November 13, 1962
November 12, 1962, being Veterans Day and a legal holiday, the regular meeting of the City Council
was held on this date. Councilmen Kurbitz, Larson, Lemon, Munger and Robinson, City Manager Smith
and City Attorney Andrews present; on roll call. Councilmen Brazier and Lynch absent and excused.
Councilman Kurbitz gave the invocation.
The minutes of the regular meeting of November 5, 1962 were approved as read.
In accordance with action taken by the Cn,an.cil at their regular meeting of November 5, 1962, the
matter of a damage claim as,filed by John Edinger, Sr., was continued. Mana -er Smith advised that
Mrs. Libby is unable to attend this meeting as planned because her children have the mumps.and
recommended that the Council continue this matter until such time as she can attend a Council_
meeting. It was then MOVED by Lemon, seconded by Robinson that this matter be continued until
such time as Mrs. Libby can appear: carried, Kurbitz, Larson, Lemon, Munger. and Robinson voting
ave by voice vote. Brazier and Lynch absent. /Henry Luckett, the retired Water Department employe
who turned the water on at 721 West Lenox Avenue, being present, was questioned by Council members
as to this incident. Mr. Luckett related that when he arrived at this address,Mr. and Mrs. Libby
were in the driveway and that when he went to Mr. Edinger's home -to tell him that the water was
turned on, Mrs. Edinger told him that her husband was out back and directed him to leave the water
on. In answer to Councilman Kurbitz's inquiry, Mr. Luckett related that it was standard practice
to turn the water on and leave it if the water meter did not show activity, but if the meter con-
tinued to register,, he would then turn it off and leave a notice for the occupant. He also ex-
plained that most houses have a shut -off valve which protects the property. In answer to Council-
man Robinson's inquiry Mr. Luckett stated that it was only a matter of seconds after the water was
turned on until he informed Mrs. Edinger. Mr. Dave Hoge, Water Department Office Manager, further
explained {:'dater Department practices stating that if there is no activity at the meter it is
customary to leave the water on v,ithout contacting the property owner or renter, but if there is
activity at the meter a not,_is then left for the person concerned and the water is not turned on.
Manager Smith emphasized the value of a shut -off valve to protect-both the �Ii_ty and the property
owner. Mr. Edinger also being- present, questioned Mr. Luckett's statement that there was no a
activity at the meter since there is no shut -off valve on this property. Al]_ persons having
been heard, Council members main expressed desire to discuss this matter with Mrs. Libby. No
further action was taken.
Petition No. 172 requesting the paving of East "I" Street from 4th Street to Naches Avenue includ-
,� ing acquisition of right -of -way, having been filed with the City Clerk on November 6, 1962 by Ben
C. Furman and others, it was MOVED by Robinson, seconded by Munger that said petition be referred
to the staff for study and recommendation: carried, Kurbitz, Larson, Lemon, Munger and Robinson
voting ave by voice vote.
Moved by Lemon, seconded by Munger that Resolution No. D -475 authorizing the execution of a Lease
Modification Agreement with Firestone Tire & Rubber Company to lease the entire Old City Police
Station located at 10 East Walnut Street, be passed as read: carried, Kurbitz, Larson, Lemon,
Munger and Robinson voting aye on roll call. Brazier and Lynch absent. Discussion of this matter
disclosed that Firestone now leases the basement area of the Old Police Station for dead storage
of tires and now wishes to rent the balance of the building for storage in connection with their
operation of the Yakima Valley Firestone Store at 1409 South lst St.,'Councilman Munger suggested
that the load bearing capacity of the second floor be determined and this information posted in
the building as notice to this renter. In answer to Councilman Kurbitz's inquiry as to renting to
government agencies, Manager Smith advised that an attempt has been made to rent to said agencies,
but that the building does not meet government specifications and that some $1500.00 will be neede
to put the heating plant in working order. He further advised that Firestone will have a small
office in the building which will be heated by electric heater.

ESOLUTION NO. D -477, fixing the time and place for hearing by the City Council on the rezone
pnlication of Howard F.,Farnswo-rth and Lee F. Farnsworth, husband and wife.
ouncilman Kurbitz then introduced, for discussion, the matter of the Airport Clear Zone and the.
relocation of 16th Avenue. He proposed the installation of stop and go lights instead of the
elocation of 16th Avenue and suggested that we utilize the lights removed from other areasfor
his purpose.. He further related that Mr. John Christoff, the son of Mr. Sam Christoff, owner of
ertain property needed for the SE Clear Zone, has talked,recently, S „Ti_th F.A.A. officials who have
ntimated that if satisfactory safety lights or gates can be installed at this point, it will not
e necessary to relocate 16th Avenue. Manager Imith explained that this idea has been explored on
different occassions and that the F.A.A. has answered categorically "No” on this point. Council
an Kurbitz emphasized that if a hazzard and possible liability in this matter exists, something
hould be done about it now and MOVED that the Council resolve to erect stop and .go signals on
6th Avenue at the end of runway 27. Councilman Lemon seconded this motion but no vote was taken
t this time.. Councilman Robinson explained that the F.A.A. has been emphatic in this matter in
he past and suggested that Manager Smith check with this agency to determine whether or not there
as been a change in their decision and then MOVED to continue this matter for one week or until
he regular meeting of November 19, 1962. This motion was seconded by Councilman Munger and
ouncilmen Kurbitz, Larson, Lemon, Munger and Robinson voted ave by voice vote. Brazier and Lynch
bsent. Mr. John Christoff, having arrived late at this meeting, was questioned by members of the
ouncil and he related that F.A.A. officials have indicated to him that if the city would install
rop arm signals such as are used at railroad crossings, that it will not be necessary to lower

the streets at this point or lower 16th Avenue and he also indicated that F.A.A. would allow
these signals to be operated from the Traffic Control Tower. Council again discussed the matter
of securing Mr. Christoff's property by easement for the Clear Zone and Manager Smith explained
that,it has been determined that this can be done but that the cost is almost as great as acquiri.r

Manager Smith reported that bids have been received for the construction of the Washington Avenue
Interceptor Sewer and that said bids must now be submitted to the Public Health Service officials
in San Francisco for approval and that it will be a couple of weeks before the award can be made.
He also reported that the leaf pickup program is starting on this date.
There being no further business to come before t-he Council, it was MOVED by Kurbitz, seconded
by Lemon that we do now adjourn, at the hour of 4:30 P.M: carried, Kurbitz, Larson., Lemon, Munger
and Robinson voting aye by voice vote. Brazier and Lynch absent.
