T,aith Assistant Mayor Brazier presiding. Councilmen Lemon, Munger and Robinson and City Manager Smith present on roll call. Councilmen Kurbitz and Lynch absent on roll call. . Council members wishing to participate in cerimonies prepared for the opening of the Yakima Free- way, it was MOVED by Robinson, seconded by Munger that we do now recess to the hour of 4 :30 P.M.: carried, Brazier, Lemon, Munger and Robinson voting aye by voice vote. Kurbitz and Lynch absent. RECESSED MEETING, TU.E:SDAY, NOVEMBER 12, 1963, 4:30 P.M. The City Council met pursuant to recession, Mayor Larson, Councilmen Brazier, Lemon, Munger and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilmen Kurbitz and Lynch absent. Councilmen Lemon gave the invocation. The Clerk of the Council having read a request to be excused as received from Councilman Kurbitz, it was MOVED by Brazier, seconded by Munger that Councilman Kurbitz be excused from this meeting: carried, Brazier, Larson, Lemon, Munger and Robinson voting aye by voice vote. Kurbitz and Lynch absent. It was noted that Councilman Lynch was regularly excused from this meeting at the Pre- vious meeting of the Council on November 4, 1963. Mr. John Chesterly, Chairman of the Metropolitan Park Board being present, reported that said Park Board gave due consideration to the Council's offer of a 5 year lease with a 5 year option for-the Naches Avenue Park strip and its improvement, and they are now asking that the Council consider a 10 year lease with a 5 year option for this project. Council members establishing that this lease is to cover the center park strip only on Naches Avenue and that the improvement will start with the first two blocks on each side of Yakima Avenue, it was MOVED by Brazier, seconded by Lemon that the Metropolitan Park Board be granted a 10 year lease with a 5 year option to renew and that a resolution and lease be prepared for this grant: carried, Brazier, Larson, Lemon, Munger and Robinson voting aye on roll call. Kurbitz and Lynch absent. This being the time fixed by the Council for the hearing on Petition No. 224 as filed by D. B. Davidson and others requesting the vaction.of a portion of 34th Avenue, and it having been de- termined that none of the petitioners were present, it was MOVED by Robinson, seconded by Munger that the formal motion as prepared by the City Attorney be read and considered: carried, Brazie Larson, Lemon, Munger and Robinson voting aye on roll call. Kurbitz and Lynch absent. ✓It was the MOVED by Robinson, seconded by Munger that the Motion denying a Petition for Vacation of a portion of South 34th Avenue between West Chestnut Street and West Yakima Avenue in the City of Yakima be passed as read: carried, Brazier, Larson, Lemon, Munger arr-I Robinson voting aye on roll call. Kurbitz and Lynch absent. ✓ Mr. Fred Velekanji representing C. A. Royse and his pro- test to the vacation of this street was present at this hearing, but did not speak. Councilmen Lemon and Robinson indicated that- they are against this vacation stating that there are not enough cross streets in this area and that there is not sufficient reason for vacating this street. Petition N ". 233 having been filed- with the City Clerk on November 12, 1963 by Hilp & Rhodes Realty Corporation requesting the improvement of the West Half of South 24th Avenue and the South Half of Nob Hill Boulevard, it was MOVED by Lemon,seconded by Robinson that said petition be referred to the City Manager and staff for study and recommendation: carried, Brazier, Larson, Lemon, Munger and Robinson voting aye by voice vote. Kurbitz and Lynch absent. Moved by Brazier, seconded by Lemon that Resolution No. D =621 establishing the annual irrigation maintenance rates for the year 1964, be passed as read: carried, Brazier, Larson, Lemon, Munger and Robinson voting aye on roll call. Kurbitz and Lynch absent. RESOLUTION NO. D -621, A RESOLUTION establishing the annual irrigation maintenance rates and charges for the year 1964 and providing for a surcharge in certain areas within the City of Yakima. Moved by Lemon, seconded by Munger that .Resolution No. D -622 transferring the sum of $3,200.00 within the 1963 Budget for the Police Department, be passed as read: carried, Brazier, Larson, Lemon, Munger and Robinson voting aye on roll call. Kurbitz and synch absent. RESOLUTION NO. D -6229 A RESOLUTION transferring the sum of $3,200.00 within the 1963 appropria- tion for 21 - Police Department. A letter dated November 7, 1963, having been received from W:..�.M. Foster, District Engineer for the Department of Highways, regarding the existing opening in the fence to allow the temporary connection of East Yakima Avenue as authorized by Resolution No. D -447, it was MOVED by Lemon, seconded by Robinson that action be taken to comply with said letter and close the temporary fence opening: carried, .Brazier, Larson, Lemon, Munger and Robinson voting aye by voice vote. Kurbitz and Lynch absent. In accordance with actions Lken by the- City Council on October 7, 1963 in connection wti th Petitio No. 217 as filed by James E. and Mary L. Baumgardner and requesting the rezone of certain propert located at 3801 Tieton Drive and the Planning Commission now reaffirming its previous recommenda- tion for denial of this application for rezoning, it was MOVED by Robinson, seconded by Munger that December 21 be set a's' t1-n time for a hearing by the. City Council, the matter of the rezone of said property as petitioned by James E. and Mary L. Baumgardner on Petition No. 217, and that the City Clerk give notice of such hearing as required by law. carried, Brazier, Larson, Lemon, Munger and Robinson voting aye by voice vote. Kurbitz and Lynch absent. Th.e Planning Commission reporting on Petition No. 226 as filed by Oscar Larson praying for the annexation of certain property located west of North 46th Avenue and North of Englewood Avenue and recommending the annexation of said property and that it be classified as R -1 single family dwelling upon annexation, it was MOVED by Brazier, seconded by Lemon that this petition for annexation be approved'-as meeting the requirement of law and that the order fixing the date of public hearing for November 25, 1963 be prepared, and the City Clerk give notice bf said hearing by publication and by posting of the property as required by law: carried, Brazier, Larson, Lemon, Munger and Robinson voting aye by voice vote. Kurbitz and Lynch absent. The Planning Commission reporting on Petition No. 232 as filed by the Masonic Temple Association i 1 1 !� I I 1 1 487 NOVEMBER 12, 1963 requesting the rezone of certain property between "Ell and "F" Street and North 4th Street and Naches Avenue, recommending that this property be reclassified from R -3 Multiple Family to B -1 Modified Business, it was MOVED by Brazier, seconded by Munger that December 2, 1963, be set as the time for a hearing by the City Council on the-matter of the rezone of this property and that the City Clerk give notice of such hearing as required by law: carried, Brazier, Larson, Lemon, Munger and Robinson voting aye by voice vote. Kurbitz and Lynch absent. Manager Smith reported that the annual leaf pick up will begin the 18th of this month and con- tinue until December 5, 1963. There being no further business to come before the Council, it was MOVED by Lemon', seconded by Munger that we do now adjourn at the hour of 5:20 P.M.: carried, Brazier, Larson, Lemon, Munger and Robinson voting aye by voice vote.
