Mayor Larson, Councilmen Brazier, Lynch, Munger and Robinson, City Manager 'Dmith and City Attorney Andrews present on roll call. Councilmen Kurbitz and Lemon absent on roll call. Acknowledging the written requests to be excused as received by the City Clerk, it was MOVED by Robinson, seconded by Munger that Councilmen Kurbitz and Lemon be excused from this meeting: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye by voice vote. Councilman Brazier gave the invocation recognizing the Nations loss by a moment of silent prayer. The minutes of the regular meeting of November 18, 1963, were approved as read. This being the time fixed for the hearing on Petition No. 226 as filed by Oscar Larson, praying for the annexation of certain property North of Englewood and East of .4 7th Avenue, and there being no protests in writing or otherwise, it was MOVED by Munger, seconded by Robinson that Ordinance No. 480 providing for the annexation of said property and zoning all and every part thereof as R -1, Single Family Residence, be passed as read: carried, Brazier, Larson, Lynch, Munger. and Robinson voting aye on roll call .� /It was noted in the discussion that neither, the petitioner, Mr. Larson, nor any of the persons who have purchased property from him were present at this meeting. ORDINANCE NO. 480, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima, and zoning the same as R -1, Single Family Residence Zone. This being the time fixed for the hearing on Petition No. 228 as filed by the Country Shopping Center, Inc., praying for the annexation of certain property East of South lst Street contiguous to the City of Yakima, and said petitioner having filed an appeal from the findings and recommen- dations of the City Planning Commission on the matter of zoning said pro perty to be annexed, it was MOVED by Robinson, seconded. by Munger that the written MOTION disapproving the recommendation of the Planning Commission relative "to the zoning of this property and requesting a further re- port from said Planning Commission, be read and considered: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz and Lemon absent. It was then•MOVED by Robinson, seconded by Munger that said MOTION be passed as read. After some discussion, it was MOVED by Robinson, seconded by Munger that said MOTION be amended to read ? ?that the property recommended for B -2 Local Business Zone should be zoned B -3, General Business Zone: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz and Lemon absent. Mr. V. J. Beaulaurier, Attorney for and Secretary of the corporation petitioning for said annexation, spoke in favor of B -3, General Business zone and M -1, Light Industrial zone instead of B -2, Local Business Zone and R -4, Suburban Residence Zone, as recommended by the Planning Commission. Mr. Gamache, President of Country Shopping Center, Inc., indicated that he could not support the annexation unless it is zoned B -3, General Business zone because of the various types Hof business being planned for, in this area. Mr. Gene Land, 812 East Mead, property owner in the area to be annexed, vigorously protested the annexation and zoning of his property, stating that B -3, General Business Zone, will jeopardize future expansion for him and asked to be exempt from annexation. Mr. Land explained that he has 1 1/2 acres on which he keeps stock and that he has some rentals in the area. He then filed a petition protesting the annexation signed by 6 property owners which had been signed within the last 5 or 6 days. Mr. Wm. A. Brown, property owner, and one of the persons who had signed the petition protesting said annexation, explained that he does) "not object to the Country Store being annexed to the City, but does not wish to be included in the action. Mr. Roy Rasmussen, of the Highway Auto Wrecking Co., spoke in favor of M -1, Light Industrial zone for the area including his business. After hearing the discussion, both for and against this action, it was MOVED by Brazier, seconded by.Lynch that the MOTION as read, be fur- ther amended to read '?property recommended for R -4, Suburban Residence Zone, should be zoned B -3 General Business Zone or M -1, Light Industrial Zone, or both ? ?: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz and Lemon absent. Mayor Larson then call- ed for a vote on the original motion to pass the written motion as amended by the City Council, and it carried: Brazier, Larson, Lynch, Munger and Robinson voting aye on roll call. Kurbitz and Lemon absent. This being the time fixed by the City Council, to meet with Ken Kincheloe, Francis E. Walker, Ray Kooser and Eulah Miller, all of the signers on a Notice of