HomeMy WebLinkAbout01/21/1963 Business MeetingF, 3 3.! bD January 21, 1963 - 8 P.M. to 11 P.M- The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Larson, Lemon Lynch, and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilr- Mun,ge:r absent and excused. The Invocation was given by Councilman Brazier. The minutes of the regular meeting of January 14, 1963 were approved as corrected. An Ordinance appropriating funs to the 1963 Budget having been read in its entirety at the regul meeting of the City Council on January14, 1963 and laid on the table for one week, was read by title only at this meeting and it was MOVED by Lynch, seconded by Robinson that Ordinate No. 413 appropriating $205,145.00 in the newly created Sewer Construction Fund to the 1963 Budget and repealing Ordinance No. 404, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye on roll call. Munger absent. ORDINANCE NO. 413, AN ORD INIANCE appropriating the sum of -4$205,145-00 from unappropriated money t�Q be deposited in the Sewer Construction Fund of the City of Yakima to Account 6 -30 , Other Structui? es and Improvements, of the Capital or Betterment classification of the 1963 appropriation for 58'-_' Sewer Construction Fund and repealing Ordinance No. 404. In accordance with action taken. by the Council at their regular meeting of January 14, 1963, with regard to Petition No. 179 as filed by Donald H. Skone , said petition praying for the anne::ation of certain property east of 58th Avenue and North of Englewood, it was MOVED by Lemon, seconded by Kurbitz that the order fixing the date of hearing on said petition for the 11th day of Februa as read by the Clerk of the Council be approved: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, and Robinson voting aye on roll, call. Munger absent. In accordance with action taken by the Council at their regular meeting of January 14, 1963 , a resolution authorizing the execution of a Lease Agreement with Bart Woodyard and Harold E. Loornis, together with a lease covering certain property located at the Yakima Municipal Airport, having been handed to the Council for consideration, and Planager Smith having explained that these persons are in the process of forming a Washington Corporation and recornmending that this matter be postponed in order that the name of the new corporation may appear on this lease, it was MOVED by Brazier, seconded by Lynch that action on this matter be postponed for one week: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye by voice vote. Munger absent. Mr. Woodyard and Mr. Loomis being present at this meeting, explained and. °showed prospective plans for their restaurant at the Airport. This being the time fixed by the Council _fcr the hearing on the Assessment; roll for L.I.D. No. 892, Lincoln Sunset Arterial Paving District, and the rc being no protests in writing or otherwise, it was MOVED by Robinson, seconded by Brazier that Ordinance No. 41LP 'confirming said- assessment roll and every part thereof, be passed as read.: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, and. Robinson voting aye on roll call. Munger absent. Matters concerning this district were discussed with Mr. Herman Knopf of 3211 Lincoln Avenue and Mr. Gene Naff, 3402 Lincoln "Lvenue. No formal protest was filed by either property owner. ORDINANCE N0. 414, AIi ORDIN!�_c10E confirming the assessment roll_ covering roll covering Local Improti e- ment District No. 892 as created and established by Ordinance No. 257 of -the Ordinances of the I I City of Yakima. This being the time fixed by the Council for the hearing on the Assessment roll for L:I.D. No. $ Westover Drive and Various Other Streets Paving Districts, and there being no protests in li.riti or otherwise, it was MOVED by Lemon, seconded by Lynch that Ordinance No. 415, confirming said assessment roll and every part thereof, be passed 'as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye on roll call. Munger absent. Matters concerning this district were discussed with Dr. Chisholm, who owns several peices of property in this district. No formal protest was filed by him. ORDINANCE NO. 415, AN ORDINAI -ICE confirming the assessment roll covering Local Improvement Distric No. 893 as created and established by Ordinance No. 263 of the Ordinances of the City of Yakima. This being the time .fixed by the Council for the hearing on the assessment roll for L.I.D. No. 894, South 1/2 of Doulgjas Drive and North Nache s Avenue paving district, it was MOVED by Robinson seconded by Brazier, that Ordinance No. 416 confirming said assessment roll and every part thereof be passed as read: carried,�razier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye on roll call. Munger absent. Discussion pointed out that Mrs. Jeanne Drees, 4210 Douglas Drive, has filed a written protest to the cost of this improvement but was .not in attendance. Matters concerning the North Nache s Avenue Area were discussed with Mr. Toney Zerr, who explained that he represented his neigh'oors in that area. No formal protest was filed by him and no formal action was taken on this protest. ORDINANCE N0. 