HomeMy WebLinkAbout12/28/1962 Special Meeting1 1 I 389 SPECIAL MEETING DECEMBER 28, 1962 The City Council having taken action at their regular meeting of December 10, 1962, to hold a special meeting on this date in lieu of regular meetings on December 24th and 31st; 1962, due notice of said meeting was given by the Clerk for the purpose of considering the following bus- iness: 1. Second reading of ordinance appropriating monies to the "Sewer Construction Fund "; 2. Second reading of ordinance appropriating monies to the' "City Garage Fund "; 3. Ordinance Creating L.I.D. No. 906 (continuation of consideration of passage of such ordinance at the request of Glascam Builders); 4. Hearing on proposed amendment to the City of Yakima Municipal Code, Chapter 12.56, Off- Street Parking and Loading Regulations; 5. Resolution authorizing execution of lease agreement for Yakima Municipal Airport Restaurant space; 6. Resolution authorizing termination of Lease Agreement with Robert Dunbar (Airport property); 7. Resolution authorizing execution of Lease Agreement with William Todd (Airport Property); Mayor Larson convened said special meeting at the•hour of 3:00 P.M. in the - .Council Chambers at City Hall in accordance with said notice and Councilmen Brazier, Kurbitz, Larson, Lynch and Robinson were present on roll call. Councilmen Lemon and Munger were absent and excused: City Manager Smith and City Attorney Andrews also present. The invocation was given by Councilman Kurbitz. An ordinance, appropriating $205,145.00 from the unappropriated money to be deposited in the newl3 created Sewer Construction Fund having been read in its entirety at the regular meeting of December 17, 1962 and laid on the table until this date, was read by title, "only at this meeting and'it was MOVED by Robinson, seconded by Lynch that Ordinance No. 404 providing for said appropriation, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch and Robinson'voting aye on roll call_. ORDINANCE NO. 404, AN ORDINANCE appropriating the sum of $205,145.00 from unappropriated money to be deposited in the Sewer Construction Fund of the City of Yakima to Account 6 -31, Constructi< and Other Improvements, of the Capital or Betterment classification of the 1963 appropriation for 58 -*Sewer Construction Fund. ' An ordinance, appropriating $2,700.00 to the City Garage Fund 1962 Budget having been read in its entirety at the regular meeting of December 17, 1962 and laid on the table until this date, was read-- by title only at this meeting and it was MOVED by Lynch, seconded by Kurbitz that Ordinance No. 405 providing for said appropriation, be passed as read: carried, Brazier, Kurbitz Larson, Lynch and Robinson voting aye on roll call. ORDINANCE NO. 405, AN ORDINANCE appropriating the sum of $2,700.00 from the unappropriated money: in the City Garage Fund to Account 7 -40', Automotive Maintenance & Operation, of the Maintenance & Operation classification of the 1962 appropriation for 34 —City Garage. This being the date fixed by the Council at their regular meeting of December 10, 1962 for the continuation of the hearing on Resolution No. D -472, being a resolution of intention to improve certain property by the construction of concrete curbs, gutters and the surfacing of certain streets and an ordinance providing for said improvements and creating L.I.D. No. 906 having been read at the regular meeting of November 26, 1962, and there being no one present wishingto pro- test said improvement, and Manager Smith having informed the Council that all matters concerning Mr. Lee Campbell and Glascam Builders and this district, have been cleared up, it was MOVED by Brazier, seconded by,Robinson that Ordinance No. 406 providing for said improvements and breating L.I.D. No. 906, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch and Robinson voting aye on roll call.. Lemon and Munger absent. ORDINANCE N0. 406, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutter, together with necessary drainage features; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. This being the -'time fixed by the City Council for the hearing on a proposed ordinance amending the zoning code 1,�aith regard to off- street parking, said action having been brought on by the Council through Resolution No. D -452, and the Planning Commission having mad.e'certain recommenda- tions after due hearing and consideration, it was MOVED by Robinson, seconded by Kurbitz that Ordinance No:-407 setting forth requirements for off - street parking facilities in residential zones and amending the Yakima Municipal Code, be passed as read:,' After 'discussion'of this ordinance, it was MOVED by`Lynch, seconded by Robinson that page 2, Section 2. be amended to, read 1112.56.110 OFF"STREET PARKING IN R -3 ZONE. Hereafter, any off - street parking facilities established in ancR -3 Zone, which adjacent lot is zoned other than R -1 or R -2, shall be developed in accordance with the following requirements: carried, Brazier, Kurbitz, Larson, Lynch and Robinson voting aye by voice vote. Lemon and Plunger absent. Roll call vote was then taken on. the pending motion as amended and Ordinance No. 407 providing for certain off- street parking regulations was passed: Brazier, Kurbitz, Larson,,Lynch and Robinson voting aye on