The City Council met in regular session, Mayor Larson, Councilman Brazier, Lemon, Lynch, Munger,
and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Kurbitz absent
and excused.
The Invocation was given by Councilman Lemon.
The Minutes of the Regular Meeting of September 3, 1963 were approved as corrected.
In accordance with action taken by the Council at the regular meeting of September 3, 1963, it
was MOVED by Robinson, seconded.by Munger that Resolution No. D 602 denying a damage claim filed
against the City of Yakima by Carl W. Walker be passed as read: carried, Brazier, Larson, Munger,
and Robinson voting aye; Lynch and Lemon voting nay. Kurbitz absent. Lemon stated it is
possible that there was some-carelessness in the application of the spray, and that the claimtLnt
would not have been able to report the damage within the 90 day limit as he would not have known
about the damage until the grass was planted in the spring. Councilman Lynch felt this was not
and open and shut case, and th,)t the city is morally obligated to -pay the claim. City.
Attorney reaffirmed that the city was not negligent in the application of the sprgy.
RESOLUTION NO. D -602, a resolution denying a damage claim filed against the City of Yakima
by Carl W. Walker.
Judge Mark Fortier being recognized by Mayor Larson requested the Council to approve his pro-
posal by passr,,ge of/Ordinance, providing for a joint City- county driver Educational School
for traffic violators appearing before the courts and other interested persons. Judge Fortier
noted the great need for this type of education because of the increasing number of traffic
accidents in Yakima resulting in many deaths, injuries and economic loss due to the higher in-
surance rates. Judge Fortier stated that some of the details have been worked out, that he has
the assurance of individuals, business, law enforcement men who will contribute their time to
the school. Judge Fortier suggested that a part time person be hired at about $2,,,000 per year
to head this program, however, he said it would not be necessary to appropriate the funds at
this time if not available, that he felt he could solicit fund from interested persons if
necessary. No formal action was taken on this matter.
The Planning Commission having submitted a report recommending the annexation of certain proper-
ty contiguous to the City of Yakima located South of Nob Hill between 24th and 28th Avenue, it
was MOVED by Brazier, seconded by Robinson that Petition No. 222 as filed by E. A. & Elizabeth
Yergen and others, be approved as meeting the requirments of law, that theCity Manager and the
Mayor be authorized to convene a Review Board as required by statute for the hearing and review
of this propose, a xction: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting
aye by voice vot I' t was then/MOVED by Robinson, seconded by Brazier, that the order fixing
date of hearing for September 30, 1963 be accepted as read: carried, Brazier, Larson, Lemon,
Lynch, Munger and Robinson voting aye on roll call. Kurbitz absent.
The City Engineer having submitted the following estimate on work performed on city projects
during the month of August, 1963. .

Under new business, Councilman Brazier suggest that the Council-give thought to the matter of
annexing new areas to the city, that annexation would be a progressive step forward for the
city, that many residence have expressed a desire to be in the city, that he hoped immediate
steps could be taken to make a study of this matter in order that it could be placed on the
ballot in the coming 1964 election. Councilman Lynch concurred with Brazier. Mrs. Dow Lambert)'
st91ted before annexation is considered the present needs of the city should be taken care of,
such as the sewer systems and the blighted areas. Dr. Bittner agreed with Councilman Brazier':
proposal stating that by annexing new areas we could reach the 50,000 population level and this
would be of great advantage to the city. City Manager Smith stated that annexation plans are
needed in order to delineate boundaries and to extend utility lines, that he and the staffwould
be glad to make this study.
Manager Smith having requested permission to initiate condemantion proceedings to expedite the
purchase of certain property owned by Gordon Spencer on 38th Avenue and Webster, it was MOVED
by Brazier, seconded by Munger that a resolution be prepared providing for said ��dction: carried,
Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz absent.
Manager Smith informed the Council that Contractors now working in this area, have been in-
structed not to proceed with the improvement until permission is given.
There being no further business to come before - the Council, it wa's MOVED by Lynch, seconded by
Brazier that we do now adjourn at the hour of 4;50 p.m. carried, Brazier, Larson, Lemon, Lynch,
Munger and Robinson voting aye by voice vote. Kurbitz,at-18,ent.
