HomeMy WebLinkAbout07/22/1963 Business MeetingJ 1 1 451 JULY 22, 1963 The City Council met in regular session Mayor Larson, Councilmen Brazier, Kurbitz, Lemon, Lynch Munger and Robinson and Acting City Manager Andrews present on roll call. City Manager /absent and on vacation. Smith . The invocation was given by Councilman Munger. The minutes of the regular meeting of July 15, 1963 were approved as read. In accordance with action taken by the City Council at�their regular meeting of.July 15, 1963, it was MOVED by Lemon , seconded by Lynch that Resolution No. D -53$ authorizing the execution of an agreement with the Nob Hill. Water Company to transfer 20 of its customers along 40th Avenue between Summitview Avenue and Lincoln Avenue from the Nob Hill Water Company to the City of Yakima, be passed as read: carried, Brazier,.Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Acting City Manager Andrews explained that the staff has met with Mr. Ed Wascher, Manager of the Nob Hill Water Company and Mr. Leo Kendrick., attorney for said compan and that it is now learned that there are only 20 customers to be transferred instead of 22 as previously reported and that, of this number,.-15 have given consent to the transfer and that it will take a little longer to get the consent of the other five as some are out of town. He also indicated that 6ne_of--the five-. is questionable as to his giving consent and upon inquiry by the Council,Mr. Andrews further indicated that the-Nob Hill Water Company will have to make any de- cision to be made if one or more of these people refuse to give their consent. The Council requested that Mr. Andrews write a letter to the Nob Hill Water Company.advising them that this transaction is in no way to be interperted as setting a precedent for future transfers. RESOLUTION NO. D -5$3 A RESOLUTION authorizing and directing the City Manager and the City Clerk to execute an Agreement with Nob Hill Water Company., Petition No. 216 having been filed with the City Clerk on July 17, 1963 by Earl Vadnais and oth requesting the formation of a local improvement district for the paving of the Alley in Block 354, Capitol Addition between 8th and 9th Avenues and Spruce and Pine Streets, it was MOVED by Robinson, seconded by Munger that said petition be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. An ordinance appropriating the sum of $19,5$3.00 to the 1963 Budget for the Municipal Garbage Fund for the-purchase of two additional packer trucks, was read in its entirety at this meeting and ordered laid on the table for one week or until the next regular meeting of the Council on July-. ; 29, 1963. John Mayo, Director of Public Works explained that this appropriation together with a-transfer of funds from the salary and wage category, which will be forth coming for Council consideration at the next meeting, will buy these two packers and will enable this de- partment to cut out two routes thus operating with 6 routes instead of eight. In answer to Mr. Walt Phillip's question as to whether the public can look forward to a reduction in garbage charges, Mr. Mayo advised that this matter would have to be decided by the Council but that we are now.in a position to build.a reserve to purchase more land for land fill and disposal sites and to replace old equipment which is costing too much to operate. Moved by Munger, seconded by Brazier that Resolution No. D -5$4 authorizing the City of Yakima to purchase real property for street right -of -way to allow the widening of 40th Avenue, be passe( as read: carried, Brazier, Kurbitz, Larson and Robinson voting aye on roll call. Lemon, Lynch and Munger voting nay. In discussing this matter, Councilmen Brazier, Lemon, Lynch and Munger protested the price asked for this property. Councilman Lynch su g ested that $1500.00 to $2000.( is enough to pay for the property and Councilman Munger suggested 2700.00 as a fair price. Mr. Gordon Hanson, attorney for Mrs. Alberta Spracher and Mr. Glen StZader, the property owners, ex- plained that his client has based her price on $1300.00 for the 30 foot strip of property and further explained that there are some $2 Bartlett Pear trees to be removed which will average $ boxes of fruit to the tree and that there are prospects for $100.00 per ton pears this year. He also reminded the Council that the Contractor who is constructing 40th Avenue, entered upon this property and took out some 30 to 40 trees before these negotiations have been completed. He stated that his clients first offer was that the property would be deeded to the City if the property were rezoned for business and if the L.I.D. assessment would be waived. Councilman Lynch and Brazier protested this