The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lemon, Munger
and Robinson, City Manager smith and City Attorney Andrews present on roll call. Lynch absent
and excused.
The invocation was given by Councilman Kurbitz.
The minutes of the regular meeting of June 17, 1963 were approved as read.
This being the time fixed by the Council for the further consideration of the matter of payment
of $64.84 for damages sustained to Mrs. Jack D. Kendall's car, and it having been determined that
the City is responsible in this matter, it was MOVED by Lemon, seconded by Kurbitz that Resolu-
tion No. D -572 authorizing the payment of $64.84 to Mrs. Kendall, be passed as read: carried,
Brazier, Kurbitz, Larson, Lemon, Munger and Robinson voting aye on roll call.
RESOLUTION NO. D -5729 A RESOLUTION authorizing the payment of $64.84 to Mrs. Jack D. Kendall.
This being the time fixed for the hearing on Resolution No. D -564 being a resolution of intention
to improve certain streets by surfacing and constructing curbs and gutters, and there being
persons present to be heard on these matters, it was MOVED by Robinson, seconded by Munger that
the ordinance providing for these improvements and creating a local improvement district, be
passed as read. Discussion was opened by John Mayo, Public Works Director who explained that
from the written protests already filed, it has been determined that item 8 of this ordinance
providing for.the improvement of East "I" Street should be deleted. It was MOVED by Brazier,
seconded by Robinson that Item 8 East "I" Street f ro m North 4th Street to North 6th Street, be
deleted from the ordinance as read: carried, Brazier, Kurbitz, Larson, Lemon, Munger and
Robinson voting aye by voice vote. Lynch-absent. Mayor Larson then explained that all protests
must be filed in writing and opened the meeting to discussion and the hearing of verbal protests.
Mr. Jack Geoghegan, Mr. N. S. Norris, Frank Glaspey, Jr., _ dr., and Lee Campbell
of Glascam Euilders Inc., Mrs. A. G. Beaman, Mrs. Lee R.'Beaman, protested the costs and plans
for Items 1, 2, and 3, South 38th Avenue, Meadow Lane and Webster Lane respectively. Public
Work's Director Mayo explained to Mr. Glaspey the allowances being made for the �%U rk this firm
has done in developing property south of ' Nob Hill Boulevard and after consideration, Mr. Campbell
and Mr. Glaspey indicated that they would go along with this improvement. Mrs. A. G. Beaman
asked for curbs only, on Meadow Lane and Mrs. Lee Beaman protested Webster being made a half street
Item No. 4, Bell Avenue was protested by Mr. Ben Mumaw who considers the benefits too little for
the cost. Item No. 5, West Walnut'Street was ,protested by Mrs. L. H. Amende', Howard Hettinger,
attorney representing Mr. Ray C. Hayes, on matters of cost. Item No. 9 was protested by Carl Loy
attorney-representing 7'property owners who are asking for a narrower street than planned. Mr.
Mayo explained that 40th Avenue is planed as a community arterial and that Gas Tax money will
be used to pay part of this improvement, predicated on a 44' street and 5 foot sidewalk on one
side of the street. He further explained that it would be necessary to seek new approval on a
narrower street and would not be able to include this improvement in this district at this time.
Item 10, South 31st Avenue, Mr. Paul Goode, attorney representing Miss Bernice Wetzel inquired
as to the City's plans for acquiring the necessary easement from the Wetzel property. E. R.
Stevenson, Sig Carlson, Ralph Hinkley, Mrs. Palmer, Don Tunstall.,,-attorney representing A. C.
Shelton made inquiries on construction and widths of streets and did-,not necessaryily protest any
items in this ordinance at this time. The office engineer having computed the percentages of
protests on the individual projects, John Maio reported that 22% protest is now on file on Item
1; 23.5% on items 2 and 3; 19.44% on items 4,5 and 6 with 32.5% of this protest being directed to
item 5; 14.7% on the assessment roll for item 9.being only 4% protest on the total project; no
protest to item 10 and 27.6% protest on item 11. Mr. Ed Putnam, Directorsof Parks advised the
Council that the Metropolitan Park Board has not met to make their decision on the improvements
involving their property. All person having been heard both for and against these improvements
and the Public Work's Director having recommended the deletion of item 7, Knobel Avenue, it was
MOVED by Brazier, seconded by Lemon that item 7, Knobel Avenue from North 40th Avenue to a
point 380 feet East thereof, be deleted from the ordinance as read carried, Brazier, Kurbitz,
Larson, Lemon, Munger and Robinson voting aye by voice vote. Lynch absent. Mayor Larson then
called for a roll call vote on the original motion to pass Ordinance No. 453 as read and deleting
items 7 and 8 in accordance with Council action_. Said motion carried, Kurbitz, Larson, Munger
and Robinson voting aye on roll call. Brazier and Lemon voting nay on roll call. Lynch absent.
,Councilman :Brazier stated that he is 100% in favor of the 40th Avenue_ improvement but he does
not -feel that he is Irepared to vote on some of the other items included in. this ordinance.
Discussion on matters herein described also pointed out that protests to all or any of these
projects may be filed with 30 days and further consideration will be given them at the end of
that time. Also the Engineers letter, setting forth the total cost .and expense of this improvement
is estimated at $270*,578.68 of which amount, it is estimated that $14.5,564.73 is to be borne by
assessments'against the properties within the proposed district and the balance of $125,013.95 is
to be borne by the Arterial Street Fund, and listing the outstanding and unpaid Local Improvement

