HomeMy WebLinkAbout02/11/1963 Business Meeting1 i 405 FEBRUARY 11, 1963 The.City Council met in regular session, Mayor Larson, Councilmen Brazier, Lemon, Munger and City Manager Smith, and City Attorney Fred Andrews present on roll call. Councilmen Kurbitz and Lynch absent and excused. The Invocation was given by Councilman Munger. This being the time fixed by the City Council for the receiving, reading and the considering of bids for the purchase of General Obligation Bonds in the principal sum of $1,000,000.00 , the Clerk of the Council read bids submitted as follows: Tot. After checking and finding same in order,.Mr. Vadman informed the Council that the bid submitted by Seattle First National Bank of Seattle, showing.the average interest rate of 2.8744 percent, making the total amount of $342,052.50, is the lowest and best bid and recommended that the bid be accepted by the Council. It.was MOVED by Lemon, seconded by Brazier that the bid of Seattle First National for the purchase of $1,000,000.00 General Obligation Bonds from the City of Yakima be accepted., and that.the deposit checks of the unsuccessful bidders be returned: carried Brazier, Larson, Lemon, Munger, and Robinson voting aye by voice vote. Councilmen Kurbitz and Lynch absent." The Minutes of February 4, 1963 were then read and approved as corrected. In accordance with action taken by the City Council at their regular meeting of February 4, 1963 on the matter of a Notice of Intention to Commence Annexation Proceedings as filed by Donald D. Noble and others, and Manager Smith having explained that City Attorney Andrews has contacted the signers of said notice who informed him that it would be more convenient for them to meet with the Council at their evening meeting on February 18, 19632 it was MOVED by Robinson, seconded by Brazier that this matter be.continued for one week or until the regular meeting of the Council on February 18, 1963:. carried, Brazier., Larson, Lemon, Munger and Robinson voting aye on .roll call. Councilmen Kurbitz and Lynch absent. An Ordinance appropriating $28,855.00.to the 1963 Budget for the Engineering Department, having been readinn it's entirety at the regular meeting of the Council on February 4, 1963, was read by title only at this meeting and it was MOVED by Robinson, seconded by Lemon that said ordinance be postponed indefinitely and a substitute ordinance be read: carried, Brazier, Larson, Memon, Munger and Robinson voting aye on roll call. Councilmen Kurbitz and Lynch absent. A substitute ordinance appropriating $23,545.00 to the Engineering Department 1963 Budget was then read in it's entirety and ordered laid on the table for One week or until the regular meeti of February.l$, 1963. This being the time fixed by City Council for the.Hearing on Petition No. 179 as filed by Donald H. Skone and others, praying.for the annexation of certain property East o.f58th Avenue and North`' of Englewood and there being no protests in writing or otherwise, it was MOVED by Munger, seconded by Lemon that Ordinance No. 422 providing for laid annexation and zoning said property as R -1, Single Family Residence, be passed as read. Carried: Brazier, Larson, Lemon, Munger, and Robinson voting aye by roll call. Councilmen Kurbitz and Lynch absent. Mr. Howard Hettinger Attorney representing the petitioner was present at this hearing. ORDINANCE NO. 4221 AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima, and zoning the same as R -1 , Single Family Residence Zone. Moved by Munger, Seconded by Robinson that Ordinance No. 423 relating to one -way traffic in certain alleys within the city of Yakima and amending the City of Yakima Municipal Code, be passed as read. carried: Brazier, Larson, Lemon, Munger and Robinson voting aye on roll call. Councilmen Kurbitz and Lynch absent. ✓Manager Smith explained that the Traffic Board is re- commending this action to develop uniformity and to take care of congestion in certain alleys. ORDINANCE NO. 423, AN ORDINANCE relating to one -way traffic within the City of Yakima, and amending Section 9.28.230 of the City of Yakima Municipal Code. Moved by Brazier, seconded by Robinson, that Resolution No. D -517 denying payment of claim for damages to Alvin G. Evans , be passed as read. Carried: Brazier, Larsonj Lemon, Munger and Robinson voting aye on roll call. Councilmen Kurbitz and Lynch absent. In discussion of procedure for handling damage claims, Councilman Robinson suggested that, in order that the claimant is informed of the Council's intentions, a letter be sent to him before the Council meeting, in order that he may attend if he chooses. Moved by Robinson, seconded by Munger that Resolution No. D -518 authorizing the payment of $44.94 to Robert F. Tormaschy in payment for tools inadvertently hauled away by the City Garbage