ROLL CALL Present: • Council: Mayor Mary Place, presiding, Council Members Clarence Barnett, Henry Beauchamp (after 7:58 a.m.), Lynn Buchanan, John Puccinelli, and Bernard Sims Staff: City Manager Zais, Assistant City Attorney Peterson, Bill Cook, Director of Community and Economic Development, Doug Maples, Code Administration and Planning Manager, Linda Rossignol and Royale Schneider, Code Administration Division, and City Clerk Roberts CRB: Community Review Board Members John Hopwood, Steve Emhoff, • Jerry Henderson, Greg Bohn and Ron Bonlender Absent: Council Member Larry Mattson (excused) 2. REVIEW OF THE COMMUNITY REVIEW BOARD Doug Maples Discusses Purpose of Meeting Doug Maples stated that we are here to discuss Chapter 11.10 of the Yakima Municipal Code that established the Community Review Board and outlines its function and responsibilities. While the ordinance is providing the means to make an impact on the cleanliness of the targeted area, staff would like to obtain Council's direction to refine and clarify provisions in the ordinance. He reported that nearly 100 cases have been presented to the Board resulting in 100% abatement of the violations. Staff Reviews the with Council Council reviewed the ordinance, focusing on: • the collection of fees • power -to -enter • proper grammar and consistency of terminology in the ordinance • definitions (Council Member Beauchamp present after 7:58 a.m.) Council also discussed: • penalties for violation of this ordinance • boarded up buildings (mothballing) • 234 JUNE 19, 2001 - ADJOURNED MEETING /STUDY SESSION • gender terminology (he /she or their) • promulgation of rules and regulations (11.10.150) • demolition or repair of building (11.10.220) • security of unoccupied buildings (11.10.230) • requirement of tenant's permission to enter when property owner signs Voluntary Correction Agreement • necessity for warrant to enter property or waiver of right to refuse entry if Voluntary Correction Agreement has been signed • procedure for handling subsequent violations if discovered while investigating original violation • what constitutes a repeat offender (line 116) Amendments Requested by Council During the discussion of the above listed topics, Council gave the following directions: • do not change the gender terminology in the ordinance • Section 11.10.150 — change rules and regulations to rules and procedures • Section 11.10.220 — reconcile standards for requiring demolition of building to those standards contained in the Urban Area Zoning Ordinance process • Section 11.10.310 - If a subsequent violation is discovered during an inspection, then a new violation process is started for the subsequent violation — 9(c) change the any illegal condition back to the illegal condition • • Section 11.10.330 (f) - even if an individual has signed a voluntary correction agreement and the individual asks staff to leave the property, then staff would leave and obtain a court order to enter the property • Section 11.10.400 (d)(6) add or Hearing Examiner • provide a flow chart of the process followed and forms used in this process • Add a definition for appeal decision -maker 3.
