Council. men Larson and Lemon absent. Invocation was given by Councilman Lynch. The Minutes of the regular meeting of May 20, 1963 were approved as read. Councilman Larson and Lemon having requested permission to be absent from this meeting, it was MOVED by Robinson, seconded by Munger that they be excused: carried, Brazier, Kurbitz, Lynch, Munger and Robinson voting aye by voice vote. Larson and Lemon absent. This being the time fired by the City Council for the hearing on Petition No. 195 as filed by Alden G.-Goode requesting the rezoning of certain property at 603 -605, Pleasant Avenue, from R -2, Two Family Residence Zone to B -2, Local Business Zone, and the Planning Commission having recommended the rezoning of said property, and their being no protests in writing or otherwise, it was MOVED by Lynch, seconded by Munger that Ordinance'No. 449 accepting said recommendation and rezoning be passed as read: carried, Brazier, Kurbitz, Lynch, Munger and Robinson voting aye by voice.vote� La.rsonw and Lemon absent. - 5D•t rr =fit _ ORDINANCE NO. 449, and Ordinance accepting the recommendation of the Planning Commission and rezoning certain property located at 603 and 605 South Pleasant Avenue in the-City of Yakima, Washington, from R -2 , Two Family Residence Zone, to B -2, Local Business Zone. This being the time fixed by the City Council for the hearing on Petition No. 196 as filed by Howard C. Light requesting the rezoning of certain property located at 81i North 5th Avenue from R -3 Multiple Family Residence Zone, to B -3, General Business Zone, and the Planning Commission having recommended the rezoning of said property, and their beingno protests in writing or other wise, it was MOVED by Robinson, seconded by Munger that Ordinance No. 450 accepting said re- commendation and rezoning /be passed as read: carried, Brazier, Kurbitz, Lynch, Munger and Robinson voting aye by voice vote. IT 1) ORDINANCE NO. 450, an Ordinance accepting the recommendation of the Planning Commission and rezoning certain property located at 811 North 5th Avenue in the City of Yakima, Washington, from R -3, Multiple Family Residence Zone to B -3, General Business Zone. Petition No. 199 having been filed on May 21, 1963 with the City Clerk by E. R. Stephenson and others, requesting to change the name of the street "Frances Avenue" to "Westover Drive ", it was MOVED by Robinson, seconded by Lynch, that said petition be referrred to the City Manager and Staff for study and recommendation: carried: Bra'ier, Kurbitz, Lynch, Munger and Robinson voting aye by voice vote. Larson and Lemon absent.VCity Attorney Andrews stated there is no statutory procedure for changing names -of streets, that it would require legislative action by the City Council to make a change by the passage of an Ordinance. He further stated that holding of a public hearing or giving notice of such hearing is not required. Petition No. 200 having been filed on May 17, 1963 with the City Clerk by Will and Marguerite Hackett, requesting the vacation of Hamm Avenue between South 17th and South 18th Avenue, it was MOVED by Lynch, seconded by Robinson that said petition be referred to the City Manager and Staff for study and recommendation: carried, Brazier, Kurbitz, Lynch, Munger & Robinson voting aye by voice vote. Larson and Lemon absent./ Marguerite Hackett in attendance, stated that she owned property on both sides of the va-c-ute- 'property. She also stated she would be out of town for several months, and that her Attorney C. W. Halverson will represent her at any future meetings regarding this , and that he should be notified of any such meetings. Petition No. 201 having been filed on.May 22, 1963, with the City Clerk by Ronald W. Poole and Wanda L. Poole, requesting the rezone of certain property at 45th and Fechter Road from R -1 One Family Dwelling to R -3 Multiple Family Dwelling, it was MOVED by Robinson , seconded by Lynch that said petition be referred to the Planning Commission for recommendation: carried, Brazier, Kurbitz, Lynch, Munger and Robinson voting aye by voice vote. Larson and Lemon absent. Petition No. 202, requesting -tree formation of an L..I.D. for construction of Water Mains at Clift Plat; Petition No. 203, requesting the formation of an L..I.D. for Construction of Sewer, A.