APRIL 8, 1963 The City Council met in regular session, Mayor Larson, Councilman Brazier, Kurbitz, Lynch, Lemon, Munger and Robinson, City Manager Smith and City Attorney Andrews were present on roll call._ Invocation was given by Councilman Brazier. _ Minutes of regular meeting of April 1, 1963 were approved as read. An Ordinance appropriating $31,515.00 from unappropriated money of Municipal Airport Fund to 1963 Budget for said fund,.having been read in its entirety at the regular meeting of the Counci: of April 1, was read by title only at this meeting and it was MOVED by Lynch, seconded by Lemon that this ordinance be passed as read: carried, Brazier, Larson, Lemon, Lynch, Munger, Robinson voting aye by roll call. Kurbitz voting Nay., Councilman Kurbitz stated that he is voting Nay for reasons outlined at the regular meeting of April 1, 1963. ORDINANCE NO. 438 , AN ORDINANCE appropriating the sum of $31,515 00 from the unappropriated moneys of the Municipal Airport Fund to Accounts 6 -10, Land, and 1-20 Buildings, of the Capital or Betterment classification of the 1963 appropriation for 39 - Municipal Airport Fund. This being the time fixed by the City Council for the hearing on Petition No. 185 as filed by K. E. Brown and others, requesting the rezone of property located at 1217 and 1218 West Lincoln and a motion disapproving the recommendation of the Planning Commission and an Ordinance ac- cepting the recommendation of the Planning Commission having been prepared and submitted to the Council for their selection, it was MOVED by Robinson, seconded by Brazier, that the Council consider the Ordinance accepting the recommendation of the Planning Commission: carried, Braziez Kurbitz, Larson, .Lemon, Lynch, Munger and Robinson voting aye by voice vote. MOVED by Brazier, seconded by Lemon, that Ordinance No. 439 accepting the recommendation of the Planning..Commis- sion and rezoning certain property located at 1217 and 121$ West Lincoln Avenue, from R` -3, Multiple Family Residence Zone to B -3 General Business Zone be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by roll call. Councilman Robin- son raised the question as to what improvements are being proposed for the 3 lots on the North side and 2 lots on South side of Lincoln. Mr. Fred Velikanje, Attorney, answered Councilman Robinsons questions by stating that the three lots on the North side were under option to BIG WEST OIL. CO., and that a Service Station of the residential type will be constructed there, 'He further explained that the two lots on the South side are now being used for a Used Car Lot and they will remain so, but that there will be a new shop built and the present building in the center of the lot will be removed. Councilman Robinson stated that the business interests must realize that they should provide off street parking, "in the heavily trafficed areas. He further explained that he is not in favor of rezoning the.: "5 lots and that is why he voted "yes" re- luctantly and if it had not been for the Planning Commission's unanimous approval of this -re- - Ejuest3 he would have not voted for the ordinance providing for the rezone. In answer to Councilman Robinsonts inquiry as to whether or not there was adequate representation by the residence of this area at the Planting Commission meeting, Planning Director Finley advised that there was a sufficient number and that they expressed their desire for commercial zoning. Mr. Finley also stated that he felt that there is no real need for too much commercial zoning, but that the Planning Commission felt that this rezoning was good in that it would improve the area. Mr. Finley also explained that; between strip zoning and spot zoning, he believed that spot zon- ing is less undesirable. In answer to Mayor Larsons question on whether curb cuts should be limited, Public Works Director Mayo explained that there is an ordinance which controls curb cuts. Mr. Mayo also explained the proposed plan for parking on Lincoln Avenue after the four lanes are installed. ORDINANCE NO. 4392 AN ORDINANCE accepting the recommendation of the Planning Commission and re- zoning certain property located at.1217 and 1218 West Lincoln Avenue in the City of Yakima, Washington, from R -3, Multiple Family Residence Zone, to B -3 General Business Zone. This being the time fixed by the