Brazier absent and excused. City Attorney Andrews absent and on vacation. The invocation was given by Councilman Kurbitz. The minutes of the regular meeting of July 29, 1963 were approved as corrected. In accordance with action taken by the Council at their regular meeting of July 29, 1963, it was MOVED by Munger, seconded by Robinson that Ordinance No: 45$ amending Ordinance No.. 453 and de- leting certain individual projects from L.I.D. No. 909, be passed as read: carried; Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Brazier absent. - ORDINANCE NO. 4581 AN ORDINANCE amending Section 1 of Ordinance No. 453 of the City of Yakima entitled "AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Improverre nt District, providing for the method of payment thereof, and creating a special fund.." Petition "No. 218 having been filed with the City Clerk on July 29, 1963 by Chas. C. Woerner and others, requesting the formation of a local improvement district for the construction of a side- walk along Spruce Street from South 11th Avenue to South 7th Avenue, it was MOVED by Robinson, seconded by Lynch that said petition be referred to the City Manager and Staff for study and recommendation: carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Brazier absent. Discussion indicated that the Engineering staff will study this matter and make a recommendation as to which side of the street, the sidewalk should be built. Petition No. 219 having been filed with the City Clerk on August 1, 1963 by Frank L. Mooney and others, requesting the formation of a local improvement district for the construction of a sewer in the area Tlyhg-.no'rth of 'IN" Street and Oak Avenue, it was MOVED by Lynch, seconded by Lemon that said petition be referred to the City Manager and staff for study and recommendation: carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Brazier absent. Petition No. 220 having been filed with the City Clerk on August 2, 1963 by Douglas Fellows, requesting that certain Public Utility Easement located in Edgecliff Manor be vacated, it was MOVED by Robinson, seconded by Munger that said petition be referred to the City Manager and staff for study and recommendation and the preparation of the resolution fixing the date for hearing this matter: carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson. .voting aye by voice vote. Brazier absent. In accordance with action taken by the City Council at their regular meeting of July 29, 1963 an ordaincne amending the Traffic Code relating to parking certain hours on Lincoln Avenue was brought on for discussion. Manager Smith having requested that this ordinance be deferred until August 19, 1963 or until .certain data recently gathered can-be completed and evaluated and until the City Attorney and the Director of Public Works return "from their vacations, it was MOVED by Munger, seconded by Lynch that action on said ordinance be postponed until the regular evening meeting of the City Council on August 19, 1963: carried, Kurbitz, Larson, Lemon, Lynch, Munger Robinson voting aye by voice vote. Brazier absent. Councilman Munger indicated that he would b in favor of no parking on Lincoln Avenue. Matters regarding the width of Lincoln Avenue and curb cuts were discussed with Mr. Lane Pratt, Mr. Gray and Mrs. Ebert, property owners on Lincol Avenue. The following -bids having been received and considered by a Bid Board on August 5, 1963: Yakima Cement & Asphalt Paving Co. 164,261.40 Superior Asphalt & Concrete Co. 167,974.25 Bohannon Asphalt Paving, Inc. 168,932.50 for the Tieton Division and Maple Arterial Street improvement, and Manager Smith reporting that I AUGUST 5, 1963 said Board is recommending the bid of Yakima Cement & Asphalt Paving Company as the lowest and best bid, it was.MOVED by Lynch, seconded by Robinson that this bid be awarded to Yakima Cement and Asphalt Company and the City Manager be and is hereby authorized to enter into a contract on behalf of the City of Yakima upon the .filing of the proper bond and insurance by said contractor: carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Mayor Larson announced that he will be attending the American Municipal Association's National Convention for Mayors in Huston Texas and ' will not be attending the next regular meeting of the Council and since Councilman Brazier, who is the AssistantMayor in the absence of the Mayor, will] be absent from the same meeting, it was MOVED by Kurbitz, seconded by Lemon that Councilman Robinsc serve as acting Mayor during the absence of Mayor Larson and Ass'istanrtMayor Brazier: carried, Kurbit Larson, Lemon, Lynch, Munger and Robinson voting aye by voice . vote. ll Councilman Munger, upon request, was informally excused from the next two regular meetings of the Council on August 12th and 19th, 1963. (Manager Smith reported on the selection of Planning Consultants to complete the Comprehensive Plan He related that he and a committee, (Mayor Larson, Councilman George Lemon, James Cowan, Chairman of the Planning Commission and