Kurbitz absent and ,excused* The invocation was given by Councilman Lemon. The minutes of the regular meeting of February 25, 1963 were approved as corrected. In accordance with action taken by the City Council at their regular meeting of February 25, 1963 with regard to Petition No. 183 as filed by Arthur G. Holden requesting the rezoning of certain property at 212 North 5th Avenue, Mr. Bob Wilson, Property Manager for the' Shell Oil Company, reviewed .plans for this property in connection with the expansion of a service station, showing a picture of a residential type structure which is to be built. Mrs. Holden, property owner, was also present at this hearing. There being no protests in writing or otherwise to this re- quest and a motion having been made by Councilman Lynch and seconded by Councilman Lemon at the previous meeting, to pass Ordinance No. 425 as read, said ordinance accepting the recommendation of the Planning Commission and rezoning said property from R -3, Multiple Family Residence Zone to B -3, General Business Zone, Mayor Larson called for a roll call vote and Brazier, Larson, Lemon, Lynch, Munger and Robinson voted aye. Kurbitz absent. ORDINANCE NO. 425, AN ORDINANCE accepting the recommendation of the Planning Commission and re- zoning certain property located at 212 North 5th Avenue in the City of Yakima from R -3, Multiple Family Residence Zone, to B -3, General Business Zone. Also in accordance with action taken-by the City Council at their regular meeting of February 25, 1963, with regard to Petition No. 184 as filed by Mrs. June Buchanan, requesting the rezoning of certain property at 1402 West Yakima Avenue and Mr. J. E. Ethridge, realtor, having explained that Mrs. Buchanan wishes to build a clinic similar to the one on 16th Avenue and Yakima Avenue with off street parking but due to the sudden death of Dr. Buchanan, formal plans have not yet been prepared, Council members discussed matters of spot zoning, parking and ingress and egress to this property with Mr. Ethridge, who is representing Mrs. Buchanan in this matter. Council - m,en Lynch and Robinson and Mayor Larson having expressed the desire for more specific plans before considering this matter further, it was MOVED by Robinson, seconded by Lynch that the Council consider the resolution disapproving the recommendation of the Planning Commission to rezone- said property: carried, Larson, Lemon Lynch, Munger and Robinson voting aye by voice vote Brazier voting nay by voice vote. Kurbitz absent. The-Clerk of the Council having read said resolution, it was MOVED by Lynch, seconded by Robinson that Resolution No. D -525 disapproving the recommendation of the Planning Commission to rezone property located at 1402 West Yakima Avenue and requesting a further report of the Planni rg Commission, be passe& as read: carried, Larson, Lemon, Lynch and Robinson voting aye on roll call. Brazier and Munger voting nay on roll call. Kurbitz absent. RESOLUTION NO. D -525, A RESOLUTION disapproving the recommendation of the Planning Commission that certain property located at 1402 West Yakima Avenue and 1210, 1212 and 1214 Terrance Street in .the City of Yakima be rezoned from R -3, Multiple Family Residence Zone, to B -1, Modified Business Zone; and requesting a further report of the Plannirg Commission. Moved by Lemon, seconded by Lynch that Resolution No. D -526 accepting the offer of Audrey Pualan Fuller to sell to the City of Yakima certain property within the Clear Zone of the Yakima Municipal Airport for the sum of $1,000.00, be passed as read: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call.. Kurbitz absent. Manager Smith pointed out that this parcel of land is 1.3 acres and that the Christoff.property is the only parcel yet to be obtained for the Clear Zone. RESOLUTION NO. D -5269 A RESOLUTION accepting an offer by Audrey Pualani, now known as Audrey Fuller, to sell to the City of Yakima certain property within the clear zone of the Yakima Municipal Airport, and authorizing and directing the purchase thereof. In accordance with suggestions made by Manager Smith at the regular meeting of the Council on February 25, 1963, it was MOVED by Lynch, seconded by Munger that Resolution No. D -527 authoriz- ing the sale of real property owned by the .City, namely the Old Police Station at 10 East Walnut and authorizing the sale to be made f6r cash or on the best terms available, and calling for sealed bids to be opened on March 25, 1963, be passed as read: carried, Brazier,. Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Kurbitz absent. RESOLUTION NO. D -527,. A RESOLUTION authorizing the sale of real property owned by the City of Yakima. Petiton No. 187 requesting the construction of sewers in the area lying East of Ninth Street and North of Spruce-Street, having been filed with the City Clerk on February 27, 1963, it was MOVED by Robinson, seconded by Munger that said petition be referred to the City Manager and staff for study and recommendation: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz absent. Manager Smith commended Mr. Les Newlun for his work in connection with this petition. Moved by Robinson, se.conded by Lynch that Ordinance No. 426 relating to and regulating the delive: or sale of gasoline and other petroleum products or aviation fuel to the Yakima Municipal Airport and amending the Yakima Municipal Code, be passed' as read. Mr. Fred Schweitzer, one of the Fixed Base Operators at the Airport being present, requested the Council to consider the matter of the Lease Modification Agreements with the Base Operators before voting on this ordinance. Manager Smith having explained that these matters have been worked up together as a package deal, that if the terms of the leases are changed this ordinance should