JUNE 10, 1963
The City Council met in regular session, Mayor Larson, Councilmen Brazier, Lemon, Lynch, Munger
and Robinson, City Manager Smith and City Attorney Andrews present on roll call.
The invocation was given by Councilman Brazier.
The minutes of the regular meeting of June 3, 1963 were approved as read.
Petition No. 207 having been filed with the City Clerk on the :..5th day of June:.1963 by Anna Petti-
grew and others, requesting the formation of a local improvement district for the construction of
an irrigation system for the Cottage Hill Pi e Line which takes its water from the Cowiche - Naches
Irrigation Canal at Park Avenue (19th Avenue) and runs down back of Monroe Avenue and down Folsom
Avenue terminating above the Starliter Garden Apartments, it was MOWED by Robinson, seconded by
Munger that,said petition be referred to the City Manager and Staff for study and recommendation:
carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.
Petition No. 20$ having been filed with the City Clerk on the 6th day of June, 1963 by William H.
Wilson, requesting the paving of the alley on the East side of Hall Avenue between Yakima Avenue
and "A" Street, it was MOVED by Munger, seconded by Lemon that said petition be referred to the
City Manager and Staff for study and recommendation: carried, Brazier, Kurbitz, Larson, Lemon,
Lynch, Munger and Robinson voting aye by voice vote.
Petition No. 209 having been filed with the City Clerk on the 7th day of June 1963 by Wm. R.
Ebeling and others requesting the formation of a local Improvement district for the paving of the
alley between Hall Avenue and Chicago Avenue from Yakima Avenue to "AI' Street, it was MOVED by
Munger, seconded by Lynch that said petition be referred to the City Manager and staff for study
and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting
aye by voice vote.
Moved by Robinson, seconded by Munger that Resolution No. D -569 authorizing the hiring and paying
not to exceed $13001:00 for services, without calling for bids and amending Resolution No. D -521,
be passed as read: carried -, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting
aye on roll call. Discussion of this matter pointed out that Resolution No.-D -521 had authorized
the expenditure of $800.00 for laboratory tests known as a McElroy Analysis of the water system
of the City of Yakima and that charges for these tests are computed on an hourly basis. Public
Works Director Mayo explained that after starting the tests,the Consulting Engineers, Gray and
(Osborne, needed more information thus taking more time and making the tests cost more. Councilmen
Robinson and Lynch suggested that, in these matter, it would be better to fix the estimates higher
to begin with. Mr. Mayo also discussed some.of the additional problems and advised that a full
report of the information received as the result of the tests is on file in his office.
RESOLUTION NO. D -5691 A RESOLUTION authorizing the City Manager to hire and pay for services
without calling for bids, and amending Resolution No. D -521.
Moved by Lynch, seconded by Robinson that the resolution denying a damage claim filed against the
City of Yakima by Mrs. Jack D. Kendall and alleging;,; damages in the amount of $64.84, be passed
as read: Discussion pointed out that the claimant's automobile was damaged when a manhole cover
tipped as'her auto ran over it in the parking lot at Cahoon's Market at 2011 Lincoln Avenue. Mrs.
Kendall advised the Council that Mr. Cahoon advised her, at the time of the accident, that the
City had been notified several times regarding this matter but had done nothing about it. Mr.
Mayo, Public Works Director, stated that this is a City Water Meter which was moved batik on to
this property when improving Lincoln Avenue and that due to the settling of the black top the
cover had come loose. City Attorney Andrews advised that he had consulted with an employee at
the market who advised him that he did not believe that the matter had been reported to the City.
Council members requesting further information as to whether this matter had been reported to
the City before the accident, it was MOVED by Lynch, seconded by Robinson that this matter be
continued for two weeks or until the regular meeting of June 24, 1963: carried, Brazier, Kurbitz;
Larson, Lemon, Lynch, Munger and. Robinson voting aye by voice vote.

it was MOVED by Robinson, seconded by Munger that said report dated May 31, 1963 be accepted and
approved: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by
voice -vote.
A letter dated June 4, 1963 from Tunstall & Hettinger, Lawyers,'on the matter of Petition No.
206 as filed by W. H. Snyder and the rezoning of'certain property located at 3516 Summitview in
order that a service station may be built on this corner, was discussed with Mr. Howard Hettinger
attorney for Mr. Snyder. Mr. Hettinger stated that his client purchased this property last fall
that it has two gas pumps, but in the past few years it's primary use has been a grocery store;
and that there is some evidence that at one time there was a ramp for servicing cars. He further
stated that his clientras applied for a building permit and it has been denied him by the Build-
ing Inspector and the Board of Adjustment, having heard his appeal on May 28, 1963, has concurrdd
with the Building Inspector on the grounds that the installation of a service station on the
,premises does not meet with the definition of service station as it appears in the Zoning Code;
that the premises are non - conforming in a B -2 Zone and that there is no hardship inevidence
to justify the appeal. Mr. Hettinger contended that there is two approaches to the problem;.=(1=)-
that the code be amended or that the property be rezoned as B -3, General Business Zone. He also
informed the Council that persons in the surrounding neighborhood have indicated that they prefer
a service station to a drive in restaurant, the alternative. On completion of discussion it was
MOVED by Brazier, seconded by Munger that said letter be referred to the Planning Commission to
be considered along with Petition No. 206: carried, Brazier, Kurbitz, Larson, Lemon, Lynch,
Munger and Robinson voting aye by voice vote.
Manager Smith informed the Council that Yakima Airport Restaurant, Inc., is requesting rental
adjustment due to delays caused at the time of the installation-of the Air Conditioning and the
procuring of their liquor license. He stated that they are asking that their rents commence on
May 14, 1963 instead of March 15, 1963 as originally designated in their rental agreement..
Manager Smith recognized the delay caused at the time of the installation of the air conditioning
but stated that hb did not feel that we are responsible for the delay in the acquiring of the
liquor license and recommended that- the Council consider ' an adjustment so that the, obligation for
rental will commence as of April 15, 1963 instead of March 15, 1963. It was MOVED by Brazier,
seconded by Robinson that the staff prepare a resolution recognizing the delay caused at the time
of installing the Air Uonditioning and adjusting the obligation of rental to commence as of
April 15, 1963 instead of March 15, 1963 as originally agreed: carried, Brazier, Kurbitz, Larson
Lemon, Lynch, Munger and Robinson voting aye by voice vot.
Manager Smith called the Council's attention to a letter from.the Yakima Valley Association of
Chambers of Commerce which advises that the Governor's Industrial Conference for Yakima County
will be held at the Chinook Hotel on Monday, June 17, 1963-and requested that Council members
attend if possible.
He also reported that Oscar Soderstrom, Police Chief, has been elected as one of eight to attend
and participate in the International Association of Police Chiefs conference to be held in
Berkley California on July $. -& 91 1963, with expenses paid. Manager Smith Commended Chief
Soderstrom and requested permission.for him to make the trip with incidental expenses paid. It
was MOVED by Brazier, seconded by Lemon that Police Chief, Oscar Soderstrom; be and is hereby
authorized to attend this conference with incidental expenses paid: carried, Brazier, Kurbitz,
Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.
Dr. Bittner again discussed with the Council, matters concerning overhead parking in the downtown
area.. He advised the Council that the Downtown Development 6ommittee is considering the possibll
ity and feasibility of constructing five or six parking facilities similar to the one built ad-
jacent to the World's Fair Grounds in Seattle, and building them over existing buildings. Mayor
Larson commded Dr. Bittner and his committee for the time and effort being spent on this problem.
There being no further business to _come before the Council, it was MOVED by Kurbitz, seconded by
