HomeMy WebLinkAbout03/18/1963 Business MeetingI I'll *1 416 MARCH l8_, 1963 The City Council met-in regular evening session, Mayor Larson, Councilmen Brazier, Kurbitz, Larson, Lemon, Lynch, and Munger , City Manager Smith and City Attorney Andrews present on roll call. Councilman Robinson absent and excused. The Invocation was given by Councilman Lynch. The Minutes of the regular meeting of -March 11, 1963 were approved as read. In accordance with action taken by the Council at their regular meeting of March 11, 1963 with regard to Petition No. 186 as.-filed by Donald K. Noble and others praying for the annexation of certain property located between 15th and 16th Avenue North of Washington Avenue, it was MOVED by Lemon, seconded by Munger that the Order Fixing the Date of Public Hearing for April 8, 1963 be passed as read: carried, Brazier, Kurbitz, Larson,- Lemon, Lynch, and Munger voting aye on roll call. The matter of the recommendations, as made by Consulting Engineers, Worthen & Pearson on the in- stallation of air conditioning in the Administration Building at the Yakima Murfeipal Airport being the next matter to be considered, Manager Smith reviewed the recommendations as set forth in a letter from this firm, dated.March 18, 1963 , stating that they recommend that all bids be rejected as exceeding the Engineer's estimate and /or do not provide sufficient sensible cooling as required by the engineers design.. The letter further requested that the engineer be allowed to retrork the plans and specifications and issue another call for bids on the work, to bring the prices within the estimate of $18,000.00 (17,200.00 package cooling and $880.00 glass partition) plus additional electrical and structural work as required. They further recommend that, on thee basis of the rework, the time allowed for bidding and construction work, be set by the Engineer. This letter further stated that in event that the Engineer's recommendation is accepted, the re- work of the system will be accomplished at the contract price presently in effect, plus a ne- gotiated amount for electrical And other work if included in this contract and finally recom- mended that if these recommendations are not accepted, the design contract be terminated at 75% of the total fee, or, a cost of direct Engineers' salaries plus office and travel expense /% %1 ti, 150 %, whichever is the lowest. Manager Smith informed the Council that-the Bid Board has oon curred in the rejection of these bids. Mr. J. Norris Pearson, consulting engineer, being present at this meeting apologized for the way the bids came in and explained that in his efforts to expedite matters he'left out the duct work in his plans and specifications. He asked for the opportunity to get the job done within the estimated $18,000.00 and explained that this could be done by modifying the duct work considerably and simplyfing the controls. He also stated that this will be a packaged system. After due discussion, it was MOVED by Lynch, seconded by Lemon that the bids received on April 15, 1963 be rejected: carried, Brazier, Kurbitz -, Larson, Lemon, Lynch, and Munger voting aye by voice vote. �obinson - absent. Councilmen Lynch and Brazier indicated that $20,000.00 is too high for this project and Councilman Lemon added that he be- lieved $18,000.00 is too high. In the matter of discussing the suggestion of.negotiating with the contractors, Mr. Dwight Specker, representing Simco Heating and Air,Conditioning Company reminded the Council that the firms bidding, have spent several hundred dollars up to this point and asked assurance that the Council will negotiate with all bidders and not select just one. This assurance was given. Mr. Specker recommended that the Council accept the recommendation of the Consulting Engineers and Mr. Dean Hannig, representing Central Heating & Plumbing concurred with Mr. Specker. Mr. Jim Kane, Manager of the Yakima Airport Restaurant, reminded those present that he is trying to open this.new operation by the lst of April and explained that he can not.' go ahead with the lights until the matter of the ceiling openings are decided. Mr. Pearson was asked how long it would take to rework the plans and specifications. He would not limit himself to any certain time but did indicate that it would be less than 30 days. After discussing the, po.ssibilityeof doing the inside work in order that Mr. Kane can go ahead with the placing of the lights and it generally being decided that this is not a good idea, it was MOVED by Lynch that the Consulting.ENGINEER , rework the plans and specifications down to a system costing less than 18,000.00 and that he work with the Restaurant people in expediting the matter of installation. This motion lost for the want of a second. Mr. John Morgan,,representing the Buren Sheet Metal . Company, then presented in writing a bid together with a Wcy bond, by said firm which was read by Mayor.Larso_n and stated that said firm will adequately air condition the Airport Restaurant for the sum of $12,500.00 plus Sales Tax by use of Carrier Air Cooled Refrigerating type equip- ment. Said proposal further stated that this firm is prepared to furnish a''100% bond in which to guarantee that an adequate air conditioning system will be provied and installed. In further guarantee of ,performance, it proposed that the City withhold for a period of 12 months after completion, ✓50% of the contract price and pay 6% per annum on the unpaid balance to Buren Sheet Metal Company on