HomeMy WebLinkAbout05/20/1963 Business MeetingI 434 May 20, 1963 The Yakima City Council met in regular session, Assistant Mayor Brazier, presiding. Councilman Munger, Robinson, Kurbitz, and Lynch; Citv Manager Smith and City Attorney Andrews present on roll call. Mayor Larson and Councilman Lemon absent and excused. Invocation was given by Councilman Munger. Minutes of Regular Meeting of May 13, 1963 were approved as read. In accordance with informal action taken at the regular meeting of the Council on May 13, 1963, the matter of the Maple- Division street improvement was again brought up for discussion. Assis- tant Mayor Brazier prefaced the discussion by reporting on the legal opinion of City Attorney Andrews and Bonding Attorney Dick Thorgrimson on this matter. Elery Van Diest, Attorney, stated he realized that the Council could not legally divert the money for the Maple Street Improvement to Pine, however, in view of the fact that many property owners, both business and residential, feel that an Arterial would be damaging to their property, he would recommend that this project be delayed until the Lenox Overpass has been completed. Roy Cochoran, 601 S. 9th Avenue, addressE the Council and stated he owned several pieces of property on Maple, his own home and several ren- tals. He felt the arterial there would be detrimental to the property by creating excessive traffic, noise and dust. His tennants are concerned about this. He feels Pine would be the bettE route. E. E. Floyd, 411 South 10th Ave e, complained that the curb would be three feet from his property and because of this was very�,_`dpposed to this improvement. Mrs. Robert Morrisette-, 1402 Lincoln, stated that the arterial in front of her home on Lincoln has steady traffic all day and she feels it will be no different on Division. Lawrence Robinson, 501 South 6th Avenue, called to the Council's attention the fact that there is a 12 to 14 foot drop from 6th Avenue to 5th on Maple, which could be very dangerous, and the street improvement will not eliminate this. Public Works Director Mayo confirmed that there -will be no change in the grade. Mrs. M. M. Triplett, property business owner, asked the Council if Maple- Division Arterial will be a 3 or 4 lanes. Public Works Director Mayo, explained it will be four lanes.' Dr. Joseph Bittner presented aerial photos of Division Street area for Council's viewing. He stated we can well afford to develop both Maple & Pine streets. He further stated that if the City is to move ahead, changes.must be expected. It is important that we look to the future. We must have - a Division - Pacific crossing or a Division -Race overpass. Harold Robinson again stated his disapproval of Maple Street. He preferred that Pine Street be used as an Arterial. He recommended that Council dealy action so that a referendum could be prepared for the vote of the people. Bob Herber, Business owner in the area, stated he favored Pine, and also the referendum. He requested a comparison cost for Pine Street and Maple. City Attorney Andrews stated that he felt there is no justification for a referendum vote at the present time. Councilman Robinson emphasized that the 4�100,00000 figure he estimated for acquiring Pine Street property is not unrealistic. Councilman Lynch stated not all property owners are of the same opinion on this matter, that many believe that Division and Maple is the best Route for the Arterial and that we must consider all the people of Yakima, not only the property owners in-the area. The Engineers and Planning Commission feel that Division and Maple is the better route. Councilman Kurbitz stated he had called various people about this and found that most did not seem to care whether the arterial would be on Pine or Maple, that their main purpose in voting for the bond issue, was to improve Yakima's traffic pattern. How- ever, he stated the property owners in the Division Street area whom he had talked to were very much opposed to Maple as an Arterial. Kurbitz MOVED that we delay this development until we can put it to a vote of the people by referendum next spring. This motion failed for lack of a second. Councilman Lynch expressed concern about delaying this project, stating that for a long time we,have been trying to get the people of Yakima to vote for improvements to move our city forward, and we have succeeded in getting their approval. :I cannot approve Mr. Kurbitz's motion as I feel we will lose the impetous>we need to make such improvements. Whereever we try to im- prove,.we will always have objections. Perhaps the next group will object to the Pine Street development- I do not wish to make it difficult for the shop owners -and residents of the Division Street area, however, if we delay this, Yakima will be back in the same old rut. Councilman Munger felt that an arterial will benefit this business area, stating that more ��raff'ic�.reate; busi-ne�3s Yc� ay, need some offstr et parking, but this could easily be solved. Councilman Robinson stated will cost more money,e� hat there will be:a danger to children because Davis High School and Lions Pool are located there. He further explained that since we have the right of way on Maple, it will be more practical to develop Maple. Council- man Brazier concurred with Other`.