The City Council met in regular session, Mayor Larson, douncilman brazier, Kurbitz, Lynch, Lemon,
Munger and Robinson; City Manager Smith and City Attorney Andrews were present on roll call.
Invocation was given by Councilman Munger.
Minutes of regular meeting of April 15 were approved as corrected.
In accordance with action taken by the Council at their regular meeting of April 17, 1963, it was
MOVED by Robinson, seconded by Munger that the ordinance regulating garbage, collection and dis-
posal which was read at the previous meeting, be amended in Section 4, Paragraph(F) beginning in
Line 9; Section 4, Subsection 3; and that the last sentence of Section 5 pertaining to rates be
deleted: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting -aye by voice
vote. A motion to pass this ordinance as originally read having been made by Munger and seconded
by Robinson at the previous meeting, Mayor Larson called for a roll call vote on the passage of
Ordinance No. 411, regulating garbage storage, collection and disposal and amending the Yakima
Municipal Code, as amended and Larson, Lemon, Lynch, Munger and Robinson voted aye on roll call.
Kurbitz voted nay on roll call. Councilman Kurbitz explained that he is against the passage of
this ordinance because it does not allow the collection of Swill.
ORDINANCE NO. 441, An Ordinance regulating garbage storage, collection and disposal and defining
terms; and amending Sections 4.16.0101 0130, .140, ..1.$0, and .210.and repealing Section 4.16.200
and Chapter 4.20, all of the City of Yakima Municipal Code.
In accordance with action taken by the Council at their regular meeting on April 1, 1963, the
matter of a resolution authorizing the sale of City owned real property to Gene Cahoon was brought
on for consideration and it was MOVED by Brazier, seconded by Munger that this matter be laid on
the table for one more week or until the next regular meeting of the Council on April 29, 1963:
carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.
Prior to Council action on Petition No. 184 as filed by June Buchanan requesting rezoning of cer-
tain property, Mr. Don Tunstall, Attorney representing Dr. Reynolds, showed the Council Architects
plan for construction of a Clinic on the Buchanan property. Mr. Tunstall stated that in the last
20 years there has been a marked trend toward decentralization, citing as an example the Medical
clinics on the Westside. He further stated he felt the property in question, because of the
$8,500.00 sale price on the lot, would make it prohibitive to build a home there. He felt that
traffic would be no problem, as entry would be from 14th Avenue and not West Yakima, and that ther
is ample offstreet parking provided. Mr. Tunstall then read excerpts from Metzenbaum citing sev-
eral cases approved by court action which supported spot zoning and stated that since the Planning.
Commission has recommended this area be zoned to B -1 that the Council should accept their recom-
mendation. Mayor Larson asked Mr. Tunstall if property owners in the area objected to the rezone.
Tunstall replied that he knew of none, but that most of the tennants-had indicated approval of
the rezone. This being the time fixed by Council for the hearing of Petition No. 1$4, as filed by
June Buchanan, requesting rezone of property at 1402 West Yakima; and 1210, 1212 and 1214 Terrace
Street, and a motion disapproving the recommendation of the Planning Commission and Ordinance,
accepting the recommendation of Planning Commission having been prepared and submitted to Council
for selection, it was MOVED by Brazier,_seconded by Lynch, that the Ordinance accepting the recom-
mendation of the Planning Commission be read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch,

Kurbitz, Larson, Lemon, Lynch, and Munger voting aye by roll call, Robinson voting Nay. In.dis-
cussion Councilman Munger stated he was not sure as to the Planning Commissions policy regarding'
spot and strip zoning, and that Council looks to: the. Commission for guidance in these matters,
and asked Planning Director Finley to clarify some of these questions. In answer to Councilman
Mungers question as to whether Mr. Finley considered spot zoning a good thing, Director Finley
stated this was not an easy question to answer. It is the Planning Commission's duty to promote
and attempt to control the development of the City in an orderly way. When you have miscellaneous
and hodge podge zoning, it becomes meaningless.. He further stated that strip zoning on arterials
is detrimental to flow of traffic, creates hazards, and is not in the best interest of the safety
and welfare of the general public. He would hope that a happy medium could be reached. In answer
to Munger's question as to how far strip and spot zoning should be allowed, Finley stated that
the final decision is up to the Council. Finley also stated that spot zoning does not guarantee
improvement of the area. Councilman Brazier favored rezone of this area and stated Dr. Reynolds
is making an investment in the community, that the tax roll will be increased, and as far as he
could ascertain the,property in question not suitable for other purposes and deteriorating badly.
Councilman Kurbitz concurred with Brazier's statement and said if Dr. Reynolds is willing to spend
the money, and the welfare of the city is improved by this develooment, we should rezone the
property. Councilman Robinson stated it is not wise to pass this ordinance, that it would be
better to try to extend the existing B -1 areas in the vicinity. It should not be too difficult
to acquire lots in the existing B -1 area for business development. He further stated that we do
not have to pick another spot which straddles the street and say that it is necessary to rezone
to B -1. This zoning will only be advantageous to the property owner and not to the neighborhood.
This is not sound or proper development. Councilman Lemon stated since it is the Planning Com-
mission's business to study these matters, and since two meetings were held on this particular
subject, he.would go along with the recommendation of the Planning Commission. Mayor Larson
stated until he could have the Comprehensive Planning Report as a guide, he would accept the
Planning Commissions recommendation and vote yes on this Ordinance.