Intention to Commence Annexation Proceedings, and it having been determined that Francis E. Walker, Eulah Miller and Ken Kincheloe were unable to attend this meeting, and that Mr. Wm. Regimbalt'., property owner in this area, was presa� n place of Mr. Walker, that Mr. Z. A. Miller was present in place of his wife Eulah Miller, and Mrs. Kincheloe was present in place of her husband Ken Kincheloe, and under the direction and instruction of City Attorney Andrews, a new NOTICE OF INTENTION TO COMMENCE ANNEXATION PROCEEDING was signed by L. A. Miller, Ray Kooser and William Regimbal, who represent': ten percent in value of the property for which annexation will be petitioned. This notice was filed with the Clerk of the Council at this time. It was then MOVED by Brazier, seconded by Lynch that the City Council meet s.ith Mr. Miller, Mr. Kooser and Mr. Regimbal at this time: carried, Brazier, Larson, Lynch Munger and Robinson voting aye by voice vote. Kurbitz and Lemon absent. The signers then in- dicating their willingness to assume their share of the City's indebtedness, it was MOVED by Robinson, seconded by Munger that the annexation pro posed'by L. A. Miller and others be accepted the City of Yakima and that the area to be annexed be required to assume its share of the City's indebtedness: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz and Lemon absent. Moved by Lynch, seconded by Brazier, that Resolution No. D -624 authorizing the sale of certain city owned property declared to be surplus, be passed as read: carried, Brazier, Larson, Lynch,. Munger and Robinson voting aye on roll call. Kurbitz and Lemon absent. D -624 RESOLUTION NO. A RESOLUTION authorizing and directing the sale of certain surplus personal proper owned by the City of Yakima. Moved by Brazier, seconded by Robinson. that Resolution No. D -625 authorizing the purchase of cast iron pipe from Mr. Gene Bohannon, a contractor, without calling for bids, be passed as read: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye on roll call. Kurbitz and Lemon absent. qDiscussion indicated that $118.00 will be saved by making this purchase in this manner and that the pipe will be used immediately. RESOLUTION NO. D -625, A RESOLUTION authorizing the purchase of cast iron pipe without calling for bids. 1)y iy r 490 NOVEMBER 26, 1963 A Notice of Appeal from the Planning Commissions decision having been filed with the City Clerk on November 22, 1963 by J. J. Anderson, it was MOVED by Robinson, seconded by Munger that Decembe 16, 1963 be set as the time for a hearing by the City Council on the matter of the rezone of certain property as applied for on Petition No. 229 and that the City Clerk give notice of such hearing as required by law: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz and Lemon absent. The 30 day legal time limit for protests to be filed, having expired on November 21, 1963, in connection with the formation of Local Improvement District No. 913, and the City Engineer's report dated November 26, 1963, having been read and reporting. 53% protest in connection with the improvement of Prasch Avenue 12th Avenue to Queen Avenue, it was MOVED by Robinson seconded by Munger that an ordinance be prepared deleting this improvement from L.I.D. No. 913, South'45th Avenue & Various ethers Paving District: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz and Lemon absent. Mr. D. 0. Robertson and Mr. D.C. Logan having filed a protest on November 20, 1963 carrying 14 signatures against the improvement of the alley in Block 420 of J. D. Nichols Capitol Heights Addition, attended this meeting and indicated that the plans for this improvement will not serve all of the property owners in the block and .requested members of the Council to investigate. The Engineer's report indicates that 45.5% protest has been filed against the improvement of this alley which is also a part of L.I.D. No. 913. Councilman Brazier was excused at tl�e hour of 5:00 P.M. City Manager Smith requested permission for Fire Chief, W. K. "Pete" Moore to attend a staff and Command School in Winston North Carolina, explaining that it will be held February 24 throug 27th, 1964 and that the Chief has been requested to participate in the program and will have his expenses paid by the school. MOVED by Lynch, seconded by Munger that Chief Moore be allowed to make this trip out of state: carried, Larson, Lynch, Munger and Robinson voting aye by voice vote. Brazier,. There being no further business to come before the Council, it was MOVED by Lynch, seconded by Munger that we do now adjourn at the hour of 5:10 P -M: carried, Larson, Lynch, Munger and Robins( voting aye by voice vote.
