The City Council met in regular session, Mayor Larson, Councilmen Kurbitz, Larson, Lemon, Lynch,
Munger and Robinson, City Manager Smith and City Attorney Andrews present-on roll call.
Councilman Brazier absent and excused.
Councilman Lynch gave the invocation.
The minutes of the regular meeting of October 8, 1962 were approved as read.
In accordance with action taken by the Council at their regular meeting of October 8, 1962, a
resolution authorizing the execution of a revised agreement with the Yakima County Rural Library
was read by the Clerk of the Council and it was MOVED by Lynch, seconded by Munger that
Resolution No. D -461 providing for said agreement and its execution,,be passed as read: carried,
Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Brazier absent.
RESOLUTION NO. D -461, A RESOLUTION authorizing the Uity Manager and the "-%i.ty Clerk to execute a
Revised Agreement with Yakima County Rural Library District for a regional library.
An order fixing the date of hearing on Petition No. 169 as filed by'John Fairbrook and others
praying for the annexation of certain property west of the present city limits to 44th Avenue
between Summitview and Chestnut, having been approved at the regular meeting of the City Council
on October 8, 1962 and an erroneous legal description of the property having been used on said
order, it was MOVED by Munger, seconded by Lemon that the order correcting said description and
fixing the date of public hearing on said petition for the 22nd day of October, 1962, be Tproved
as read: carried Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call.
Brazier absent. / The Council wishing to clarify all action on Petition No. 169 then considered
the matter of zoning in connection with this petition and it was MOVED by Lemon, seconded by
Robinson that said petition be referred to the Planning Commission for study and recommendation:
carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Brazier
absent.
The City Council desiring to vacate the alley between 9th and 10th Avenues and Walnut and Chestnut
and this being the time fixed by Resolution No. D -451 for the public hearing on'said matter,
Councilman Ro'inson explained that St. Elizabeth's Hospital now occupys this property and that in
preparing -for the new construction and expansion of said hospital_, it h-as been established that
title to said property has never been obtained by those who operate the hospital. He further
explained that there are no utilities on the property. There being no protests in writing or
otherwise to said vacation, it was MOVED,by Robinson, seconded by Munger that Ordinance No. 3$4
providing for said vacation, be passed as read: carried, Kurbitz, Larson, Lemon, Lynch, Munger
and Robinson voting aye on roll call. Brazier absent.
ORDINANCE NO. 3$4, AN ORDINANCE providing for the vacation of the South 50 feet of the public
alley adjacent to Lots 8 and 9, Block 2, Heermans Addition to North Yakima, now Yakima, Washingtoi
also known as the South 50 feet of the public alley adjacent to Lots 8 and 9, Block 372, Yordy's
Supplemental Addition to Capitol Addition to North Yakima, now Yakima, Washington.
Moved by Kurbitz, seconded by Lemon that Ordinance No. 385 eliminating certain real property owner
by the City of Yakima from irrigation maintenance charges as set forth in L.I.D. No. 308, be
passed as read: carried Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll
call. Brazier absent . /6iscussion of the motion established that this property is located between
East Washington Street and Lenox Avenue on 6th Street.
ORDINANCE NO. 385, AN ORDINANCE eliminating certain real property owned by the City of Yakima
from irrigation maintenance Charges of Local Improvement District No. 308.
Moved by Robinson, seconded by Kurbitz that Ordinance No. 386 placing certain parcels of real
property in the city on the irrigation maintenance roll for L.I.D. No. 661, be passed as read:
carried, Kurbitz,•Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Brazier
absent. Discussion of the motion established that this is the property on Garret Street recently
sold by the City to Mrs. Margaret Dahlke and Andrews Mastel in accordance with Resolutiom No.
D -420 and D -421.
ORDINANCE NO. 386, AN ORDINANCE placing certain parcels of real property in the City of Yakima
on the Irri,(;ation Maintenance Roll of Local Improvement District No. 661.
Moved by Robinson, seconded by Lemon that Resolution. No. D -462 transferring °125.00 within the
1962 Budget for Legal Department, be passed as read: carried, Kurbitz, Larson, Lemon, Lynch)
Munger and Robinson voting aye on roll call. Brazier absent.
RESOLUTION NO. D -4625 A RESOLUTION transferring the sum of $125.00 within the 1962 appropriation
for 14 - Legal Department.
Mr. Bill Ellis of 1704 South 14th Avenue, being present,- requested the Council to consider iiith
the County, the matter of repairing Mead Avenue, explaining that chuck holes in this street
are bad.:.He'also protested the 4 way stop and go signal at Broadway Md Mead Avenue. Public
works Director May explained that Mead Avenue is included in the 6 year plan for improving street
and suggested that perhaps the Council would like to review the 6 year plan and reconsider the
matter.of priority for repairing Mead Avenue. He further explained that the signal light at
Broadway and Mead will be 'changed.
In accordance ,',rith the Council's request, Manager Smith reported that it would appear that the
3rd Monday in the month will be the best date for an evening Council. meeting. It was then
MOVED by Robinson, seconded by Lynch that the City Manager and staff. prepare the appropriate
ordinance providing for a regular Council meeting to be held on the 3rd Monday in each month at
the hour of 8:00 P.M: carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by
voice vote. Brazier absent.
In accordance with a request made by Councilman Lynch, it was MOVED by Lynch, seconded by Kurbitz
that Ordinance Igo. 387 amending Ordinance No. 357 prohibiting hazardous activities in public
parks and playgrounds, be passed as read by Councilman Robinson: carried, Kurbitz, Larson, Lemon
Lynch, Munger and Robinson voting aye on roll call. Brazier absent.
ORDINANCE NO. 387, AN ORDINANCE prohibiting hazardous activities in public parks and playgrounds
making exceptions thereto; and amending Section 13.16.145 of the City of Yakima Municipal Code.

There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by
Robinson that we do now adjourn at the hour of 4:30 P.-M: carried, Kurbitz, Larson, Lemon, Lynch,
Munger and Robinson voting ave by voice vote. Brazier.
