HomeMy WebLinkAbout05/13/1963 Business Meetingr 432 MAY 13, 1963 The City Council met in regular session, Mayor Larson, Councilman Brazier, Kurbtiz, Lemon, Lynch, Munger and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Invocation was given by Councilman Kurbitz. Minutes of Regular Meeting of May 6, 1963 were approved as read. Petition No. 197 having been filed with the City Clerk on May 9, 1963 by Ed Schaefer and others requesting the removal of 8 maple trees in the]-100 block on the South side of Willow, it was MOVED by Robinson, seconded, by Munger that said petition be referred to the City Manager and staff for study and recommendation: - carried, Brazier, Kurbitz, Lemon, Lynch, Munger, and Robinson voting aye by voice vote. Petition No. 198 having been filed with the City Clerk by Leonard Lacour and others requesting th formation of an L.I'.D. for the construction of a sewer to serve lots in Airport Addition No. 1,' it was MOVED by Munger seconded by Lemon that said petition be referred to City Manager and staff for study and recommendation: carried,- Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Moved by Robinson, seconded by Munger that the Council deviate from the regular order of the agenda and consider the matter of the legal action to collect $"23.22 from Charles M. Young, and also to allow Mr. Les Newlun to address the Council on the'matters of interest to him: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Moved by Munger and seconded by Robinson that Resolution No. D -555 authorizing the City Attorney - to commence legal action against Charles M. Young for the collection of $23.22 for the installati of a new irrigation service be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, and'Robinson voting aye by roll call. RESOLUTION NO. D -555 , a resolution authorizing and directing the City Attorney to commence legal action against Charles M.'Young, Mr. Les Newlun stated that he is concerned about some of the young boys in the City who are breaking laws because of lack of something useful to do. Mr. Newlun thouglrl` work camps, patterned after the Civilian Qonservation Corp of the early 30's would keep the boys active and help them to become useful citizens. Mr. Newlun indicated that he has discussed the proposed program with some of the churches, labor unions and Chamber of Commerce and that they have.indicated that they' will support such a'movement. He asked the Yakima City Council to recommend and support his proposal to state officials in Olympia. Nor formal action was taken on this matter. Council then returned to the regular agenda and it was MOVED by Munger, seconded by Robinson that Resolution No. D -556 authorizing the City Manager to make application for a Federal Grant in the amount of .$554,190.00 for the expansion and addition to existing sewage treatment facilities, be ,passed as read: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson - ,-voting aye b�.ro.11• -ca ussion, Manager Smith pointed out that the 30 percent grant, under Federal.Water Pollution Con- trol Act, has a sense of urgency in that application must be submitted not later than May'20, 1963. Councilman Brazier reiterated his opposition to the use of Federal funds when it is not necessary and stated that in certain areas, the Federal Government has a legitimate interest, such as National Defense and Water pollution and that since water pollution not only effects the immediate area involved but alsothe cities down stream, he would vote for the 30 percent grant_ in order to help combat this problem. He stated he did not feel that favoring this, in any way conflicted with his'stand on the imprudent use of government funds. Thesecare two distinctly different proposals:- He indicated that he is very much opposed to the use of federal funds for streets, sidewalks, municipal building, which he felt should be am on a local level, andthere- for he would not vote for the 50 percent grant.. Councilman Kurbitz opposed.this resolution as he believed that Yakima could afford to make these necessary improvements. Councilman Lemon stated since the government has an interest in water pollution, he would favor applying for this grant. 'Councilman Lynch stated he favored applying for both the 30 and 50 percent grant, that he saw no difference in these proposals. He felt the council is working for the betterment of the community, the money is available for use in sewer construction, and since it could not be financed locally, we should be* practical about this and make application for both grants. RESOLUT_IONINO. D -556, A resolution authorizing the City Manager!-to make application for Federal Grl in the amount of $554,190.00 for expansions and additions to existing sewage treatment f acilities.1 Moved by Lynch, seconded by Robinson that Resolution No. D -557 authorizing the City Manager to mak application for a Federal Grant in the amount of $923,650.00 for expansion and addition to existin sewage treatment facilities be passed as read: Carried, Larson, Lemon, Lynch, Munger and Robinson voting aye by roll call. Kurbitz and Brazier voting no. In discussion Councilman Robinson posed the question that the fact we are applying for both grants does not mean that both will be approved. He further stated that he was in favor of this grant as he felt we should not impose an additional sewage cost to Yakima citizens, that we should apply for both grants with the recognition that only one is available. Kurbitz and Brazier both opposing stating that this improvement should be done on the local level. RESOLUTION NO. D-­557, a.Resolution authorizing the .City Manager to make application for a Federal Grant in the amount of $923,650.00 for expansions and additions to existing sewage treatment facilities. Moved by Robinson, seconded by Brazier that Resolution No. D -55£3 consenting to the assignment from L. W. Hale, d /b /a/ Hales Car Rental Service to Rent Car Inc. of an interest in an automobile rentq: business at the Yakima Airport to Rent Car Inc. be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by roll call. RESOLUTION NO. D -558 A Resolution consenting to the assignment from L. W. RESOLUTION NO. D -559, a Resolution reinstating a parcel of real property on the Irrigation Maintenance Assessment Roll,of the �ity of Yakima for the year 1963. Moved by Lemon, seconded by Munger that Resolution No. D -560 authorizing exclusion of certain property from Irrigation Maintenance Assessment Rolls, be passed as read: carried, Brazier,. Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by roll call. RESOLUTION NO., D -560, A resolution excluding certain lots, tracts and parcels of land from the Irrigation Maintenance Assessment Rolls for the year 1963. The Planning Commission reporting on Petition No. 195 as filed by Alden Goode requesting the re- zone•of property at 603- 605,Pleasant Avenue and recommending that said property be rezoned from R -2 , Two Family-Residence, to B -2, Local Business Zone, it was MOVED by Lynch, seconded by Munger that a public hearing be held on this matter at the regular meeting of the Council on May 27, 1963 and.that due notice be given by publication: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. The Planning Commission reporting on Petition No. 196 as filed by Howard Light requesting the re- zone of property at $11 North 5th Avenue and recommending that said property be rezoned from R -3 Multiple Family Residence, to B -3, General Business Zone, it was MOVED by Robinson , seconded by Lemon that a public hearing be held on this matter at the regular meeting of the Council'on May,27, 1963 and_that due notice be given by publication. Carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Bids having been received by the Bid Board on May 10, 1963 for the Eisenhower Area Storm Drain project, and the City Engineers recommending the lowest and best bid as submitted by.Kimball Construction Co. of Yakima, it was MOVED by.Robinson, seconded by Lynch that the Engineers recommendation be'accepted and the bid awarded to said Kimball Construction Company and that the - City Manager be and is hereby aauthorized to enter into a contract on behalf of the City of Yakima upon the filing of the proper -bond.by said contractor: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. The matter of arterial improvement of Division and Maple streets, approved by voters under the 1962 Bond Issue, was brought on for discussion. Elery Van Diest, Attorney, stated that he, as well as property owners in that area, were against the Maple - Division project. Theyfelt that fast traffic and lack of parking created by this development would cause poor business climate. If owners were forced out of business, the area would become blighted, Mr. .Van Diest further stated he was strongly in favor of developing Pine street as an Arterial. He questioned that the proposed project would accomplish the purpose for which it was intended. Others in attendance speaking in favor of the Pine Street development were Mr. Goode, Mr. Morrisette, Rev. Rimbaugh, Minister of Bethlehem Lutheran Church, Harold Robinson, and Roy Brown. Council members brought out the point of whether it was legally permissable to deviate from the project approved by the voters. City Attorney Andrews stated that several cities with similar problems, wishing to deviat from an approved Bond issue, presented their case to the Supreme'Court, and the Courts decision was that cities must abide by the covenants of the bond. City Attorney Andrews stated the only. alternative would be a referendum vote. _In answer to Councilman Mungers request to review the factors which led to dismissal of the original plan to use Pine Street as an Arterial, Public Works Director Mayo informed the Council that the safety problem was considered in regard to Davis High Gym and Lyons Park area. Also the YVT tracks were considered to be a hazard to traffic and right of way from,4 parcels of property would have - lto-be purchased at a considerable sum. Mayo stated that right of way exists.on Division and Maple. Councilman Lync'b stated that the pamphlet sent to each voter in 1962 election regarding the bond issue distinctly specified the Maple - Division Street improvement. Councilman Kurbitz stated he favored the Pine Street Devel- opment and that we could change this plan. As far as the YVT tracks, they should not present a problem,-that we have them on 16th and Division, and.as far as.the purchase of right of way , the city is now in the process of acquiring land from Christw<�ff property. Mr. Harvey Block, Block Distributing Co. suggested to the Council that they delay this project until the Lenox Overpass was completed to see if the traffic pattern changes. Cost of delay was discussed by council members. Councilman Robinson stated the change to Pine Street would require and additional $100,000.00. He further stated the Bond issue was approved by the voters, and we cannot legally change this improvement to Pine Street, that we should go ahead with plans to improve Division and Maple. Mayor Larson stated that the project was presented fairly to the public, that we have talked to many groups about this, and have asked many questions. There seemed to be no objection to the Maple Division street project. Councilman Lynch stated that we do not want to work a hard - ship-on the property owners, and asked if we could informally delay this matter for a while, until City Attorney Andrews could give a formal opinion on the legality of changing the original plans. City Attorney Andrews said he would check with the Bonding Attorney, Mr. Dick Thor,grimson. Councilman Lynch stated , we are willing to listen to the pros and cons of this matter if possible however, if it.is not legal , we will have to go along with the vote of the people. Councilman Robinson stated we should not delay this more than a week. City Attorney Andrews stated he will have a report at the next regular meeting of the Council. Manager Smith requesting authorization to send Judge Mark Fortier to attend a workshop on Alcoholism at Gearheart, Oregon, On May 23, 24 and 25, 1963, it was MOVED by Brazier, seconded by Robinson that Judge Fortier be authorized to attend conference and that his expenses be paid.
