The City Council met in re gular session,
and Robinson, City Manager Smith and City
Moved by Robinson, seconded by Lynch that
Brazier, Larson, Lemon, Lynch, Munger and
Councilman Lemon gave the invocation.
Mayor Larson, Councilmen Brazier, Lemon, Lynch, Munger
Attorney Andrews present on roll call. Kurbitz absent.
Councilman Kurbitz be excused from this meeting: carrie
Robinson voting aye by voice vote.
The minutes of the regular meeting of December 2, 1963 and the Special Meeting of December 4, 196
were approved as read.
A Notice of Intention to Cormnence Annexation Proceedings having been filed with the City Clerk on
this date by Bruce Glenwood Corporation and Mr. R. B. Colwell, President of said corporation bein
present:.at this meeting, it was MOVED by Robinson, seconded by Munger that the City Council now
meet with the initiating parties who signed said Notice dated December 9, 1963, those initiating
parties being the Bruce Glenwood Corporation, R. B. Colwell,President: carried, Brazier; Larson,
Lemon, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz absent. ✓ Mr. Colwell in-
dicating that his firm is willing to assume it's share of the City's indebtedness, it was MOVED.
by Munger, seconded by Lemon that the annexation proposed by Bruce Glenwood Corporation, be ac-
cepted by the City of Yakima and that the area to be annexed be required to assume it's share of
the City's existing indebtedness: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson
voting aye by voice vote. Kurbitz absent.
An Ordinance appropriating the sum of $4,249.20 from the unappropriated monies of the Airport
Improvement Fund to the 1963 Budget for that fund and $28,250.80 from the unappropriated monies
of the Municipal Airport Fund to the 1963 Budget for that fund, having been read in its entirety
at the regular meeting of the City Council on December 2, 1963 and laid on the table for one week
and having been read by title only at this meeting, it was MOVED by Lynch, seconded by Munger
that Ordinance. No. 483 providing for said appropriation be passed as read: carried, Brazier,
Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.. Kurbitz absent.
ORDIP,* ,fANCE NO. 483, AN ORDINANCE appropriating the sum of $4,249.20 from the unappropriated monie
of the Airport Improvement Fund to Account 6 -10, Land.;of the Capital Outlay Account Classificatio
of the 1963 appropriation. for 63- Airport Improvement rund.; and appropriating the sum of $28,250.8
from the unappropriated monies of the Municipal Airport rund to Account 6 -10, Land, of the Capita
Outlay Account Classification of the 1963 appropriation for 39- Municipal Airport Fund.
In accordance with action taken by the City Council at their regular meeting of November 26, 1963
on the matter of annexing certain property as described on Petition No. 228 and filed by the
Country Store, and the Planning Commission having reviewed the zoning of said property to be an-
nexed and now recommending B -3, General Business and M -1, Light Industrial zones after hearing
additional and pertinent information regarding; uses of the area to be annexed, it was MOVED by
Lemon, seconded by Lynch that Ordinance No. 484 which provides for said annexation and zoning
of certain, property east of South lst Street contiguous to the City of Yakima, be passed as read:
carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Kurbitz
absent. vin the discussion of this matter, before the voting on the motion to pass said ordinance
Mr. V. J. Beaulaurier, Attorney and Secretary for-the petitioner, indicated that perhaps further
consideration should be given to the Auto Salvage business operated by Roy Rassmussen and located
north of the Country Store operations. He suggested that due to the salvage operation of this
business, perhaps Mr. Rasmussen's property should be included in the M -1, Light Industrial zone
since it is a non - conforming use in a B -3, General Business Zone and his client will not be able
to move his building and improve as planned. Discussion-of this matter established that the
salvage part of this business will eventually phase out and Councilmen indicated that any further
change in zoning would need ratification of the Planning Commission and su gested that a County
Building Permit be obtained and this building moved before Ordinance No. 494 becomes effective.

