to Council'mna's Robinson's inquiry as to when cleanup and repair work would be completed by the contractor on 24Th Ave. and Washington Ave . as he considered this rather hazardous to drive on in,its present state, Public Works Director Mayo informed the Council that when weather permits this work will be completed. City Manager Smith having requested permission for Captains Robert Madden and Douglas Campbell to attend a Northwest Auto Theft Conference to be held on.January 9 and 10th at Portland, it was MOVED by Lynch, seconded by Brazier, that said Policemen be all to attend this. conference and that their expenses be paid: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting a e by voice vote. Kurbitz absent. Discussion indicated their expenses would be approximately $80.00. There being no further business.to come before-.the Council, it was'MOVED by Lynch, seconded by Brazier, that we do now adjourn at the hour of 4:25 p.m.: carried, Brazier, Larson, Lemon, - Lynch, Munger and Mobinson voting aye by voice vote.
