HomeMy WebLinkAbout10/22/1962 Business Meeting77 �J Seconded b 1 369 OCTOBER. 22, 1962 The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Larson, Lemont Lynch, Munger and Robinson, City Manager,Smith and City Attorney Andrews present on roll call. The invocation was given by Councilman Lemon. In order that the Council might hear President Kennedy's speech concerning emergency actions to be taken in the Cuban situation, Mayor Larson called the meeting to order a few minutes early and it was MOVED by Brazier,: seconded by Kurbitz that we do now recess for this.purpose: carried Brazier, Kurbitz, Larson, Lemon, Lynch, Munger. and Robinson voting aye by voice vote. At the hour of 3:20 the Council proceded with the business at hand. The minutes of the regular meeting of October 15, 1962 were approved as read. Mr. Michael A`: Polo having filed an appeal from the decision of the Planning'Commission in con- nection with Petition No. 167.which requests the rezoning of certain property located at 201 Hall Avenue from R -3, Multiple Family Dwellings to B -2, Local Business Zone, it was MOVED by Robinson, .9REt said appeal be received and that the date for public hearing on this matter be fixed for the 5th day of November, 1962: carried, Brazier, Kurbitz, Larson., Lemon, Lynch, Munger and Robinson voting aye by voice vote. In accordance with action taken by the Council at their regular meeting of October 15, 1962, it was MOVED by Lynch, seconded by Lemon that Ordinance No. 3$$ providing that one regular meeting of the City Council shall be held on the thrid Monday of each month at the hour of 8:00 P.M., be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll calla ORDINANCE NO. 3$$1 AN ORDIIIJA NCE specifying the day and hour of regular meetings of the City Council of the City of Yakima, 'and amending Section 1.06.010 of the City of Yakima Municipal Code, This being the time fixed for the hearing; on Petition No. 169 as filed by John Fairbrook and others praying for the annexation of certain property west of the present city limits to 44th Avenue between Summitview and Chestnut and the chairman of the Board of County Commissioners, Lee Crossen and the Superintendent of Schools, A. W. Allen, having boncurred in writing,with Mayor Larson that it is not necessary to convene the entire Review Board for the annexation of the approximate 5 acres covered by Petition No. 169, and there being no protests in writing or otherwise to said annexation, it was MOVED by Lemon, seconded by Robinson that Ordinance No. 389 providing for the annexation of said property and requiring the property owners to assume the existing indebtednesses of the City of Yakima, be passed as read:' carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. ORDINANCE NO. 389, AN ORDINANCE providing for the annexation by the `'ity. of Yakima, Washington, of certain property contiguous to the City of Yakima. Moved by Munger, seconded by Lynch that Resolution No. D -463 authorizing the execution of an agreement with the Old Union Ditch Company with regard to responsibility and liability with re- spect to the maintenance and operation of pipe and fencing constructed by the City of Yakima to enclose and protect portions of the Old Union Ditch and wasteway owned by the Pacific Power & Light Company, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. RESOLUTION NO. D -463, A RESOLUTION authorizing the City Manager and the City Clerk to enter into an agreement with Old Union Ditch Company. Moved bir Brazier, seconded by Kurbitz _that Resolution No. D -464 authorizing the execution of an agreement with Pacific Power & Light Company with regard to responsibility and liability with respect to the maintenance and operation of certain pipe and fencing constructed by the City of Yakima to enclose and protect portions of the Old Union Ditch and the wasteway owned by Pacific Power & Light Company, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. RESOLUTION NO. D -4642 A RESOLUTION authorizing the City Manager and the City Clerk to enter into an agreement with Pacific Power & Light Company. Councilman Kurbitz inquired as to the status of the matter of obtaining certain property from Sam Christoff and Joe Wong for the Clear Zone at the Yakima Municipal Airport and in discussing this matter intimated that the property owned by Sam Christoff could probably be obtained by paying for some four or five rows of trees which would have to be removed, rather than resorting - to a condemnation suit. He:�;further suggested that since there is no immediate emergency that this project be set aside 'until next year. He- compared.._aj.G travel with the railroad stating that trains haul passengers three to one.and further stating he is not against the improvement of the airport and suggested that our timing is bad and that we should proceed slowly, reviewing the situation and perhaps meet again with the FAA representatives before resorting to court action. He also questioned the advisability of relocating 16th Avenue contending that this will not save lives, further pointing out that the lighting set up presents more of a hazzard than the fencing. Councilman Munger pointed out that the fence has been clipped a couple of times by planes landing. Upon the suggestion of Councilman Robinson Manager Smith reviewed our commitment, with the federal government relating that in 1956 the city voluntarily agreed to acquire the clear zone property by October 1961, a deadline now one year past. He also explained that no further federal aid will be available until this commitment is met.according to the F.A.A. Councilman Lynch pointed out that this improvement is not to extend runways and that 16th Avenue is dangerous as it is and. t'bat he would be derelict in his duty if, after having expert advise . nothing is done about it and lives are taken in an airliner accident. He further explained that the city has not done all it can do since it still has condemnation. Councilman Robinson stated that he is not hopeful of obtaining the necessary property any easier in the future and that he is not willing to run the risk of accident hazzard or losing the possibility of obtaining immediate federal funds in case of emergency repairs or the need for future development program. He further explained that the purpose of relocating 16th Avenue to the east is to remove the possi_bilit�r of low flying aircraft striking_; vehicles. No formal action was taken on this matter at this time.
