A letter dated June 4, 1963 from Tunstall & Hettinger, Lawyers,'on the matter of Petition No. 206 as filed by W. H. Snyder and the rezoning of'certain property located at 3516 Summitview in order that a service station may be built on this corner, was discussed with Mr. Howard Hettinger attorney for Mr. Snyder. Mr. Hettinger stated that his client purchased this property last fall that it has two gas pumps, but in the past few years it's primary use has been a grocery store; and that there is some evidence that at one time there was a ramp for servicing cars. He further stated that his clientras applied for a building permit and it has been denied him by the Build- ing Inspector and the Board of Adjustment, having heard his appeal on May 28, 1963, has concurrdd with the Building Inspector on the grounds that the installation of a service station on the ,premises does not meet with the definition of service station as it appears in the Zoning Code; that the premises are non - conforming in a B -2 Zone and that there is no hardship inevidence to justify the appeal. Mr. Hettinger contended that there is two approaches to the problem;.=(1=)- that the code be amended or that the property be rezoned as B -3, General Business Zone. He also informed the Council that persons in the surrounding neighborhood have indicated that they prefer a service station to a drive in restaurant, the alternative.