-lift Plat; and Petition No. 204 requesting the formation of an L.I.D. or Construction of . Pavement, at Englewood Hill Place from North 58th Avenue to point 250�g s East thereof, and said petitions 202, 203, and 204 having been filed on May 24, 1963 with the City Clerk by A. E. Clift, it was MOVED by Lynch, seconded by Munger that said petitions be referred to City Mgr. and staff for their recommendation: carried, Brazier, Kurbitz, Lynch, Munger and Robinson, voting aye by voice vote. Larson and Lemon absent. Moved by Munger, seconded by Robinson, that Ordinance No. 451 placing a parcel of real property in the city of Yakima on Irrigation Maintenance roll of Local Improvement District No. 450, be passed as r2ad:, carried, Brazier, Kurbitz, Lynch, Munger and Robinson voting aye bn roll call. Larson and Lemon absent. ORDINANCE NO.. 451, an Ordinance placing a parcel of real property in the City of Yakima on the Irrigation Maintenance roll of Local Improvement District No-450. MOVED'by Munger, seconded by Lynch that Resolution'No. D -563 authorizing a temporary loan of $10,500.00 from the Cumulative Reserve for Domestic Water Supply Development Fund to the Sewer ,Construction Fund, and providing for repayment be.passed as read: carried,- Brazier, Lynch, Munger and Robinson voting aye on roll call. Kurbitz voting Nay."' Larson and Lemon - :absent. City Manager Smith stated this loan is being made to cover part of the payment for the Construc- tion of the Washington Interceptor Sewer project to contractor John Knowles until bonds can be issued. Councilman Kurbitz stated he is opposed to dipping into this fund, citing the half million dollar fund of some years ago which was depleted by transfer of funds. Manager Smith stated that. these were two entirely different situations. The purpose of the Cumulative Fund is for Water -Sewer development and it is being used for this purpose. He assured Mr. Kurbitz that rigid requirements are met in these loan transactions and that -the State examiner carefullyy reviews all 1p s to- seec:thatF-th:ey, meet these'_.requ r.ements.c :;-.No loan can exceed 5 years. Council. s-,-t do man RobinsoEwound management established the policy of borrowing from this fund, that even a quarter percent saving in interest would bustify borrowing from this fund, and he believed it. is good judgment to approve this resolution. Councilman Lynch concurred with Councilman Robin- son and further stated the money is being usedfor the projects we have voted for and the money is not being wafted. 1 1 1 1 1 r� 1 1 MAY 272 1963 RESOLUTION NO. # -563 a resolution authorizing a temporary loan of $10,500 from Cumulative Reserve for Domestic Water Supply Development fund to the Sewer Construction fund and providing for re- payment. Moved by Munger, seconded by Robinson that Resolution No. D -564 a resolution of intention to create a local improvement district to improve certain streets by paving and construction of curb: and gutters as required on Petition No.'s 164, 166, 172, 177, 181, 182, 189, 191, and 193 be passed as read:: carried:- Brazier, Kurbitz,-Lynch, Munger and Robinson voting aye on roll call. Larson and Lemon absent. RESOLUTION NO. D -564 , a Resolution of intention to create a Local Improvement District. Moved by Robinson, seconded by Munger that Resolution No. D -565 authorizing the hiring of work, labor and materials without calling for bids for the application of an overlay on Powerhouse road; be passed as read: carried, Brazier, Kurbitz, Lynch, Munger and Robinson voting aye on roll call. Larson and Lemon absent, 'In answer to Councilmen's inquiry, Public Works Director Mayo stated that little will'be saved by calling for bids, that Yakima Asphalt's offer is the best price they have had and that it is imperative that paving over the shoulder be done as quickly as possible as they tend to tear down by traffic. RESOLUTION NO. 565, a Resolution authorizing and directing the City Manager to hire work, labor and materials without calling for bids. The City.Engineer reporting the following estimate for work performed on City projects during the month of May: 1 PROJECT WASHINGTON AVENUE INTERCEPTOR SEWER CONTRACT AWARDED AND CONTRACTOR DEC. 10, 1963 JOHN B. KNOWLES FUND SEWER- CONSTRUCTION 58 -6 -30 AMOUNT $1$,637.77 IT was MOVED'by Lynch, seconded by Robinson that said report dated May 24, 1963 be accepted and approved and that the estimate set forth therein be paid: carried, Brazier, Kurbitz, Lemon, Munger and Robinson voting aye by voice vote. Larson and Lemon absent. Bids having been submitted to the Bid Board on May 27, 1963 for the Edgecliff Manor- Horizon Heights Sanitary Sewer and Domestic Water projects as provided for in LID's # 904,905, 907 & 0 it was MOVED by Robinson , seconded by Munger that the City Engineers recommendation LA `�� "Ov of DeBlasio Bros. in the amount of $47,357.