HomeMy WebLinkAbout12/17/1962 Business Meeting1 1 1 1 387 December 17 1962 In accordance with Ordinance No. 3$$, the first regular :evening meeting of the City Council was held on this date. The - Council convened at the hour of -8 P.M. with Mayor Larson, Councilmen Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson, City Manager'Smith and City Attorney Andrews present on roll call. Some 15 interested- citizens -were also present. The invocation was given by Councilman Lemon. The minutes of the regular meeting of December 10, 1962 were approved as read. In accordance with action taken by the City Council at their regular'meeting of December 10, 1962 matters concerning the Naches Tunnel were again brought on for consideration. Mr. Dick Hurd and Mrs. Marjorie McCormick members of the Tunnel Association answered questions as to the reports already available on this project and informed the Council that the latest report has not yet been received by the Association. The discussion of this matter pointed out that the.1960 report gives a feasibility figure of $8,000,000.00 for this construction;,that the Association is trying to get the Bonding Company to handle the project on a feasibflitti basis;' that this route is vital to Yakima as it provides a free access to this central area; that it'is costing $50,000.00 to up date the feasibility reports; that the association has been working some 20 years on this project; that it has become a State Highway project; that the Tunnel area has 1 /3'less snowfall than Snoqualmie since the elevation is only 3,600 feet; that it is not expected that this highway will in anyway interfere with the improvement of the Ellensburg highway; that more interest was created when products grown in the State began to move by water into Oregon; that this highway will serve 50% of the population of the State; that Seattle and Tacoma are now supporting the Association and. that the tunnel' is planned as a 2 lane highway. Mr. Art Waters, operator of Motel 97, stressed that this project will not interfere with the improvement of the Ellensburg highway since it is now the No. 1 project in the States improvement plans., Mr. Earl Woodruff, interested citizen, stated that some item of construction should be cheaper now due to the improvement of equipment over the years. Councilman Lynch stressed the fact that he is not against any project that will help Yakima grow but that he-is concerned as to how the Council's action on this matter, might be used. Mr. Todd Smith, 1962 President of the Chamber of Commerce urged the Council to support the Association. All persons having been heard and upon the request of Councilman Lynch, the Clerk of the Council reread the resolution and it was again MOVED by Robinson, seconded by Kurbitz that Resolution No. D -490 endorsing in principle the development of a Naches Pass Tunnel Highway provided the same is economically feasible, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger, and Robinson voting aye on roll call. This being the time fixed by the City Council for the hearing on Petition No. 173 as filed by Albert J. Miller requesting the vacation of certain property abutting on Clinton Avenue,.. and there being no protests in writing or otherwise, it was MOVED by Lynch, seconded by Munger that Ordinance No. 400 providing for the vacation of said property, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. ORDINANCE NO. 4001 AN ORDINANCE providing for the vacation of the West 20 feet of the North 145 feet of Block °2, Shannon Homes Addition to the City of Yakima, according to the plat thereof recorded in Volume "H" of Plats, page 31, records of Yakima County, Washington. This being the time fixed by the City Council for the hearing on Council action to vacate certain property abutting on Clint. Avenue, and °there being no protests in writing or otherwise to said action, it was MOVED by Munger, seconded by Lemon that Ordinance No. 401 providing for said vacation, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinsoi voting aye on roll call.;/Mr. Paul Anderson, owner of adjacent property, expressed approval and appreciation for this.action. ' ORDINANCE-NO. 401, AN ORDINANCE providing for the vacation of the West 20 feet of the South 145 feet of Block 2, Shannon Homes Addition to the City of Yakima, according to the plat thereof re- corded in Volume "H" of Plats, page 31, records of Yakima County, Washington. In accordance -with action taken by the City Council at their regular meeting of December 10, 1962 with regard to a Notice to Commence Annexation Proceedings as filed by Mr. A. E. Clift, this matter was again brought on for consideration. Mr. Clift and Mr. Howard Hettinger, attorney representing the property owner and Mr. Clift, being present at this meeting, Council members discussed matters of taxation and annexation procedures with Mr. Hettinger. It having been de- termined that the property to be annexed is less than 10 acres and under $200,000.00 valuation thus making it unnecessary to convene the Review Board as specified by statue and that a formal Power of Attorney for Mr. Clift is now on file with the City of Yakima, it was MOVED by Brazier, seconded by Lynch that the property described in said Notice of Intention, will be accepted for annexation, that the owners of said property will be required to assume the City's existing indebtedness and that, upon the filing of a petition praying for said annexation, it be referred to the Planning Commission for study and recommendation on the matters of zoning: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. An ordinance appropriating $205,145.00 from t�,ee nappropriated money to be deposited in.the newly created Sewer Construction Fund to the 1963 io� ewer improvements, having been read inits enti.rei was ordered laid on the table until the special meeting of the Council on December 28, 1962. An- ordinance appropriating $2,700.00 to the City Garage 1962 Budget having been read in its en- tirety, was ordered laid on the table until the special meeting of the Council on December 28, 1962. An ordinance relating to building regulations and adopting by reference the Western Plumbing` Officials Uniform Heating & Comfort Cooling Code, 1962 Edition, and making certain amendments thereto, having been read, it ,was MOVED 'by.. Leemon; seconded by Munger that said ordinance be passe( as read. 