HomeMy WebLinkAbout09/16/1963 Business Meetingr SEPTEMBER 16, 1963 Under agenda item "Reports & Communications" the City Clerk called to the attention of the Counc the fact that a Notice of Intention to Commence Annexations Proceedings had been filed by Mr. Oscar Larson, proposing the'annexation of certain property contiguous to the city of Yakima, which property is located West of 46th Avenue and North of Englewood Avenue. It was MOVED by Brazier, seconded by Munger that September 23, 1963 be set as the datefor;'a meeting with Mr. The City Council met -in regular session -, Mayor Larson, Councilman Brazier, Kurbitz, Lemon, Lynch Munger and Robinson, and City Manager Smith and City Attorney Andrews present on roll call. The Invocation was given by Councilman Lynch. The Minutes of the regular meeting of September 9, 1963 were approved as corrected. In accordance with action taken by the Council on June 24, 1963 in the matter of Petition No. 200, as filed by Marguerite and Will Hackett on May 17, 1963 to vacate a certain portion of Hamm Avenue between 17th and 18th Avenue, and Manager Smith having reported to the Council that the petitioners wish to withdraw said petition until a later date, it was MOVED by Brazier, seconded by Lynch that action -on this matter be tabled indefinitely: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger•and Robinson voting aye by voice vote. In accordance with action taken by the City Council on August 19, 1963 in the matter of Petition No. 217 as filed by James E. & Mary,..-L. Baumgardner, to rezone certain property located at 3801 Tieton Drive, from R -1 Single Family Residence, to B -2 Local Business Zone, and Manager Smith reporting to the Council that Mr. Ken Hawkins, attorney representing petitioners, could not be present for hearing on said petition, it was MOVED by Brazier, seconded by Munger that this matter be postponed one week until the next regular meeting of September 23, at 3 p.m.: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger, and Robinson voting aye by voice vote. Mayor Larson requested the clerk to notify all interested persons in the area of the change of date of hearing. Councilman Brazier asked that persons in attendance regarding this rezone be heard. Before calling for an expression from interested incividuals in attendance, Mayor Larson informed them that they are welcome to attend the official hearing on September 23 and may:_gain express their views at that time if they wish. - Mr. Phillip Robillard, Mr. Gedosch and Mr. Flueger all protested to this rezone, stating that it was of no advantage to the city, and that it would create parking problems. PETITION NO. 223 having been filed with the City Clerk on September 13, 1963 by Mrs. Albert A. Kauzlarich and others, requesting an L.I.D. for paving alley between 13th & 14th Avenue from Spruce to Division, it was MOVED by Robinson, seconded by Lemon, that said petition be referred to the City Manager and Staff for Study and Recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson- voting aye by voice vote. PETITION NO.. 224, having been filed with the City Clerk on September 16, 1963 by D. B. Davidson and others requesting the - vacation of existing street right of way on 34th Avenue between Chest- nut and West Yakima Avenue, it was MOVED by Munger, seconded by Lemon that said petition be re- ferred to the City Manager and Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. PETITION NO. 225, having been filed with the City Clerk on-September 15, 1963 by Fred C. & Irene i MdDowell, to rezone certain lots in Block 249; except lots 1, 2, 15 and 16, located between A & B Streets and Third Avenue and 4th Avenue, from R -3 Multiple Family Zone, to B -3, General Business Zone, it was MOVED by Lynch, seconded by Robinson that said petition be referred to the City Manager and Planning Commission for Study and Recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. MOVED'by Lynch, seconded by Lemon that Ordinance No. 461, regulating-fire service water connec- tions; providing for fire service connection charges and amending the water code be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. ORDINANCE NO. 461, an ordinance regulating fire service water connections, providing -for fire service connection charge, and amending Section 7.68.275 of the City of Yakima Municipal Code. MOVED by Robinson , seconded by Munger that Ordinance No. 462,­•repealing the penal code regarding intoxicated persons in public be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. ORDINANCE 462, and ordinance repealing Section 5.44.100 of the City of Yakima Municipal code, and declaring an emergency. In accordance with action taken by the Council on September 9, 1963 in the matter of the condem- nation proceedings of certain property owned by Gordon Spencer on 38th Avenue and Webster, and Manager- -Smith reporting to the Council that the city had reached an amicable agreement with Mr. Spencer regarding the purchase of the property, it was MOVED by•Brazier,.seconded by Munger that _. this matter be tabled: car ied, Brazier, Kurbitz, Larson, Lynch, Lemon, Munger,and Robinson voting aye by voice vote.N7It was then MOVED by Robinson, seconded by Brazier, that the agree- ment for purchase of property be approved, and that the necessary documents be prepared to complete this t ransactionycarried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Manager Smith explained the terms of the agreement and stated the purchase