roll call'. Lemon and Munger absent. ORDINANCE NO. 407, AN ORDINANCE setting forth requirements for off - street parking facilities in residential zones and on lots adjacent to residential zones; allowing the Board of adjustment to make certain exceptions'; and amending Section 12.56.100 and adding a new section to be known as Section 12.56.110, both of the City of Yakima Municipal Code. Mr.. Bob Paradis having notified Manager Smith that he does not wish to renew his existing lease with the City of Yakima for the operation of the Chateau at the Yakima Municipal Airport, and this being a matter of special notice to be considered at this meeting, and Manager Smith having informed the Council that final arrangements for a new lease have not been completed, it was MOVED by Lynch seconded by Brazier that the matter of a "Resolution authorizing execution of lease agreement for Yakima Municipal Airport Restaurant space" be continued until a future date: Nn I F, 90 SPECIAL MEETING, DECEMBER 28, 1962 IIcarried, Brazier, Kurbitz, Larson, Lynch and Robinson voting aye by voice vote. Lemon and Munger absent. Moved by Brazier, seconded by Robinson that Resolution No. D -496 authorizing the execution of a Lease Termination Agreement with Robert C. Dunbar, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch and Robinson voting aye on roll call. Lemon and Munger absent. Discussion pointed out that the original lease covers certain farm property located at the Yakima Municipal Airport. RESOLUTION NO. D -496, A RESOLUTION authorizing the City Manager and the City Clerk to-execute a Lease Termination Agreement with Robert C. Dunbar. Moved by Lynch, seconded by Kurbitz that Resolution No. D -497 authorizing the execution of a Farm Lease Agreement with William Todd, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch and Robinson voting aye on roll call. Lemon and Munger absent. Discussion pointed out that this is the same property located at the Airport and released by Resolution No. D -496. RESOLUTION NO. D -497, A RESOLUTION authorizing the City Manager-and the City Clerk of-the City of Yakima to enter into a Farm Lease Agreement with William Todd. The Council having concluded the items to be considered in accordance with the "Notice of Special Meeting" and wishing to consider the following items as prepared and submitted by the Manager and staff: 1. Petition No. 177 as filed by Everett J. Dickerman and others requesting L.I.D. for Curb, Gutter and Surfacing of Webster Avenue from South 38th Ave., to South 40th Ave., 2. Ordinance relating to public health. 3. Resolution authorizing extension of time for completion of performance of agreement by Cornell, Howland, Hayes and Merryfield. 4. Transferring $200.00 in 1962 Budget for Planning Department. 5. Engineer's report on completion of L.I.D's Nb. 892, 893, 894, 895, 896 and fixing date for hearing on Assessment Rolls as January 21, 1963, the evening meeting. 6. Engineer's estimates -for work performed on city projects during the month of December. it was MOVED by Brazier, seconded by Robinson that these matters be considered and determined by the City Council at this meeting: carried, Brazier, Kurbitz, Larson, Lynch, and Robinson voting aye by voice vote. ORDINANCE NO. 408, AN ORDINANCE relating to public health; prohibiting spitting anddischarge of body substances in public places and where food is prepared; and amending Section 4.04.465 of the City of Yakima Municipal Code. Moved by Robinson, seconded by Lynch that Resolution No. D -498 authorizing an extension of time for completion of performance of agreement by Cornell, Howland, Hayes and Merryfield to perform engineering services relating to a study of the City's sewerage system, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch and Robinson voting aye on roll call. Lemon and Munger absent. RESOLUTION NO. D -498, A RESOLUTION authorizing an extension of time for completion of perform - anide of agreement by Cornell, Howland, Hayes and Merryfield. Moved by Robinson, seconded by Brazier,that Resolution No. D -499 transferring $200.00 in the 1962 Budget for the Planning Department be passed as read: carried, Brazier, Kurbitz, Larson, Lynch and Robinson voting aye on roll call. Lemon and Munger absent. RESOLUTION NO. D -4991 A RESOLUTION transferring the sum of $200.00 within the 1962 appropriatio for 04 - Planning Department. The City Engineer reporting the completion of L.I.D. No. 892, the Lincoln - Sunset Arterial Paving District, L.I-:D. No. 893, the Westover Drive and Various Residential Street and Alleys Paving District, L.I.D. _No. 894, the S.2 Douglas Drive & N. Naches Avenue Paving District, L.I.D. No. 895, the South 44th Avenue and Arlington Street Paving District and L.I.D. No. 896, the Broadmoo #1 and Broadmoor #2 Paving District and having filed the assessment rolls for each district with the City Clerk, it -was MOVED by Brazier, seconded by Lynch that the engineers reports on these districts be accepted and approved and the City Clerk be and is hereby instructed to give notice of hearing on each Assessment Roll by publication and to each property owner in each district, for the hour of 8:00 P.M. on the 21st day of January, 1963: carried, Brazier, Kurbitz, Larson, Lynch and Robinson voting aye by voice vote.