type bargining. G.ouncilman Robinson explained with regard to the price, that this is pear orchard now but if it were subdivided the value would increase. He also explained that the fact that the property owner has a claim for damaged trees, asuit for damages does not constitue a purchase of the property and therefore after the damages have been satisfied,the property, perhaps, could be bought for a cheaper price, but while this method would appear cheaper, the construction of 40th Avenue would be delayed and in the long run cost the City more. Councilman Lemon suggested that this matter be continued and an independent appraiser hired to appraise the property in question. Mr. Hanson and Mr. Mayo indicated that the price of $4,250.00 is the only price the property owner will accept. Councilman Brazier explain- ed that he is voting for the resolution only because of the importance of completing 40th Avenue and requested the staff to have their easements in the future, before improvement projects are started. RESOLUTION NO. D -5$41 A RESOLUTION authorizing and directing the City Manager of the City of Yakima to purchase real property for street right -of -way. An appeal from the Planning Commission's decision in the matter of the rezoning of certain property located at 201 Hall Avenue as requested by Michael A. Polo, having been filed with the City Clerk on July 16, 1963, it was MOVED by Robinson seconded by Brazier that this matter be heard by the City Council at their regular meeting of August 5, 1963 and due notice by publica- tion and to interested persons be given: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Acting City Manager Andrews reported later in this meeting that, in the matter of the Council's hearing on the Woodrow Edinger's appeal from the Planning Commission's decision, he has been advised that Mr. Dick Smith, attorney for Mr. Edinger, will be out of town on July 29, 1963, the date fixed by ,Council action for this hearing. After due consideration by the Council and Councilman Kurbitz having suggested that these matters be heard at the regular evening meeting, it was MOVED by Robinson, seconded by Brazier that re- notice be given by publication and to interested parties and that the matter of the Woodrow Edinger Appeal be heard on August 19, 1963 ,instead' of.,July: ;- 29..;. 1963 as,_previously ordered by the Council: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Rovinson voting aye by voice vote. It was then MOVED by Robinson, seconded by Brazier that the matter of the date for the hearing on the Michael polo matter be reconsidered: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. It was then MOVED by Robinson, seconded by Brazier that the date for the hearing on the matter of the appeal by Michael Polo be changed from August 5, 1963 as fixed r 452 JULY 22, 1963 earlier in this meeting, to'August 19, 1963: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Mrs. Everett Dickerman, property owner on Webster Avenue, being present at this meeting and in- quiring as to the protests filed against the improvement of a8th Avenue, 40th Avenue and Webster, was advised that a full report on the protests filed against the individual improvements as pro- vided for in L.I.D. No. 909 will be given-at the regular meeting of the Council on . +.July_, 29, 1963 and that Wednesday the-24th day of July is the last day for filing such protests. Mrs. Dickerman indicated that those persons occupying residences on Webster AVenuv are most interested in having this improvement. Mr. Walter Phillips, 3 North 40th Avenue, brought on for discussiQ)n the matter of numbering house in the City of Yakima and protested the numbering system being proposed by the staff. Mr. Mayo explained the existing problem between 36th Avenue and 41st Avenue between Chestnut and Barge stating that since Yakima Avenue does not extend through this area making the dividing line be- tween the north and,south, two houses cloSetogether will have the same number. Councilmen Lynch and Brazier recommended.that this matter be referred to the Planning Commission. It was MOVED by Robinson, seconded by Munger that this matter be laid on the table: carried, Brazier, Kurbitz Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Council cautioned the staff not to jump into this matter without careful consideration. Councilman Munger, upon request, was informally excused from the next regular meeting of the City Council on July 29, 1963. T.herebeing- no further business to come before the Council, it was MUVED by Kurbitz, seconded by Bra'zier,that we do now adjourn at the hour of 4:40 P.M., carried, Brazier, Kurbitz, Larson, Lemon Lynch, Munger and Robinson voting aye by voice vote.