�Councilman and expressed opposition to running an arterial through a school complex because of danger involved. Councilman.Kurbitz suggested we postpone action on this until next meeting, when all Council members would be in attendance. MOVED by Hurbitz, seconded by Robinson that the matter of the Maple - Division project be postponed until next week and that it be placed at the bottom of the agenda. Carried, Br.abier, Kurbitz,- Yiunger, Lynch, Robinson voting aye by voice vote. Councilman Lynch asked Public Works Director Mayo if he could prepare a comparison cost report by next week. Mr. Mayo stated that he might -be able to prepare a very general estimate. MOVED by Munger, seconded by Lynch that Ordinance No. 448 defining an attempt to commit a crime and declaring an attempt to be a misdeameanor, and amending the Yakima Municipal Code, be passed as read: carried, Brazier, Kurbitz, Lynch, Munger and Robinson voting aye on roll call. Larson and Lemon absent. ORDINANCE NO. 448 , an Ordinance defining an attempt to commit a crime, declaring an a ttem1t to be a misdeameanor, and providing for the punishment thereof; and creating a new chapter of the City of Yakima Municipal Code to be known as Chapter 6.02, "General Provision ". Moved by Robinson, seconded by Munger that Resolution No. D -561 authorizing the execution of an agreement with Cornell, Howland, Hayes and Merryfield for engineering services to the sewage treatment facilities, be passed as read: carried, Brazier, Kurbitz, Lynch., Munger and Robinson voting aye on roll call. Larson and Lemon absent. Manager Smith stated that he, the staff and City Attorney Andrews have carefully reviewed said agreement with Mr. Cornell and that after two other conferences, it was agreed that this is a satisfactory agreement and that he is, therefore, recommending approval by the Council. RESOLUTION NO. D -561, a Resolution authorizing and directing the City Manager and the City Clerk of the City of Yakima to enter into and agreement with Cornell, Howland, Hayes and Merryfield. Moved by Lynch, seconded by Munger that Resolution No. D -562 denying a damage claim filed against the City of Yakima by Management Inc. d /b /a City Peerless Laundry and Cleaners be passed as read: carried, Brazier, Kurbitz, Lynch, Munger and Robinson voting aye on roll call. Larson and Lemon absent. City Attorney Andrews informed the Council that the Claimant had been notified regarding this matter. Resolution No. D -562 A Resolution denying a damage claim filed against the city of Yakima by Management Inc. d b a City Peerless Laundry and Cleaners. more 1 1 1 1 i 435 May 20, 1963 Public Works Director Mayo reporting on a supplemental payment and the City Engineer having sub - mitted a su ]pplemental estimate in the amount of $5,1/_7.22 for payment on the Peach Ten and Variou Residential Streets project, it was MOVED by Lynch, seconded by Munger that said report. and esti- mate be approved and that payment of said estimate be authorized: carried, Brazier, Kurbitz, Lynch, Munger and Robinson voting aye by voice vote. Larson and Lemon absent. Manager Smith thanked Council members for taking the tour of the Landfill at Boise Cascade, Public Works Department,Shop, Tahoma Cemetery and Airport Landfill. He stated plans for a tour of Oak Flats WaterShed will be,,'made. City Manager Smith having given a brief explanation of the Business Route recommended by the Washington State Highway Department, it was MOVED by Robinson , seconded by Munger that City Manager Smith notify the State Highway Department that the alternate Business Route from Highway 82 is :satisfactory. Johri Mayo notified the Council that Washington Interceptor Sewer has been completed by John Knowl s, and that the Public Health Department will inspect it on Friday, May 24, 1963. . There being no further business to come before the Council it was MOVED by Kurbitz, seconded by Munger that we do now adjourn at the hour of 10:30 p.m.: carried, Brazier, Kurbitz, Lynch, Munger and Robinson voting aye by voice vote.