final�xceptance of the eer Job, This.SprR0 oral also excluded the electrical power to the second floor. ✓Mr. Wal -ter peck? �Pffws�ytl i�ls �rdl69in�nconsidered at this. time. In the discussion of what is "adequate ", Manager Smith asked Mr. Pearson if, in the case of ne- gotiation, he would be available to evaluate what is adequate and Mr. Pearson explained-that he would not be able to do this unless some criteria is established as to what and where the re- sponsibilities lie. Manager Smith indicated that he believes that an adequate system exclusive of electrical work, can be installed for $15,000.00 Mr. Pearson stated that if the Council places a ceiling on the amount to be spent on this project, he will prepare plans and specifi- cations accordingly. It was the MOVED by Brazier that this matter be referred to the City Manager to negotiate for an air conditioning system which will cost $15,000.00 or less. This motion lost for the want of a second. Councilman Lynch then MOVED, seconded by Councilman Lemon', that Mr. Pearson be authorized to rework the plans and specifications, as-expediciously- as possible, down to a system costing less than $p15,000.00 including Sales Tax and excluding electrical work: Lemon and Lynch voted aye on roll call. Brazier, Kurbitz, Munger and Larson voted nay. This motion lost for the want of a majority f avoriiig it. A Motion was then made by Kurbitz, seconded by Lemon that the Council appoint two members of the City Council, namely Mr. Munger and Mr. Brazier, to work with the City Manager on,the negotiation with all bidders who have - participated in the first and second bid call, including those whose bids were not accepted because of technicalities, to submit modified bids, and that this committee bring to the Council at their next regular meeting on March 25, their recommendations for an air conditioning system .costing $13,500.00 excluding Sales Taw: carried, Brazier, Kurbitz, Larson, Lemon and Munger voting aye on roll call. Lynch voting nay. Councilman Robinson Absent. Councilman Lynch protested this action stating that it is the wrong way to go about this problem and that we have hired an engineer and the bidders need his specifications to bid by. Moved by Brazier, seconded by Munger that Ordinance No. 433 authorizing and directing an action in the Superior Court for the condemnation and acquisition of certain property for the enlarge- ment and improvement of the Airport and for the relocation of So. 16th Ave. be passed as read: carried, Brazier, Larson, Lemon, Lynch, Munger, and Kurbitz voting aye on roll call Robinson absent. Councilman.Kurbitz voted last and announced his intention to bring this matter on for reconsideration at the next regular meeting of the City Council on March 25, 1963. This matter s C 1 L 1 1 BE, f . March 1$. 1963 was again discussed with Mrs. Ann Olson and Mr. John Christoff., daughter and son of Sam Christoff the owner of property to be condemened. Mrs. Olson again asked that the Council consider, either the lowering of a tunnel for 16th Avenue or the opening.of 12th Avenue rather than the relocation of 16th Avenue. No new information was introduced at this meeting. Councilman Kurbitz again indicated that he is in favor.of opening 12th Avenue. Councilman Lynch and Mayor LarsoneK- plained to Mrs. Olson and Mr. Christoff they regretted that this action is necessary but the City is committed to completing this improvement and since they are unable to obtain the property by negotiation with their father, this is the only alternative. ORDINANCE NO. 433',: An Ordinance authorizing and directing the City Attorney of the City of Yakima to institute and prosecute an action in the Superior Court of the State of Washington, in and for Yakima County, for the.condemnation and acquisition of certain real property for the.enlargement and-improvement of the Yakima Municipal Airport, and for appurtenances and facilities related thereto, and for the relocation of South 16th Avenue as an incident thereof; providing for the taking of said real property, and directing that compensation for the same shall be paid from the Municipal Airport Fund of the City of Yakima and declaring the taking of said real property to be necessary for a public use required by the public interests. Moved by Brazier, seconded by Lynch that Ordinance No. 434 placing certain property located at 914 South 22nd Avenue, on the Irrigation Maintenance Rolls for L.I.D. No. 793, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Munger voting aye on roll call. Robinson absent. ORDINANCE NO. 434, AN ORDINANCE placing a parcel of real property in the City of Yakima'on the Irrigation Maintenance Roll of,Local Improvement District No. 793. Moved by Lemon, seconded by Munger that Resolution No. D -535 approving the completed planning documents prepared by Cornell, Howland, Hayes and Merryfield as the basis for detailed planning of the expanded waste treatment facilities and correction of g.round water infiltration in connection with the advance from the United States Government, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch,,and.Munger voting aye on roll call.. Robinson absent. RESOLUTION NO. D -5352 A RESOLUTION approving the completed planning documents prepared with an advance from the United States of America under the terms of Public Law 560, 83rd congress of the United States , as amended. . Moved by Munger, seconded by Brazier that Resolution No. D -536 denying a damage claim filed agai the City by Julius F.
