JULY 292 1963 The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lemoh, Lynch and Robinson and City Manager Smith present on roll call. Councilman Munger absent and excused. City Attorney Andrews absent and on vacation. The invocation was given by Councilman Lemon. The minutes of the regular meeting of July 29, 1963 were approved as corrected. An ordinance appropriating $19,583.00 to the 1963 Budget for the Municipal Garbage Department, having been read in its entirety at the regular meeting of July 22, 1963,. was read by title only at this meeting and it was MOVED by Lemon, seconded by Robinson that Ordinance No. 457 providing for said appropriation,be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye on roll call. Munger absent. Manager smith and Public Works Director Mayo reviewed information regarding this transaction and added that no trade�in is figured in the purchase price since it is•believed that we can do better by turning the matter of selling the old equipment over to the City Purchasing Agent who may be able to arrange a sale to a smaller community. Mr. Mayo stated that, with this equipment, the department will be operating with new equipment on five routes, that these packers are being purchased at -the same price as the ones purchased in 1962, that the price of this equipment is scheduled to raise in October of this yea] that the life of these trucks is from 5 to 7 years and that it is hoped that an accumulative reserve fund can be established for the purpose of replacing,old and troublesome equipment on a 2 year cycle and for the purchase of future landfill and disposal sites for this department. ORDINANCE NO. 457, AN ORDINANCE appropriating the sum of $19,583.00 from the unappropriated money in the Municipal Garbage Fund to Account 6 -40, Machinery and Equipment, of the Capital or Betterment classification of the 1963 appropriation for 32 - Municipal Garbage Department. This being the time originally fixed by the City Council for the hearing on the Appeal from the Planning Commissions decision with regard to the rezoning of the Woodrow Edinger property locate at Baker Street and 12th Avenue, Mayor Larson called to the attention of those present that, at the regular meeting of the Council on July 22, 1963, action was taken to re- notice this matter and fixed the date of hearing for August 19, 1963. It having been determined that there were no persons present wishing to be heard on this matter and the Council wishing to further secure the changing of the date for hearing, it was MOVED by Robinson, seconded by Lemon that this matter be continued to August 19, 1963: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye- by voice vote. Munger absent. Petition No. 217 having been filed with the City Clerk on July 26, 1963 by James E. Baumgardner requesting the rezoning of property located at 3801 Tieton Drive, it was MOVED by Lynch, seconded by Lemon that said petition be referred to the Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye by voice vote. Munger absent. An ordinance relating to traffic control and providing for certain time limitations for parking on Lincoln Avenue between 5th and 16th Avenues, _having _been submitted to the Council for con- sideration and Council members expressing the desire to study this matter further, it was MOVED by Robinson, seconded by Lynch that this ordinance be postppned- for one week or until the next regular meeting of the Council on August 5, 1963: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, and Robinson voting aye by voice vote. Munger absent. Mrs. Dorothy Ebert, daughter of the owner of Anderson's Cash Grocery, 1212 Lincoln Avenue, being present, protested the fixing of "No parking" hours between 7 and 9 A.M. stating that stock deliveries for the store are made at 7:30 A.M. and since there is no off street parking available, deliveries could not be made until after 9:00 A.M. which would interfere with scheduled deliveries and their early morning trade. She further related that attempts have been made to purchase the vacant lot adjacent to the store from Mrs.-Ng, ud�e Cahoon, without success. Councilman Robinson also indicated that the matter of thdse .regul'ations:-.being' in--f'orce .on Saturday, Sunday and Holidays should be considered. Moved by Robinson, seconded by Lemon that Resolution No. D -585 transferring $12,417.00 in the 1963 Budget for the Municipal Garbage Department to complete the purchase of two new Garbage packer trucks, be-passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye on roll call. Munger absent. RESOLUTION NO. D -5851 A RESOLUTION transferring the sum of $12,417.00 within the 1963 appropriat "on, for 32 - Municipal Garbage Department. The 6ity Engineer having submitted the following summation of :the. percentage : of protests 'received to date on the proposed street improvement projects included in local improvement district No. 909 , South 38th Avenue, 40th Avenue and Various Others ": 1. South 38th Avenue from Tieton Drive to Nob Hill Boulevard 76.9% la. South 38th Avenue from Tieton Drive to Webster Avenue 21.9% lb. South 38th Avenue from Webster Avenue to Nob Hill Boulevard 81.9% 2. Meadow Lane from 38th Avenue to 40th Avenue 30.6% 3. Webster Avenue from 38th Avenue to 40th Avenue 39.9% 4. Bell Avenue from 40th Avenue to a point 2851ft. West thereof. 30.2% 5. West Walnut Street from Westover Drive to Glenn Drive 55.4% / 5a. West Walnut Street from Westover Drive to 40th Avenue - 0 - 5b. West Walnut Street from 40th Avenue to Glenn Drive 55.4% 6. Frances Avenue from Walnut Street to a point 232 ft. South thereof - 0 - 7. Knobel Avenue from 40th Avenut to a point 380 ft East thereof 93.9% 8. East "I" Street from North 4th Street to North 6th Street. 75.9% 9. 40th Avenue from Lincoln Avenue to Nob Hill Boulevard 10.7% 10. South 31st Avenue from Nob Hill Boulevard to a point 635 ft-S. thereof - 0 - 11. Plath Avenue from 16th Avene u to 18th Avenue 27.6% and after due consideration and discussion with Public Works Director John Mayo, it was.MOVED by Robinson, seconded by Lynch that projects 1, South 38th Avenue from Tieton Drive to Nob Hill Boulevard, lb, South 38th Avenue from Webster'Avenue to Nob Hill Boulevard, 5, West Walnut Street from Westover Drive to Glenn Drive and 5b, West Walnut Street from 40th Avenue to Glenn Drive be, deleted from L.I.D. No. 909 and the staff be and is hereby directed to prepare an ordinance amending Ordinance No. 453 and providing for said deletions: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye by voice vote. Munger absent. Ar. Bill Fluegge, property owner on Webster Avenue and Meadow Lane inquired as to the finishing date of these streets I F, 454 JULY 29, 1963 stating that the dust is bad. John Mayo, explained that bids will be called for the later part of August further explaining that the local contractors have all the work they can handle at this time, but that it will take very little time to complete after thetids_ are let. Mr. Jack Geoghegan property owner on 38th Avenue asked if residents on this street could oil the road to keep the dust down. Mr. Geoghegan was cautioned against putting too much oil on at one time. Councilman Brazier asked if something can be done to repair the rear entrance of West Park from Snow Mountain Road. Public Works birector Mayo advised that this will be patched and that irrigation water is causing the trouble Councilman Brazier, upon request, was informally excused from the next two regular meetings of the Council on August 5th and 12th, 1963. Councilman Lemon brought on for discussion the matter of Mrs. George Timpke's property at 1009 Spruce Street and was advised that Mr. Foster, District Engineer for the State Highway has been contacted on this matter and a report will be made by that department. Manager `'mith reported that Mr. James D. Cowan has submitted his resignation from.the Board of Adjustment since he is now Chairman of the Planning 6ommission. Manager Smith also reported that he will have a recommendation to submit to the Council in the near future, on a firm to complete the Comprehensive Plan. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Brazier that we do now adjou rn.at the hour of 4:20 P.M: carried, Brazier, Kurbitz,.Larson, Lemon; Lynch and Robinson voting aye by voice vote.