Jary Finley, Planning Director) interviewed three firms and that this committee is unanimous in the selection of Ebasco Service Inc., (Electric Bond and Share) of San Francisco California, as the firm to complete the Comprehensive Plan. He further related that this firm is presently working on a planning project for Benton County and have previously complet- ed a downtown study for the City of Spokane. He stated that Mr. Charles Cavanaugh will be the project director and since he will be in the area soon, meetings will be arranged with him. He outlined 'procedure stating that if the Council approves this recommendation, notice of this action will be sent to the State Department of Commerce and Economic Development which will then enter into a contract with the consulting firm. He also reported that the first Project, Population Forecast and Land Use Survey, has been completed and that the Consultirg Firm will complete the second 701 project, the Comprehensive Plan, which has already been ap roved, and which will incluab the use of the Planning Department Staff and will require,..payment of 9306.00 as a project inspec- tion fee. He also advised that payments to the consulting firm will be made from funds already allocated by the Housing and Home Finance Agency to match the City's contribution of staff service; n I. He also indicated that the Comprehensive Plan will be completed within eight to ten months. After due consideration and discussion, it was MOVED by Robinson, seconded by Lynch-that Manager Smith's recommendations be approved and that negotiations be continued to obtain the services of Ebasco Service, Inc., to complete the Comprehensive Plan for the 6ity of Yakima: carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Manager Smith; requested authorization to send Sergeant Pinell to a Juvenille Court Institute to be held August 11 throu,ght 16 in Eugene Oregon and estimated his expenses to be $130.00. It was MOVED by Robinson, seconded by Munger that Sergeant Pinell be allowed to attend said confer- ence and that his expenses be paid: carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Brazier, absent. Manager Smith also requested that permission be granted to send Police Captain Madden to a Safe Burglary Conference to be held September 24 through 27, in Portland Oregon and estimated his ex- penses to be $60.00. It was MOVED by Kurbitz, seconded by Robinson that Captain Madden be allow- ed to attend said conference and that his expenses be paid: carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Brazier absent. The matter of,the Comprehensive Plan not covering in detail, the study of the Downtown Business District was discussed with Dr. Bittner, Chairman of the Downtown Development Association. Manager Smith explained that the Comprehensive Plan does not include a detailed study of the downtown area but includes it in the general plan of the whole city. He explained further that to obtain such a study of the downtown area will cost some $30,000. to $35,000. and is a seperate project which could be carried on simultaneously with the Comprehensive Plan. Dr. Bittner ex- pressed suprise and disappointment that the basic plan will not include a detailed study of the downtown area and indicated that the study of the Central Business District should be the heart of the Comprehensive Plan. He further indicated that information regarding location of off - street parking, traffic patterns, width of streets, modernization and improvement of pedestrian traffic could be determined from this study. The matter of using federal funds for this study was then introduced into the discussion and Councilmen Kurbitz and Lemon protested the use of such funds for this purpose. Councilman Lynch indicated that he is not for the use of federal funds in all projects, but that there is no otheresource for this .study. Councilman Robinson pointed out that it is not feasible to do any part of this study with City funds and unless federal money is used the problem must be left to the people in the Central Business District. Mayor Larson indicated that those who oppose the use of Federal Funds, should now come forth with their money and further pointed out that Federal Funds have been made available and therefore they should be used. Manag( Smith having suggested that Council members meet with the Consultants when they arrive next week, it was MOVED by Munger, seconded by Lynch that the matter of the study of t1le Central Business District along with the Comprehensive Plan, be referred to the City Manager and staff for study 'and recommendation: carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Brazier absent. Manager Smith advised that final approval has been received from the Department of Health Educa- tion and Welfare on the 30% of the total project cost for the expansion of the sewage systems. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Lynch that we do now adjourn at the hour of 5:00 P.M: carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye `by voice vote.