ORDINANCE NO. 453, AN ORDINANCE providing for the improvement of certain property by grading,
ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutter, together
with the necessary drainage features; establishing a Local Improvement District, providing for
the method of payment thereof, and creating a special fund.
This being the time fixed for the hearing on Petition No. 194 and. Resolution No. D -566 being a
resolution of intention'to improve certain property in Sutor Addition by constructing Water Mains
and other appurtenances, and there being no protests in writing or otherwise, it was MOVED by
Munger, seconded by Lemon that Ordinance No. 454 providing for said improvement and creating
L.i.D. No. 910 , be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Munger and Robinso
voting aye on rollscall. Lynch absent.
ORDINANCE NO. 454, AN ORDINANCE providing for the improvement of certain property by construct-
ing the necessary mains, fire hydrgnts, valves and other appurtenances for the purp:o:se of supply-
ing water :5r domestic use and fire protection; establishing a Local Improvement District, pro-
viding for the method of payment thereof, and creating a special fund.
This being the time fixed -for the hearing on Petition No. 200 as filed by Marguerite and Will
Hackett requesting the vacation of`a portion of Hamm Avenue and Mr. Al Krage, 1114 South 17th
Avenue being present,protested this action since his property extends through to 18th Avenue and
will become landlocked if Hamm Avenue is vacated and no provision is made to develope 18th Avenue
Mr. Finley, Planning Director, explained that, to develope this property, it must, according to
code,,-front on a public street and suggested that this could be done by leaving Hamm Avenue as
it is and constructing 18th Avenue through to Stone or by developing 18th Avenue through from
Nob Hill Boulevard to Stone. Mr. Bud Applegate, attorney representing the Hackett's explained
that 18th Avenue, if constructed from Nob Hill to Stone, will run through buildings do the
Hackett property. Miss Hackett having explained that they are leaving on an extended vacation

and the Council desiring more time to consider this matter, it was MOVED by Robinson, seconded by
Lemon that this hearing be continued until the regular evening meeting of the City Council to be
held on September 16,•1963: carried, Brazier, Kurbitz, Larson, Lemon, Munger and Robinson voting
aye by voice vote. Lynch absnt.
Petition No. 210 having been filed with the City Clerk on June 19, 1963 by Marvin D. Leingang and
others requesting the formation of a Local Improvement District for the construction of curbs and
gutters and the surfacing of Queen Avenue from Meade Avenue to King Street, it was MOVED by
Brazier, seconded by Munger that said petition be referred to the City Manager and staff for stud
and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Munger and Robinson voting aye by
voice vote. Lynch absent.
Petition No. 211 having been filed with the City Clerk on June 21, 1963 by Lawrence R. Cyr and
others requesting the formation of a Local Improvement District for the construction of curbs and
gutters and the surfacing of Prasch Avenue from 12th Avenue to Queen Avenue, it was MOVED by
Brazier, sec nded by Munger that said petition be referred to the City Manager and Staff for stud
and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Munger and Robinson voting aye by
voice vote. Lynch absent.
Petition No. 212 having been fil..ed with the City Clerk on June 21, 1963 by Woodrow Edinger and
others requesting the rezoning of certain property situated at the northeast corner of the inter-
section of Baker Street and 12th Avenue, it was MOVED by Brazier, seconded by Munger that said
petition be referred to the-Planning Commission for study and recommendation: carried, Brazier,
Kurbitz, Larson, Lemon, Munger and Robinson voting aye 'by voice vote. Lynch absent.
Petition No. 213 having been filed with the City Clerk on June 21, 1963 by Michael A. Polo reques
ing the rezoning of certain property situated at 201 Hall Avenue, it was MOVED by Brazier, second

Moved by Munger, seconded by Robinson that Resolution No. D -573 providing for the transfer of
$2,236.00 within the 1963 Budget for the City Garage, be passed as read: carried, Brazier, Kurbi

The City Engineer having submitted the final estimate for work performed on the Washington Avenue
Interceptor Sewer by John B. Knowles, contractor, it was MOVED by Lemon, seconded by Munger that
said i7,60rt dated June 24, 1963, be approved and that this project be and is hereby officially
accented as being satisfactorily completed and that payment of the final estimate in the amount
of $26,521.47 be and is hereby authorized: carried, Brazier, Kurbitz, Larson, Lemon, Munger and
Robinson voting aye by voice vote. Lynch absent.
Oity Manager Smith reported on the 5th lane for traffic on South 1st Street between Pacific and
Lenox Avenues stating that on street parking will be removed from lst street in this area to give
the necessary space for the new lane and explained thatihe State Highway is paving thin area and
it will be ready for re- striping Thursday or Friday of this week and requested the Council's
a- proval and authorization for the Street Department to go ahead with the striping. It was

These minutes ordered corrected the Council on July 1, 1963, upon the request of Councilman
Kurbitz:
Councilman Kurbitz inquired regarding a petition requesting the improvement of 38th Avenue
and Mr. Mayo, Public Works Director, explained that a petition was taken out of his office
for signing, covering this improvement, but that it has not been returned. Councilman
Kurbitz stated that he is neither for or against the matter, but a policy is being establist
ed whereby an improvement can be iniated without petition and expressed approval of such
a precedent.