Council for the hearing on Petition No. 186 as filed by Donald K. Noble and others praying for the Annexation of Certain Property between 15th and 16th Avenue, North of Washington Avenue, it was MOVED by Munger, seconded by Lynch that Ordinance No. 440, providing for the annexation of said.property and zoning same as R 71 Single Family Residence Zone, be passed as read. carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by roll call. ORDINANCE NO. 440 , AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima, and zoning the same as R -1 , Single Family Residence Zone. Moved by,Lemon, seconded by Munger, that Resolution No. D 544, authorizing the execution of an Orchard Lease agreement for property at City Reservoir, with Loren H. Miller, be passed as read carried, Brazier, Kurbitz, Larson, Lemon, Lench, Munger and Robinson voting aye by roll call. RESOLUTION NO. D -5441 A RESOLUTION authorizing and directing the City Manager and the City Cler to execute an Orchard Lease agreement with Loren H. Miller. Moved by Robinson, seconded by Lemon, that Resolution D -545 authorizing the execution of a Grazing Lease Agreement with Edgar Jones for property at Airport be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by roll call. RESOLUTION NO. D 5459 A RESOLUTION authorizing and directing the City Manager and the City Clerk to execute a Grazing Lease agreement with Edgar M. Jones. The Planning Commission reporting on their reconsideration of Petition No. 184 in accordance with Resolution No. D -525 and reaffirming their recommendation that the property at 1402 West Yakima Avenue and 1210, 1212 and 1214 Terrace Street be rezoned from R -3, Multiple Family to B­a1, Modified business zone as requested by Mrs. June Buchanan, it was MOVED by Brazier, seconded by Lemon that a public hearing on this matter be held at the regular meeting of the Council-on the 22nd,day of April, 1963 and that due notice be given by publication: ear��°°ied, Brazier, Kurbitz, Larson,'Lemon, Lynch, Munger and Robinson.voting aye by voice vote. VMr. Champ Sanford , Architect, representing Dr. Reynolds, displayed plans for a proposed Clinic, ex plaining that this property is very suitable for this type of structure,;. In answer to Council man Munger's inquiry, Planning Director Finley stated that the Planning Commission had denied rezoning of property to B -1 along 13th, 14th, and 15th Avenue on West Yakima Avenue. Mr. Finley further stated that he is opposed to establishing B -1 zoning along West Yakima Avenue and that Terrace Street is more adequate for this type of zoning. Discussion also indicated * the area lying east to the area. 1 1 1_, 1 1 1 1 423 APRIL 8, 1963 that there will be no access to the Buchanan property from Yakima Avenue. In answer to Council- man Munger's inquiry as to how far west the strip zoning will go, Director.Finley indicated that it should not be allowed. Councilman Kurbitz suggested we rezone one section at a time and let that section develop and then continue to rezone a section at a time, indicating that he can see nothing bad about zoning. The Planning Commission reporting on Part II of Petition No. 185 as initiated by the Planning Commission and signed by Benjamin Hoffman and others and recommendin the rezoning of property located at 1105 to 1304-Lincolh Avenue (both sides of Lincoln Avenue from R -3 , Multiple Family Dwellings to B -3,. general Business Zone, it was MOVED by Robinson, seconded by Munger that' a public hearing beheld on this matter at the regular meeting of the City Council on April 221 1963 and that due notice be given by publication: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. City Manager Smith having requested authorization to send Public Utilities Director Bert Ander- son, Water Department employees Glenn Perkins and Bob Tollefson, to Eugeng, Oregon, Wednesday, Thursday, Friday, April 17, 18 and 19 to attend the Northwest Water Works Conference, it was MOVED by Munger seconded by Robinson that they be allowed to attend the conference with expenses paid: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger, and Robinson voting aye by voice vote. Manager Smith stated that the cost would be approximately $135.00. Manager Smith asked Council members to attend the Conference of Public Works Association being held in Yakima on April 10, 1963.