ORDINANCE NO. 484, AN ORDINANCE providing for the annexation by the City of Yakima of certain
property contiguous to the City of Yakima and zoning said property.
In accordance with action taken by the City Council at their regular meeting of December 2, 1963
the Council continued the hearing on Petition No. 232 as filed by the Masonic Temple Association,
requesting the rezone of certain property between E & F Street and North 4th Street and Naches
Avenue. It was MOVED by/Munger, seconded by Robinson that Ordinance No. 485 providing for the
rezone of said property from R -3, Multiple Family Residence Zone to B -1, Modified Business Zone,
be passed as read: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye bn rol
call. Kurbitz absent. J In the discussion of this matter, reference was made to the Planning
Commissions report dated December 5, 1963 announcing their intention to amend the zoning code
with regard to Professional Offices Buildings in B -1, Modified Business Zone. Mr. Velekanji,
Attorney for the Petitioner indicated again that B -1, Modified Business Zone will be acceptable
only if such an amendment is made to the zoning code and Councilmen Lemon, Lynch, Munger and
Robinson indicated that they will be in favor of such an amendment.
ORDINANCE NO. 48:5, AN ORDINANCE accepting the recommendation of the Planning Commission and re-
zoning certain property in Block 85 of the Town of North Yakima, from R -3, Multiple Family Resi-
dence Zone to B -1, Modified Business Zone.
An ordinance appropriating $4,365.00 from the unappropriated monies in the City Garage Fund to
the 1963 Budget for that Fund., having been read in its entirety, was ordered laid on the table
for one week or until the next regular meeting of the Council on December 16, 1963.
An ordinance relating to the Electrical Code vhich_regulates the issuance of electrical permits
having been read by the Clerk of the Council, it was MOVED by Robinson, seconded by Lemon that sa
ordinance be passed as read: Mr. Me Coy, Building Inspector explained that this amendment will
clarify the code concerning home owners permits for doing their own wiring, further explaining
that a few speculation builders are wiring the houses they build and the licensed contractor is
objecting to this practice. He stated that this amendment will still allow the home owner to do
his work but will prohibit the contractor from doing electrical work without a license. Mr.
Mc Cov assured the Council that the Speculative Builder is meeting code standards but stressed th
fact that the Electrical Code now allows the builder to do electrical work without a license be-
cause he owns the structure. Discussion pointed out that the contractor doing only Electrical
work must be licensed by both the State and City and Councilman Robinson indicated that the
Council should not legislate in matters of. competition but in the interest of public safety
and expressed the desire to discuss the matter with interested persons, including the speculative
builders and electrical contractors. Councilman Lynch indicated understanding of the Electrical
Contractors problem and expressed favor for the amendment. It was then MOVED by Robinson, second
ed by Munger that this matter be continued for one week until the regular meeting of December 16,

in the 1963 Budget for the Fire Department, be passed as read: carried, Brazier, Larson, Lemon,
Lynch, Munger and Robinson voting aye on roll call. Kurbitz absent. Discussion indicated that
this amount will be used to repair a pumper for the Fire Department
RESOLUTION NO. D -629, A RESOLUION transferring the sum of $2,200 within the 1963 appropriation f
22 -Fire Department.
Moved by Munger, seconded by Lemon that Resolution No. D -630 authorizing the purchase of certain
repair parts for a Galion Roller without calling for bids; be passed as read: carried, Brazier,
Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Kurbitz absent.
RESOLUTION NO. D -630, A RESOLUTION authorizing and directing the purchase of material without
calling for bids.
Moved by Munger, seconded by Lemon that Resolution No. D -631 authorizing the purchase of a Heil
Packer and truck for the Garbage Department without calling for bids, be passed as read: carried
Brazier, Larson,-Lemon, Lynch, Munger and Ro',.inson voting aye on roll call. Kurbitz absent.
Discussion-of this matter indicated that this will provide the City with its 6th Packer and truck
of this type and that the price on this purchase will be the same as that on the original bid.
RESOLUTION No. D -631, A RESOLUTION authorizing the purchase of a Heil Packer and truck, without
calling for bids.
The Planning Commission now reporting and making certain recommendations as to the zoning of -
certain property sought bo be annexed by Mr. Leroy Brackett, signer of Petition No. 236, it was
MOVED'.by Munger, seconded by Lynch that Petition No. 236 be approved as meeting the requirements
of law ; that the City Manager and the Mayor be authorized to obtain waivers of a meeting of a
Review Board, as authorized by law; and that a resolution be prepared fixing December 23, 1963
as the time for a public hearing by the City Council on this petition: carried, Brazier, Larson,
Lemon, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz. absent.

improvement project, it was MOVED by Lynch, seconded by Robinson that said estimate and report
dated December 9, 1963 be approved and the estimate therein'-set forth be.approved and payment
authorized: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye'by voice vote.

Mr. Gene Land, property owner in the area newly annexed to the Cj�7 of Yakima on this date, being
present ..during the hearing on this matter, protested the passage of Ordinance No. 484, without
hearing protests to said action.
Mayor Larson reported on a meeting of the Association of Washington Cities.
There being no further business to come before the Council, it was MOVED by Brazier, seconded by
Lynch that we do now adjourn at the hour of 5:00 P.M. carried: Brazier, Larson,*Lemon, Lynch,