crew, be passed as read: carried, Brazier, Larson, Lemon and Robinson voting aye on roll call. Munger voting Nay on roll call. Councilmen Kurbitz and Lynch absent. RESOLUTION NO. D -51$, A RESOLUTION aut.h0i! zing the payment of $44.94 to Robert F. Tormaschy. Moved by Brazier, seconded by Munger that the resolution denying payment of a claim for damages filed against the City of Yakima by Robert H. Murphy, be continued until the next regular evening meeting of the City Council on February 18, 1963; carried, Brazier, Larson, %Lemon, Munger and Robinson voting aye by voice vote. Councilmen Kurbitz and Lynch absent. ✓ This action was taken because the letter mailed February $, 1963 by the City Attorney informing Mr. Murphy of the Council's intention to deny this claim would not be received,by him in time to attend this meeting since he lives in Wapato. I 406 FEBRUARY 11, 1963 Moved by Lemon, seconded by Munger that Resolution No. D -519 accepting an offer by Joe Wong, Harry Wong and Tom Wong-to sell to the city of Yakima certain property within the clear zone of the Yakima Municipal Airp'ort, and authorizing the purchase thereof, be passed as read: Carrie Brazier, Larson, Lemon, Munger and Robinson voting aye on roll call. Kurbitz and Lynch absent. In discussing this matter, Manager Smith reported-that the City appraiser has appraised this property at $13,000.00 making this offer pretty much in line with said appraisal. Manager Smith also advised that the "WOngs" are to have the privilege of using the land for row crops for the next two years. RESOLUTION NO. D -519, A RESOLUTION accepting an offer by Joe Wong, Harry Wong and Tom Wong to sell to the City of Yakima certain property within the clear zone of the Yakima Municipal Air- port, and-authorizing-and directing the purchase thereof. The Planning Commission reporting on Petition No. 183 as filed by Arthur G. Holden and wife, requesting the rezoning of property located at 212 North 5th Avenue,• and recommending that said property be rezoned from R -3, Multiple-Family to B -3, General Business zone, it was MOVED by Robinson,-seconded by-Munger-that a- public hearing on this matter be held at the regular meeting of the Council on- February 25, 1963 and that due notice be given by publication: carried, Brazie: Larson, Lemon, Munger -and Robinson voting aye by voice vote. :Councilmen Kurbitz and Lynch absen- The Planning Commission also reporting on Petition No. 184 as filed by Mrs. June Buchanan re- questing the rezone of property located at 1402 West Yakima Avenue, and recommending that said property be rezoned from R -3 , Multiple Family to B -1, Modified Business zone, it was MOVED by Munger, seconded by Lemon that a public hearing on-this matter be held at the regular meeting of the City Council on February 25, 1963 and that due notice'of said hearing be given by pub - lication: carried, Brazier, Larson, Lemon, Munger and Robinson voting aye by voice vote. Councilmen Kurbitz and Lynch absent. Mr. Stephen Huza,.filed a letter with the Clerk of the Council setting forth his protest, and also voiced his - objections to the pay increases being considered for-the Engineering Department stating that he believes this to be against State Laws. City Manager Smith explained that the ordinance being considered is -A/ � 1� & ,"and that he has checked with the State Attorney General and State Examiner on this matter. Manager Smith reported on the trip made by him and Mayor Larson to Olympia. He stated that they met with'!S •legislators of the 14th and 15th District and discussed House Bill No. 3, providing for the sharing of liquor revenues, and were'told that if this bill comes out of committee, it will have no difficulty passing the House. He further reported that the Legis- lators are anxious to do something for cities. Mayor.Larson stated that they had been assured that, under no circumstances, will legislators vote more tax burden on cities without more revenue to them. He also related that the matter of increase in the Firemen''s pensions from $130.00.to $150.00 which amounts to approximately $7,225.00,year.ly increase to the City of Yakima, was discussed and that the Legislators were sympathetic with the cities needs. Councilman Munger. asking to be excused from the regular meeting of the Council on February 18, 1963, since he will be in Portland, Oregon at that time, it was MOVED by Robinson, seconded by Brazier that Councilman Munger's request be grantedr- carried, Brazier, Larson, Lemon, Munger, and Robinson voting aye by voice vote. Councilmen.Kurbitz and Lynch absent. There being no further business to come before the Council, it was MOVED by Brazier, seconded by Lemon, that we do now adjourn at the hour of 4:45 p.m. carried::- Brazier, Larson, Lemon, Munger and Robinson, voting aye by voice vote.