ORDINANCE NO. 443, An Ordinance accepting the recommendation of the Planning Commission and re-
zoning certain property located at 1105 to 1304 Lincoln Avenue in the City of Yakima, Washington
from R -3 , Multiple Family Residence Zone, to B -3, General Business Zone.
This being the time fixed by Council for the hearing of Petition No. 190 as filed by Mabel McPhee
requesting rezoning of property located at 316 North 3rd Street from B -2 to B -3, and a motion
disapproving the recommendation of the Planning Commission and Ordinance accepting the recom-
mendation of the Planning Commission having been prepared and submitted to Council for selection,
it was MOVED by Munger, seconded by Brazier, that Ordinance accepting the recommendation of
Planning Commission be read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinsor

Robinson voting aye by roll call. �Mr. Ken Matson, Contractor, explained that it i.-s necessary
to rezone this property from B -2 to B -3 because a three story apartment house is to be built
on this property.

others requesting the formation. of -an L.I.D.--for thle - construction -of curb, gutters and the
surfacing of Plath Avenue from 16th to 18th, it was MOVED by Robinson seconded by Munger that
said petition be referred to the City Manager and staff for study and recommendation: carried,
Brazier,' Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.

of Washington Department of Highways from irrigation maintenance charges under Local Improvement
Districts No. 308 and No. 542.

parcels of land from the Irrigation maintenance Assessment Rolls be passed as read: carried,

RESOLUTION N0: D -550, A resolution excluding certain lots, tracts and parcels of land from the
Irrigation maintenance Assessment Rolls-for the year 1963.:
Director of Public Works, John Mayo gave the report•on costs covering certain parking changes.for
the area West of Naches Avenue, from,A to Chestnut; both sides of A from Third to Naches, and
both sides of Chestnut from 4th street to Naches, the total cost would-be about $27,603.00 and
would increase parking space by 61 stalls, averaging out about $452.00 per space. He further
stated the costs will vary in different blocks, depending upon the work involved.- Director Mayo
also informed the Council that the on final proposal by the 'Chamber of Commerce for 168 addi-
tional parking .spots was estimated at 62,000.00.. In answer to Kurbitz question as to how this
would be financed, Mayo indicated that it could be,.financed through parking meter revenue or
Local Improvement District. Kurbitz stated he thought it would-be of less cost to City if em-
ployees of the Street Department could do the job. Mayo stated the Street Department has a full
schedule of work outlined for summer, and he felt that a contractor could do a more efficient
job. In answer to Braziers question as to what revenue could be realized from meters Mayo stated
the 61 parking meters would be 4 hour meters at five cents per hour and should realize about
$60.00 per year; at this rate it would take approximately 10 yearw to break even.. Mayo also
suggested an increase of 105 spaces can be realized in the area North of C Street, two blocks
on North Second and Third Streets, Three blocks on 4th Street. Existing parallel_parking could
be converted to diagonal parking on one side of the street by painting in-diagonal stripes. The
best sides to be used would be the East side of 2nd;; Westside of Third; and Westside of Fourth.
The additional parking space will be needed as the State Highway department had indicated they
plan to reroute traffic from Highway 410 to Freeway by wayhof Fifth Avenue to C Street on to
6th Street, South to Yakima Avenue and to Freeway. This will necessitate widening of Lh Street,
which will create a shortage of about 60 parking spaces. Council requested that Director Mayo
present this information in a written report for the next - regular meeting of the Council.
Councilmen Kurbitz and Brazier were excused at the hour of 5:25 p.m.
Dr. Bittner of the Downtown Development Association, spoke to the Council on the Parking�Space
problem. He stated he did not think it necessary to be:ruthless in making the change to angle
parking. All trees-do not have to be removed and certain.areas beautified by Companies like
United Pacific, and Shaw and Sons , need not be disturbed. We desparetly need additional space
for parking outside the meter zone. Any space that can be picked up by metered area at the
cost estimated by Mayo would be helpful as off street parking is about $1,000 per car. Dr.
Bittner commended the Council for their patience in this matter'
City Manager Smith recommended to-Council that the firm of Anderson, Birkeland, Anderson and Mast
of Tacoma design the Lenox Avenue Overpass and that a contract will be presented to Council '
at the next regular meeting.,�-City Manager also informed Council we have warranty deedson all
the property for the airport clear zone, with the exception of Christoff land and that City
Attorney Andrews will start condemnation proceedings this week.
There being no further business on the agenda.,,it was MOV ED by Lynch, seconded by Robinson, tha
we do now adjourn at the hour of 5:45 p.m.