price was approximately $895.00. Mr. Gordon Spencer, in attendance, said the city's offer•was agreable to him as presented. A RESOLUTION adopting the 1964 preliminary budget for the City of Yakima, setting the date of hearing as October 7, 1963 at 3 p.m. for the adoption of the final budget, and directing the City Clerk to give notice of budget proceedings, having been read by the clerk of the Council, it was MOVED by Munger, seconded by Lynch that Resolution No. D -603 be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Manager Smith gave a brief resume of the budget stating that the Council may make any adjustment between various departments and funds, but cannot exceed the approved preliminary budget. With the consent of all Councilmen and Mr. Larson it was agreed that the initial meeting would be held then and there ratherrthan at the later date. Mayor Larson announced that the initial meeting with the initiating party, namely Mr.'Larson, was convened and opened for discussion. Mr. Oscar Larson stating he is willing that the area proposed for annexation assume its share of the City's existing indebtedness, it was than MOVED by Robinson, seconded by Munger that the Annexation Proceedings by Oscar Larson be accepted by the city and that the area proposed for annexation be required to assume its fair share of the city's existing indebtedness; carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Gray & Osborne, Consulting Engineers, having submitted Progress Estimate No. 4 & Semi Final, for 1963 Street Improvement on Lincoln Avenue, in the amount of $6,011.74 to Superior Asphalt & Concrete Co, it was MOVED by Robinson, seconded by Lynch, that said engineers.report dated Seplember 16, 1963 be approved, and payment of same-be authorized;; carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Upon Councilman Munger's request, Public Works Director Mayo informed the Council and the asmmbly that Friday, September 20, 1963 will be the date of enforcement of parking restrictions on Lincoln Avenue. Signs will be erected, and traffic lanes painted. Councilman Lynch referring to Annexation Plans contemplated by the City, stated that progress toward this goal is being hindered by the common practice of extending water sewer hook up service to residence outside the city. He further stated that it had come to his attention that 10.permits had been issued this year and he felt this did not help toward annexation, as once the service is rendered in these areas, residence are not so anxious to annex. He also stated that at the present time, the Planning Director or Building Inspector decides whether this service is to be allowed. This he feels is improper, and suggested that in the future these decisions be made by the - Council. He urged the Council to adopt a atr_,irigent written policy regarding extention of services outside the city. He further suggested that the staff could be of great help in showing residence interested in annexation what procedure to take, stating that he had a call from one party who was interested in annexing but had no idea how to proceed: Councilman Kurbitz disagreed withViynch, stating that if out of-city service is not allowed, residence would install their own system, and it was unlikely that after going to such expense they would be willing to annex. Mayor Larson and Councilman Robinson agreed that appli- cations requesting extention of service should come before the council. However, Robinson stated that once policy is established it should be referred back to the staff. After discussion by the Council, it was MOVED by Lemon, seconded by Brazier that a rigid policy be drawn regarding extention of outside water -sewer hook up service and presented to the council for their considera tion: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz voting. Nay for reasons outlined above. City Manager Smith having recommended to the Council that Mr. A. Robert Williams, an architect with the firm of Doudna,- Williams and Phipps, be appointed to fill the unexpired term of Jim Cowan on the Board of Adjustment, or until November 18, 1965, it was MOVED by Robinson, seconded by Munger that the City Manager's recommendation be accepted; Carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Manager Smith having reported to the Council the need very soon for the financing of projects underway in the design of the expansion sewage treatment facilities, it "was MOVED by Lemon. seconded by Robinson that an ordinance be drawn authorizing -t-he sale of $1, 500,000.00 Water - Sewer Revenue Bonds -,; carried, Brazier, Kurbitz,.Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. MOVED by Robinson, seconded by Lynch that the installation of 35 angles parking spaces on the South side of Webster on 40th-Avenue be approved as outlined by Manager Smith: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Manager Smith stated that this would alleviate some ­bf--,the- ,-parking problem during major, functions at the Stadium and the High School. Mr. Bill Flueger , in the audience, stated that since there would be no parking on the North Side of Webster he was agreable to this recommendation. Mr. Don Gray, Consulting Engineer , Gray & Osborne, presented the Council copies of the Engineer's Water Study. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Brazier, that we do now adjourn at the hour of 10 p.m. carried: Brazier, Larson, Lemon, Kurbits, Lynch, Munger and Robinson voting aye by voice vote. i JOHN M.
