HomeMy WebLinkAbout12/02/1963 Business Meeting1 1 1 491 DECEMBER 2, 1963 The City council met in regular session, Mayor Larson, Councilman Brazier, Lemon, Lynch Munger and Robinson , City Manager Smith and City Attorney Andrews present on roll call. Councilman Kurbitz absent: The Clerk of the Council having received a letter from Council- man Kurbitz asking that he be excused from attendance at this meeting, -it was MOVED by Robinson, seconded by Lynch that Councilman Kurbitz be excused: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz absent. Councilman Munger gave the invocation. The Minutes of the regular meeting of Tuesday, November 26, 1963 were approved as corrected. 1963 Tuesday December 3/, being the last day under State law for the City Clerk to assign numbers to the Council positions to be voted upon, in February; "and March-of 1964,' the'- Clerk of the Council asked'th6- incur`barits to draw 'the position numbers. Councilman Lemon drew Position No. 1, Councilman Robinson drew position number 3. Councilman Kurbitz not in attendance auto- matically was assigned Position No. 2. This being the time fixed by the Council for the hearing on Petition No. 217 as filed by James Baumgardner requesting the rezoning of property located at 3801 Tieton Drive from R -1, Single Family Residence, to B -2, Local Business Zone and it having been determined that the petitioner or his agent or other interested parties -were not present to be heard, it was MOVED YmM l :l Zn son, seconded by Lynch that the resolution affirming the action of the City Planning�in denying application be read and considered: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinsox voting aye by voice vote. Kurbitz absent. It was then MOVED by Robinson, seconded by Lemnn that Resolution No. D 626 a resolution affirming the action of the Planning Commission in denying the application to rezone property at 3801 Tieton Drive be passed as read: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Kurbitz absent. RESOLUTION NO. D -626, A RESOLUTION affirming the action of the City Planning Commission in denying the application of James E. Baumgardner and Mary L. Baumgardner, Husband & Wife, to rezone certain property located at 3801 Tieton Drive in the City of Yakima from R -1, Single Family Residence Zone to B -2, Local Business Zone,. It was MOVED by Robinson, seconded by Munger, that by Yakima Masonic Temple Association be continued of the Council on December 9 , at 3 p.m.: carried, Robinson voting aye bn rollc! call. MOVED by Lynch, seconded by Munger that Resolution No. D -627 authorizing the purchase of property from Sam Christoff for clear zone be passed as read: carried, Brazier, Larson, Lynch, Lemon, Munger and Robinson voting aye on roll call. v� Councilman Brazier stated he thought the $32,500 settlement was a little too high but in view of the contingencies of "t the litigation and the recommendation of the staff, he would go along with the majority vote of the Council. Manager Smith gave a brief summary of events leading to the purchase of the -clear zone property and property for the 16th Avenue relocation, and stated that it may be necessary for the City to issue general obligation bonds to cover their share of the expense for this property. RESOLUTION NO. D -627 A RESOLUTION authorizing and directing the purchase of real property from Sam Christoff and Gana Christoff , husband and wife, in settlement of Cause No. 46621 in the Superior Court of the State of Washington in and for Yakima County. MOVED by Munger, seconded by Lynch, that Resolution No. D -628, a resolution authorizing a temporary loan of $25,000.00 from the Cumulative Reserve for Domestic Water Supply Development Fund to the Municipal Airport Fund, and providing for repayment be passed as read: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye by roll call. Kurbitz absent. RESOLUTION NO. D -628 , a resolution authorizing a temporary loan of $25,000.00 from the Cumulative Reserve for Domestic Water Supply Development Fund to the Municipal Airport fund, and providing for repayment. An Ordinance appropriating $4,249.20 from the unappropriated monies of the Airport Improve- ment Fund, and appropriating the sum of $28,250.80 from the unappropriated monies of the Municipal Airport Fund for the purchase of Clear Zone property was read in its entirety and ordered laid on the table for one week or until the next regular meeting of the City Council on December 9, 1963 at 3 p.m. MOVED by Robinson, seconded by Lemon that Ordinance No. 481, an Ordinance establishing minimum charges for Domestic Water, and amending the Yakima Municipal Code be passed as read; carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Kurbitz absent. ,/Councilman Lynch stated that there is too little difference in the minimum charge for water supplied to those inside and outside the city, and suggested that a study be made within the next year to determine whether the charge for water service outside the city is adequate, and that the city users are not bearing the burden for-the service given to the suburban areas Manag.er!Smith stated that change of rate studies should be considered in light of the over all picture of the financing of the Water and Sewer program. ORDINANCE NO. 481, AN ORDINANCE establishing minimum charges for domestic water, and amending Section 7.68.255 of the City of Yakima Municipal Code. In accordance with action take by the Council at their regular meeting of November 26, 1963 with regard to protest filed against certain improvements as provided for in Local Improvement District 913 , it was MOVED by Munger, seconded by Lemon that Ordinance No. '482, An Ordinance amending Section 1 of Ordinance No. 469 of the City of Yakima by deleting Prasch Avenue from the Local Improvement District be passed as read: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz absent. F, 492 DECEMBER 2, 1963 ORDINANCE NO. 482, AN ORDINANCE amending Section I of Ordinance No. 469 of the City of Yakima entitled an Ordinance providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; esta4lishing a Local Improvement District, providing for the metho of payment thereof, and creating a special fund. It was MOVED by Robinson, seconded by Munger that said engineers report dated December 2, 1963 be approved and payment of same be authorized: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz absent. Mayor Larson announced that-a special meeting of the Council will be held on Wednesday at 1:30 p.m. for the purpose of the receiving and opening bids for the Water and Sewer Revenue Bond issue. City Manager Smith reported to the Council that the Bond Sale for Sewer construction has been rated at A and AA by the National Bonding Services. There being no further business to come before the Council, it was MOVED by Brazier, seconded by'Lynch that we do now adjourn at the hour of 4:30 P.M, Carried: Brazier, Larson, Lemon, Lynch Munger and Robinson voting aye by voice vote.