416, AN ORDIP�I:'NCE confirming the assessment roll covering Local Improvement Distric No. 894 as created and established by Ordinance No. 264 of the Ordinances of the pity of Yakima. This being the time fixed by the Council for the hearing on the assessmentroll for L.I.D. No. 895 44th Avenue and South 1/2 ,of Arlington Street Paving District, and there being no protests in writing or otherwise, it was MOVED by Brazier, seconded by Robinson that Ordinance No. 417 confirming said assessment roll and ev, -:ry part thereof, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, ,Lynch and Robinson voting aye on roll call. Munger absent. Manager Smith and3ublic Works Director Mayo explained that this district is to be paid by the School District. ORDINANCE NO. 4179 AN ORDINANCE confirming the assessment roll_ covering Local Improvement District No. 895 as created and established by Ordinance No. 272 of the Ordinances of the City of Yakima. This being the time fired by the Council for the hearing on the assessment roll for L.I.D. No. '896, Broadmoor No. 1 and 2 Curb and Gutter District, and there being no protests in variting or otherwise, it was MOVED by Lemon, seconded by Brazier that Ordinance No. 418 confirming said assessment roll and every part thereof, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye on roll call. Petition No. 181 as filed by Lyle Washburn and others requesting the formation of a Local Improvement District for the construction of curhs, gutters and the surfacing &E West Walnut Street from Westover Drive to South 40th Avenue, having been filed with the City Clerk on January 14, 1963) it was MOVED by Robinson, seconded by Brazier that said petition be referred to the staff for study and. recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, and Robinson voting aye by voice vote. Munger absent. Petition No. 182 having been filed v °;ith the City Clerk on the ll�th Day of January , 1963 by Robert C. Munger absent. Manager Smith reporting that the following bids have been received by a bid board for the extensic a Domestic Wat'c -retain on Willow Street. DeBlasio Bros. $7,97..72 Central Heating K, Plumbing 91785.98 Valley Plumbing & Heating 13,988.26 and he and Public Works Director Mayo recommending the bid of De Blasio Brothers as the lowest best bid, it was MOVED by Brazier, seconded by Lynch that the Council concur jdth .these recom- mendations and that this bid be awarded to DeBlasio Bros. in the amount of $7,974.72 and that the City Manager be and is hereby authorized- to enter into a contract on behalf of the City of Yakima upon the filin.z of the proper 'pond by said Contractor: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting.aye by voice vote. Mrs. Paul Garbe, 1104 South 31st avenue, being present and inquiring as to what is 'r"eing done with regard to two petitions filed by persons in her neighborhood, said petition requesting the construction of curb -s and - ;utters on South 31 st Avenue and the removal of -a tree at the corn r of 31st and Nob Hill_ which obstructs. the vies,,, Public (works Director Mayo explained that the im- provement petition will be included in local improvement districts' .formed in the spring, and as to the'tree, he further explained. that the city has contacted the property owner, Mr. Wetzel and asked for cooperation•on this matte ,-but that Mr.. has-contacted will-not removed the tree or trim it. The matter of the city's need for right of way for 31st Avenue and the legal technicalities evolved in the matter of remmving the tree were then discussed. Councilman Brazier suggested use of a criminal complaint in the matter of the tree in which case the city would be forced to tape action. Councilman Robinson also explained the matter of a right of way problem on this, property and concluded that if the city does have a :right of way then we might be able Rio do somethinn about the tree. Mr. T,�loolen' stated that the people , except Mr. fletzel, in this area unanimously signed the petition for the curb and ;utter in this area. The Council informally referred this matter to the staff for study and recommendation. Councilman Kurbitz having requested information on plans to increase the engineering staff and the app.ropiiation of additional money to the 1963 budget for this purpose, registered his protest to this action and e .piained th-�t he believed that this engineering �,iork should be farmed out to engineering firms because added personell- will not be dropped and will be on the payroll for year: to come thus using any saving s achieved by adding to the staff. This matter was discussed but no formal action taken. Mr. Kurbitz having explained that he is to be a memb (-::r of a people to people tour through Europa: and requesting permission to be excused from the neat 9 meetings of the City Council, it was MOVED by Robinson , seconded by Brazier, that Councilman Kurbitz be excused from Council meetings for the next -9 i,�eek: ; carried, Brazier, Kurbitz, Larson, Lemon, Lynch, and Robinson. voting ave on roll call. Manager Smith having requested authorization to send City Alarm Supervisor, Ed Rumsey to Beaverton, Oregon on T"tTednesd.ay and Thursday, January 23 and 24th, 1963 to attend a public safety communications officer's session, it was MOVED by Robinson, seconded by Brazier, that Mr. Rumsey be allowed to attend this session and that his expenses be paid` up to_//:11$ .0_.00: carried, Br azier, Kurbitz, .Larson, Lemon,Lynch, .and appr6ximately Robinson voting aye by voice vo!;e. Munger absent. Manager Smith having explained that a letter has been received from the fixed based operators as well as aerial applicators at the Yakima Municipal Airport, protesting rates charged them by the city, the matter of Airport ,Rates was brought on for discussion. He further explained that the Fixed Base Operators have made the reco ;mme nd.ation that th,�= City charge a fee to the .off base operators who use the-airport facilities. Mr. Howard Hettinger stated that he is opposed to the recommendations made by the. Fixed Base Operators and that the real issue is a personal one and not a matter of revenue for the City. Councilman Lynch emr,hasized that it should be made clear that the Fixer? Base Operators havemade the recomme nd. -Aion and not the City. There was , a general discussion on this matter and it was suggested that further study be made. Manager Smith advised the Council that he is having a meeting with the airport grouj_) on Wednesday afternoon, 1:30 p.m. at the Yakima Vallee Regional Library. Councilman Lemon suggested that a three man committee be selected to stuffy this, situation and make recommendations. Councilman_ Lynch suggested that persons selected for this committee not be connected with aviation so that a more objective view may be taken. No formal action taken on. this matter.
