The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lemon, Lynch
and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman
Mungir absent and excused.
The invocation was given by Councilman Lynch.
The minutes of the regular meeting of July 1, 1963, were approved as corrected.
Moved by Robinson, seconded by Lemon that Resolutions No. D -575 transferring the sum of $2,500.00
within the 1963 appropriation for the Police Department, be passed as read: carried, Brazier,
Kurbitz, Larson, Lemon, Lynch and Robinson voting aye on roll call. Munger absent. Manager
Manager Smith explained that this action is recommended in order that a 1961 model police car,
which is out of service at the present time because it is not in running condition, can be re-
placed., He further explained that a complete overhaul will cost some $350.00 to $500.00 and if
the car is retained until 1964 the depreciation will be some $300.00. He also explained that
the money being transferred from salaries and wages is an overage in the sergeants classification
that a new sergeant was budgeted for January 1, 1963 and the examinations were not completed
until June, thereby creating a surplus.
RESOLUTION NO. D -5751 A RESOLUTION transferring the sum of $p2,500.00 with the 1963 appropriation
for 21 - Police Department.
Moved by Lynch, seconded by Lemon that Resolution No. D -576 authorizing an extension of time for
completion of performance of engineering services consisting of an investigation and.study of the
water system of the City of Yakima as provided for in -an agreement with Gray and Osborne dated
December 4, 1962, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and
Robinson voting aye on roll call. Munger absent. Manager Smith read a letter from Gray and
Osborne, consulting engineers, requesting the extension of time and stating that certain phases
of the work are taking more time than anticipated. Mr. Smith explained that he had met with Mr.
Don Gray and after dissussion of the matter with him, he is recommending that the extension be
granted since there will be no additional cost and we will have a better report. Councilman
Robinson and Councilman Kurbitz indicated that a request of this nature should be made before the
deadline of the original contract is reached.

The Planning Director having submitted information to the Council stating that the Planning
Commission has denied the request for rezoning certain properties as set forth on Petition No.
201 as filed by Ronald W. Poole, Petition No. 206 as filed by W. H. Snyder, Petition No -212 as
filed by Woodrow Edinger and Petition No. 213 as filed by Michael A. Polo, it was MOVED by
Robinson,seconded by Lemon that said information be received and filed: carried, Brazier, Kurbi
Larson, Lemon, Lynch and Robinson voting aye by voice vote. Munger absent. Discussion pointed
out that this decision is final unless the petitioner files, within 14 days from the date of
notification, an appeal.to be heard by the City Council.
Mr. Wayne Leonard, 811 South 7th Avenue being present at this meeting, discussed with members
of the Council, the problem of the unsatisfactory storm drain facility in his area and the
problems caused by heavy rains such as were experienced on Sunday July 7, 1963. He protested
the service given by the City since he was one of the first to call for help. Discussion of
this problem pointed out that there were greater emergencies in the Central Business Area which
had to be secured before the crews could get to Mr. Leonard, but that he did get one load of
gravel. John Mayo, Public Works Director, explained some of th-e causes for the trouble in this
area and indicated that certain improvements are included in the Bond Issue Improvements.
Manager Smith read a letter from the Metropolitan Park Board protesting the improvement of 38th,
40th and Webster Avenues, as provided for in L.I.D. No. 909, stating that they are not opposed.
to the improvement but that they do not have funds with which they can assume their proportionat
share of the cost: Mr. Edl Putnam, Metropolitan Park Director explained that a special levie
will be needed for maintenance and operation of the parks and. suggested that the City assume thi
responsibility.
Mrs. Timpke, property owner at 1009 East Spruce, having requested help with a drainage problem
at the. regular meeting of the Council on July 1, explained at this meeting that due to the storm
on Sunday, water has spread throughout her basement. It was again suggested that an open trench.
drain be built on her property to carry the water away and the staff again assured Mrs. Timpke
that they would keep working on the problem.
Councilman Kurbitz requested information regarding the Huza matter and its relation to the budge
about to be* prepared for 1964. City Attorney Andrews Vt��� Aed that it is not known what pro-
cedure will have to be taken in this matter, since no /or rs have been received from the Judge.
Councilman Brazier indicated that he hopes that the Business and Occupational Tax on Utilities
can be eliminated entirely in the preparation of the 1964 budget. Councilman Kurbitz suggested
that perhaps if the Council indicated that this tax is to be decreased for the second year in a.
row, the petitioners would drop their request to vote on the matter. Mayor Larson and Council-
man Lynch expressed belief that if the citizens understood the financial situation and knew of
the services which will have to be curtailed as the result of the loss of funds, they would
ap-orove the tax. No formal action was taken on this matter at this time.