'Council members discussed this ordinance with Mr. Charles Mc Coy, Building Inspector and Mr.. Robert Leichnitz, a member of the Plumbers Examining Board and Pete Moore, Fire Chief, who explained their problems as to installation of air conditioning and the overloading of elec-- trical circuits.. Discussion pointed out that this ordinance will take certain inspection duties from the Fire Department and place them with the Inspection Department and - includes, for the first time, regulations for the installation of air conditioners. After discussing the fee schedule for permits, it was MOVED by Robinson, seconded by Brazier that page 3 of the ordinance read be amended and that under. "Air Conditioning, the last item be'changed to read "Evaporative coolers other than portable collers $1.00 ":' carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. A roll call vote was then taken on the pending motion to pass Ordinance No. 402 as amended and it carried: Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. J r 388 DECEMBER 17, 1962 ORDINANCE NO. 402, AN ORDINANCE relating to building regulations; adopting by reference the Western Plumbing Officials Uniform Heating & Comfort Cooling Code, 1962 Edition, of the Western Plumbing Officials Association, and making amendments thereto; providing for the issuance and revocation of installer's license; requiring installer's surety bond and insurance; adopting a permit fee schedule; ,declaring violations to be misdemeanors and providing a penalty; and amendi Chapter 11.32 of the City of Yakima Municipal Code. Moved by Robinson, seconded by Munger that Ordinance No. 403 relating to fire prevention and adopting by reference the Fire Prevention Code of 1960 of the National Board of Fire Underwriters be passed as read: carried, Br_�zier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. ORDINANCE N0. 403, AN ORDINANCE relating to fire prevention; adopting by reference the Fire Prevention Code, Edition of 1960, of the National Board of Fire Underwriters, and making amendmen thereto; establishing a Bureau of Fire Prevention, and prescribing its duties; defining terms; an repealing Chapters 10.04,, 10.12, 10.16 and 10.28, and creating Chapter 10.05, all of the City of Yakima Municipal Code. Moved by Lynch, seconded by Munger that Resolution No. D -491 requesting planning assistance from State Department of-Commerce and Economic Development for the purpose of carrying out a planning Program, b'e passed as read: carried, Brazier, Larson, Lynch, Munger and Robinson voting aye on roll call. Kurbitz and Lemon voting nay on roll call. Councilman Brazier explained that he is against the principle of using Federal Funds but since the Council has elected in the past to make application for these funds, he is voting for the resolution.. Councilman Kurbitz explained that he is not in favor of encouraging the use of federal funds. RESOLUTION NO. D -491, A RESOLUTION requesting planning assistance from the..State Department of Commerce and Economic Development and authorizing the City Manager of the City of Yakima to carry out a Planning Program. Moved by Lemon, seconded by Munger that Resolution No.' D -492 authorizing the execution of an agreement with Book Publishing Company for maintenance of and supplement service to the City of Yakima Municipal Code, be passed as read: carried,%Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call.. Kurbitz voting anylon roll call and explaining that this actioi make it impossible to negotiate with any one else for this service. RESOLUTION NO. D -4929 A RESOLUTION authorizing the City Manager and the City Clerk to execute an Agreement with Book Publishing Company. Moved by Robinson, seconded by Munger that Resolution No. D -493, , being a resolution of intention to improve certain property by the construction of water mains anc other appurtenances as requested on Petition No. 174 and filed by'Ronald'Poole, and fixing the date of hearing on said :..matter. for the 7th-day of January, 1963, be passed as read: carried Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call RESOLUTION NO. D -4932 A RESOLUTION of intention to create a Local Improvement District. Moved by Lynch, seconded by Munger that Resolution No. D -494, being a resolution of intention to improve certain property by the construction of pipe sewers as requested by Petition No. 175 and filed by Ronald Poole and fixing; the date of hearing on said matter for the 7th day of January, 1963, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. RESOLUTION NO. D -494, A RESOLU'T'ION of intention to create a local improvement district. Moved by Munger, seconded by Robinson that Resolution No. D -495 transferring funds within the 196 Budget for the Police Department, and Municipal Garbage Department, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll_ call. RESOLUTION-NO. D 495, A RESOLUTION transferring funds within the 1962 appropriations for 21 - Police Department, and 32 - Municipal Garbage." Councilman Munger requested a Quarterly report.-,.on current Capital Outlay expenditures. The Council wishing to express sympathy to Mr. Tom Heuterman, news reporter covering City Hall, on the passing of his father, it was MOVED by Brazier, seconded by Munger.that the 'Clay Council— by resolution; extend•condolences:.to Mr:.. Heuterman: :tarried, Brazier, Kurbitz, Larson, Lemon,,Lynch, M nger and Robinson voting aye by voice vote. fD Manager Smith called attention to the Notice of Special Council Meeting to be held on Friday, December 2$,-1962. He also requested the Council to authorize the staff to proceed with the necessary steps to issue $1,000,000.00 General Obligation Bonds in accordance with the $:2600,000.00 improvement bond issue °passed by the vote of the people in November, 1962, explaining that the capital improvements planned will be made on interim financing. This matter was discussed and it was MOVED by Lynch, seconded by Lemon that the City Manager and staff proceed to bring before the Council such legislation and information as is necessary for the issuance of $1,000,000.00 General Obligation Bonds: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Manager Smith also informed the Council that there is no change in the circumstances surrounding the acquiring of the Sam Christoff property for the SE Clear Zone at the Airport.. Councilman Lynch also related that he has met with Mr. Christoff and has made no headway on the matter. After discussing this matter, it was MOVED by Brazier, seconded by Robinson that the City Attorney be and is hereby instructed to commence condemnation proceedings as authorized by Resolution No. D -376 to acquire the Christoff property for the SE Clear Zone and the Christoff route for the relocation of 16th Avenue: carried, Brazier, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Kurbitz voting nay on roll call and suggesting that the Council consider leasing the Christoff property. No further action was taken on this matter. There being no further business to come before the Council, Brazier, that we do now adjourn at the hour of 11:.20 P.M: Lemon, Lynch, Munger and Robinson voting aye by voice vote.