$7 for Schedule I b and II, as being the lowest and best bid, be-accepted, and that said bid be awarded to DeBlasio Bros., subject to receiving the required easement from the Yakima Valley Canal Company, and that the city Manager be hereby authorized to enter into a contract on behalf of the City of Yakima upon(% the filing of the property bond.by said contractor: carried, Brazier, Kurbitz, Lynch, Munger and Robinson voting aye by voice vote. In accordance with action taken at the regular meeting of the Council onMay 20, 1963, the matter of the Maple- Division street improvement was again brought up for discussion. Mrs. William Patterson, representing the League of Women Voters read a prepared statement filed with the City Clerk, May 27, 1963, reaffirming its support of the 1962 Bond Issue which was approved by the voters in the November 1962 election and strongly urged the Yakima City Council to see that the street improvement project authorized by the voters be carried out.. Mrs. Dow Lamber -f, a member of the League, and a member of the Yakima Citizens Development Committee, stated there was a matter of principle involved, that the ballot box is the strength of the people, if you undermine their ..- deci:sions= y_ou-�"undermine the entire system of government. This is a dangerous precedent. She urged the Council to consider this matter very carefully in their final decision., Mr. Hy Wells, Chairman, of Yakima progress Committee, said he was concerned about any change being made in the mandate of the people, and urged the Council to consider this very carefully. Councilman Robinson stated that two letters were on file with the Clerk, one from Mr. Robert Morisette who protested the Maple Division route, and one from the Yakima Public Schools stating they were concerned with the proposed plan for developing Pine Street, stating that A. C. Davis High School is Severely restricted now with traffic problems and the location of another major traffic arterial on Pine would increase the hazard tremendously. They asked Council to seriously consider this matter. Gouiicilman Kurbitz stated that he had voted for the package in the 1962 election with the progress of the city in mind. Other citizens had also done this, but_ now a group of citizens in the area feel they would be hurt by this, and he believes that a mistake has been made in approving the Maple Division route, that a referendum should be put on the ballot in the spring election to determine whether we are right or wrong. Mrs. Dow Lambert replied to Council- man Kurbitz, stating we must as citizens have the responsibility to come forth and not wait until' a vote of the people is,taken and a decision made before we register our thoughts on the matter. Mr. Alden Goode, stated that although he had been against the Maple route, that he now feels the Council should abide by the vote of the people. Councilman Lynch stated he had received a call from Mr. C. Meeker, protesting the Maple Division route. He also stated, that if we are to delay this project, there is no way that we could refuse delaying other projects.such as Lenox Overpass, Summitview or Lincoln if there were opposition,: to these improvements, that a delay againsTthe will of the people will hurt the City. Councilman Brazier stated after hearing both side of the story, that he still feels the Maple routel_is preferable to Pine. There being no further comae nts from the assembly, it was MOVED by Robinson, seconded by Munger that we direct the improvement to be continued along Division.,; and Maple as voted by the people in the 1962 Bond issue: carried, Brazier, Lynch, Munger and Robinson voting aye on roll call. Kurbitz voting Nay. Larson and Lemon absent.