be reconsidered, it was MOVED by Lynch, seconded by Brazier that the established order of business be suspended, and that the Mayor call up Item 7 (b)-of the Agenda for consider,aation: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye by ovice vote. It was then Moved by Lynch, seconded by Munger that Resolution No. D -528 authorizing the execution of lease modification agreements with airport fixed base operators, be passed as read: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye on roll call. Kurbitz absent./Councilman Lemon was excused from this meeting at the hour of 4:00 P.M. and did not vote on this motion. Details concerning this matter were discussed wi'th'Mr. F. 0. Schweitzer, Mr. Charles D. Mc Allister, Mr. Kenneth Hawkins, attorney representing Mr. Mc Allister and'Mr. Donald A. Larson, all base operators. Mrs. Bruce Coombs and Mrs. Ralph R. Richardson were also present. Discussion pointed out that these agreements will reduce the rates for land leased at the Airport from 10 cents a square foot to one cent for land with .build- ings and increase the rates from 1/2 cent to 1 cent for open land. Mr. Mc Allister and his attorney, Mr.. Hawkins informed the Council that they have contracts based on the one cent rental charge for gasoline and asked that consideration be given to excluding them from the new rate. D -528 A RESOLUTION authorizing and directing the City Manager and the City Clerk of the City of Yakima to execute lease modification agreements with airport fixed base operators. The Council then returned to the motion made by Robinson, seconded by Lynch to Pass Ordinance No. 426 relating to and regulating the delivery or sale of petroleum products at the Airport, Mayor Larson calling for a roll call vote, and Brazier, Larson; Lynch, Munger and Robinson voted aye on roll call. Kurbitz and Lemon absent. ORDINANCE NO. 426, AN ORDINANCE relating to, and regulating the delivery or sale of gasoline, oil other petroleum products or aviation fuel to the Yakima Municipal Airport; requiring a license foi such activities; imposing a charge on such deliveries or sales; and amending Sections 5.0$.010, .020 and .030 of the City of Yakima Municipal Code. Moved by Brazier, seconded by Munger that Ordinance No. 427 fixing the time of delinquency of in- stallments and providing for the issuance of Local Improvement District Installment Notes fr the unpaid portion of Local Improvement District No. $92, being the Lincoln and Sunset Arterial Improvement, be passed as read carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Moved by Robinson, seconded by Brazier that Ordinance No. 428, fixing the time of delinquency of installments and providing for the issuance of Local Improvement District Installment Notes for t unpaid portion of L.I.D. No. 893,-being the Westover Drive & Various Others Paving District, be passed as read: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye on roll call. Kurbitz and Lemon absent. Smit4 City Manager City Treasurer Gladys'H:- Richter;.City Treasurer Councilman Munger.then discussed with the Planning,Dirctor, Mr.- Jarvis Finley, various statements made by him to the Planning Commission and reported by the newspapers, regarding parking problems and access to down town Yakima. He urged that a thorough survey be made to determine the actual parking needs in'the central business area and stated that he is not in favor of angle parking on 2nd, 3rd and 4th Street as planned by the Downtown Development Association but is in favor of the angle parking plan for Naches Avenue. He explained that he is pleased to see the interest shown by the Chamber of Commerce and the Development association and indicated that the survey should be made by top level people from these and other groups. Councilman Munger reported that the Park TN Shop Association has provided 391,900 hours"'of free.parking. He also protested Mr.'Finley' statment toi the Planning Commission that Lenox Avenue ••O,verpass; will not help the down town access problem. Mr. Finley contended that the problem is access to the down town area rather than park- ing. Mrs. Lenore Lambert, who served- on•the citizens development committee, and-observer for the League /of Women Voters., also protested the indication that Lenox Avenue Overpass will not pro- vide better access to the down town-area. Manager Smith reported that Mr. Ed Williams' term on the Civil Service Board for Fire and Police has expired as of January 1, 1963 and requested the Council to approve his appointment for anothe six year term. It was MOVED by Robinson, seconded by Munger that the Council does hereby approve the appointment of Mr. Williams to said Civil Service Board for a six year term or until January 1, 1969: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye by voice vote. Manager Smith also reported that Worthen & Pearson, Consulting -Engineers for the Air Conditioning installation in the Ad ' ' t, l B ilding at the Airport, has submitted a basic estimate of $14,625.00 for a cent ra sys em ase on 25 tons cooling load and $20,125-00-based on 33 tons whic they believe to be the total cooling load and which would be individual packaged units. He furth( reported thattthe Consulting Engineers are recommending the central system - mounted on the roof, but that our Building Inspector reports that the Administration Building roof is not structurally strong enough for this purpose. He also reported that he has not'yet heard from Woodyard and Loomis with regard-to their participating in the additional cost of this improvement. There being no further business to come before the Council, it was MOVED by Brazier, seconded by Munger that we do now adjourn at the hour of-5:40 P.M: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye by voice vote.
