FEBRUARY 18, 1963
The City Council met in regular session at,the hour of 8 p.m. on this date. Mayor Larson,
Councilmen Brazier, Lemon, Lynch and Robinson, City Manager Smith and City Attorney_Andrews were
present on roll call. Councilman Kurbitz and Munger absent and excused. .
The Invocation was given by Councilman Brazier.
In accordance with Resolution No. D, -512, the Clerk of the Council read the one and only bid re-
ceived for City Advertising and it was MOVED by Lynch, seconded by Robinson.that the bid of
Yakima Daily Republic to-print and publish such ordinances, resolutions,'notices etc., of the
City of Yakima for the ensuing year, be accepted and the City Manager be and is hereby authorized
to enter into an Agreement with said Company on behalf of the City of Yakima for said service:
carried „Brazier, Larson, Lemon, Lynch and Robinson voting aye by voice vote. Kurbitz and Munger
absent. ,/Discussion pointed out that the bid received this year is identical with the bid re-
ceived and accepted by the Council last year.
In accordance with action taken by the Council at their regular meeting of February 11, 1963) it
was MOVED by Brazier,•seconded by Lemon that Resolutin No. D -520 denying payment of a Claim for
Damages filed by Robert H. Murphy, be passed as read:- carried, Brazier, Larson, Lemon, Lynch and
Robinson voting aye by voice vote. Kurbitz and Munger absent. Mr. Murphy did not attend this
meeting. Discussion pointed out that the car which was damaged belongs to Mr. Murphy's daughter,
Janet Murphy and that the tree which damaged the car is growing in the parking strip in front of
202 South Naches Avenue and not in the center park area on this street.
A Notice of Intention To Commence Annexation Proceedings having been filed with the City Clerk
on January 23, 1963 by - Donald D. Noble and,others'and action on this matter having been set over
to this date, and Mayor Larson having determined that Mr. Don D. Noble, Mr. Albert A. Ruegg ,
Mrs. Wanda M. Ray and Mr. Leonard B. Lacour, signers of said notice, were present at this meeting
it was MOVED'by Robinson, seconded by Lemon that the annexation proposed by these persons be
accepted by the City of Yakima and that the area to be annexed be required to assume its share of
the City's existing indebtedness: carried, Brg`zier, Larson, Lemon, Lynch and Robinson voting aye
by voice vote._ Kurbitz and Munger absent. ✓ ✓Upon the request of the Council, Public Works Di-
rector Mayo, brought forth for filing, a petition, to be known as Petition No. 186, signed by
Albert A: Ruegg,., Howard Ruegg, Leonard B. Lacour, Kenneth M. Gaskin, John H. Jones, Nancy A.
Crawford,Edward K. Klang, Donald D. Noble, Billy L. Ray, Olaf Turnbloom, Charles E. Poland,
Howard Nelson, Mary Burns, Hugh Mack and F. B. Lund, praying for the annexation of certain
property between 15th and 16th Avenue•North of Washington Avenue, being the same property describe
in the preceding Notice of Intention to Commence Annexation Proceedings. In order that this matte
might be considered by the Planning Commission at their meeting on March 5, 1963) it was MOVED by
Robinson, seconded by Lynch that Petition No. 186, be referred to the City Manager and the Plannin.
Commission for study and recommendation: carried, Brazier, Larson, Lemon, Lynch and Robinson voting
aye by voice vote. Kurbitz and Munger absent.
An ordinance appropriating $23,545.00 to the 1963 Budget for Statutory and General and the Enginee -
ing Department, having been read in its entirety at.the regular meeting of the Council on February
11, 1963 and laid on the table for one week, was read by title only at this meeting and it was
MOVED by Robinson, seconded by Lemon that Ordinance No. 424 providing for said appropriation, be
passed as read: carried, Brazier, Larson,''Lemon, Lynch and Robinson voting aye on roll call.
Kurbitz and Munger absent. Before voting on this matter, Councilman Brazier explained that he
feels that raises are not proper at this time for jobs already established. He pointed out that
two members of the Council were absent when the ordinance was presented and that since this is an-
emergency ordinance and requires one more than a majority vote to pass, he has advised other
members of the Council of his position in advance so as not to hinder the engineering program. He
also indicated that perhaps the salaries which have been deleted from this ordinance should be
taken "up before budget time, but that they should not be a part of this ordinance. He then asked
for more information on this appropriation and Manager Smith and Public Works Director Mayo ex-
plained that the Ciil Engineer is needed for some of the more technical work being planned and
the two Engineering Aids will be inspectors as well as surveyors and that these three people are
needed to speed up the handling of local improvement districts and to take care of the increased
work load. Mr. Mayo explained that the money included for expert services is to be used for
specialists when needed, such as Mr. George Picatti for electrical work. 'Councilman Lynch indi-
cated that he agreed with Councilman Braziers statements to some degree.
ORDINANCE NO. 424, AN ORDINANCE appropriating the sum of $23,545.00 from the unappropriated
oneys in the Current Expense Fund to the 1963 appropriations for 15 - Statutory & General, and
24, Engineering Department.
Petition No. 185 having been filed with the City Clerk on February 13, 1963 by K. E. Brown and
others requesting the rezoning of property located at 1217 and 1218 Lincoln Avenue from R -3,
Multiple Family .Dwellings to B -3, General Business zone, it was MOVED by Brazier, seconded by
Lynch that said petition be referred to the Planning Commission for study and recommendation:

it was MOVED by Robinson, seconded by Lynch that the report of the City Engineer dated February
15, 1963 with - respect to the progress on this construction project of the City of Yakima, be
approved and that said estimate therein set forth be approved and payment of same authorized:

FEBRUARY 18, 1963
Manager Smith reporting that he has reappointed Mr. Don F. Conners to the Board of Adjustment
since his term expires on March 15, 1963, it was MOVED by Brazier, seconded by Lemon that the
City Council does hereby approved and confirm this reappointment for a 6 year term or until March
15, 1969: carried, Brazier, Larson, Lemon, Lynch and Robinson voting aye by voice vote. Kurbitz
and Munger absent.
Manager Smith having informed the Council that W.. K.. 11Pete11 Moore, has requested permission to
attend and educational conference for instruct6rs of Fire Schools to be held February 26 through
the 28th in Memphis Tennesee and has further requested that he be allowed, not to exceed $258.
for expenses, it was MOVED by Robinson, seconded by Brazier that Fire Chief Moore be and is
hereby authorized to make this trip out of State and that his expenses be allowed not to- :exceed
`258.00: carried, Brazier, Larson, Lemon, Lynch and Robinson voting aye by voice vote. Kurbitz
and Munger absent.
Manager Smith also reported that a formal presentation of the Engineering Study on Sewage Treat-
ment Plant and Industrial iffaste System, will be made, by the Consulting Engineers, Cornell,
Howland ,Hayes & Merryfield, at the hour of 8 p.m. on Wednesday, February 27, 1963 in the City
Council Chambers, to the Members of the City Council and he further explained that it is planned
to invite the News Media as well as Members of the Citizens Committee of last summer who made a
study of our Water -Sewer problems.. He also requbsted that Council Members, who can, meet with
him at the hour of 10 A.M. on Wednesday of this week, February 20, 1963, to make a tour of the
Sewage Treatment Plant, the,Warehouse and other city properties as time permits.
There being no further business to come,before the Council, it was MOVED by Brazier, -seconded
,by Lynch that we do now adjourn at the hour of 9:25 p.m. carried; Brazier, Larson, Lemon, Lynch
and Robinson voting aye,by voice vote. Kurbitz and Munger absent.
