HomeMy WebLinkAbout10/01/1962 Business Meetingr 360 OCTOBER 1, 1962 The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lemon, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman Munger absent and excused. The invocation was given by Councilman Brazier. The minutes of the regular meeting of September 27, 1962 were approved as read. lIn accordance with action taken by the Council at their regular meeting of Septemt -:er 27, 1962, it was MOVED by Lemon, seconded by Robinson that Resolution No. D -455 authorizing a temporary loan- of $45,796.00 from the Cumulative Reserve for Domestic Water Supply Development Fund to the Cumulative Reserve for Domestic Water Sunnly Development Fund Municipal Garbage Fund, be passed as read: carried, Larson, Lynch and Robinson voting aye on roll'call. Kurbitz and'Lemo•n voting nay on roll call. Councilman Brazier temporarily absent to answer ,a long distance telephon call and Munger absent from this meeting. In the discussion of the motion, Councilman Kurbitz explained that he voted against the resolution because he can not make up his mind as to whether or not this service should be rendered by the �;ity or a private hauler. Councilman Lemon then indicated that he would like to reconsider the matter of a private contractor taking on this service. Councilman Lynch speaking in favor of the motion explained that it could be assumed that if this service is turned over to a private hauler, that one of the conditions of the franchise would be that the 'contractor take over all of the City's equipment, both old and new. Manager Smith explained that this money is to be spent for three new packer trucks, that this item has been included in the City Budget for the past three years and that instead of making a lease pur- chase as originally planned, he is recommending this method of purchase aeNe cheaper way for the city. He further explained in the discussion of city service vs private contractor that the Council made a study of this matter in 1961 and had, after due consideration, voted in favor of th City continuing this service. He also explained that there are only three manufacturers of this type of equipment, namely, Truck Welding & Equipment Company, Totem Equipment Company and Garwood Manufacturing Company, all firms located in Seattle, and that Truck Welding and Totem Equipment have submitted bids of which Truck Welding is the low bidder and that one of the conditions of this bid is that the City make it's commitment to purchase not later than 5:00 P.M. on this date, October 1, 1962. RESOLUTION NO. D -455, A RESOLUTION authorizing a temporary loan of $45,796.00 from the Cumulative Reserve for Domestic Water Supply Development Fu,.d to the Municipal Garbage Fund, and providing for repayment. An ordinance appropriating the sum of $45,796.00 as provided for in Resolution No. D -455, to the 1962 Budget for the Municipal Garbage Fund,, having been read in its entirety, was ordered laid on the table for one week to be read and considered by the Council at their regular meeting of October 8, 1962. Due to the discussion and the vote cast for and against Resolution No. D -455 and it being necessary to have one more than. a. majority vote to pass this ordinance and Councilman Brazier having returned to this meeting,JMayor Larson requested that another roll call vote be taken on the motion:to pass Resolution No. D -455. There was no objection to this procedure by Council,-members and the motion passed the second time: Brazier, Larson, Lemon, Lvnch and Robinson voting; aye on roll call and Kurbitz voting; nay, Munger absent. Councilman Lemon then qualified his vote stating that he does not wish to hold up procedure and understanding that the city's equipment would be taken over by a private contractor he is voting for the resolution and asking the council to reconsider the matter of giving this service to a private hauler. Manager Smith indicating that he does not wish to go ahead with this purchase Tfrithout�-assurance of the passage of the ordinance appropriating the money to the 1962 Budget, it was MOVED by Robinson, seconded by Brazier that the City Manager be and is hereby directed to place the order for the three packer trucks: carried, Brazier, Larson, Lemon., Lynch, and Robinson voting aye on roll call. Kurbitz voting nay on roll call and Munger absent. The next item of business on the agenda being the hearing on the 1963 Budget, it was MOVED by Lynch, seconded by Lemon that the Council deviate from the regular order of business and open the hearing on the 1963 budget as the last item of business: carried, Brazier, Klarbitz, Larson, Lemon Lynch and Robinson voting; aye by voice vote. Munger absent. Petition No. 166 having been filed with the City Clerk on September 14, 1962 by Robert J. Schoenga: and others requesting the formation of a local improvement district for the improvement of South 31st Avenue by the construction of curbs, gutters and the surfacing of said street, it was MOVED by Lynch, seconded by Kurbitz that said petition be referred to the City Manager and staff for study and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting ave by voice vote. Munger absent. Petition No. 167 having been filed with the CityClerk on September 25, 1962 requesting the rezoni of property located at 201 Hall Avenue from R -3, Multiple- Family Dwellings to B -2, Local Business zone, it was MOVED by Robinson, seconded by Lynch that said pdition be referred to the Planning Commission for study and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye by voice vote. Munger absent. Petition No. 168 having; been filed with the City Clerk on the 27th day of,September, 1962 by C. L. Shelton for Eden House Nursing Home, Inc., and others requesting; the formation of a local improvement district for the construction of water mains and other appurtenances, it was MOVED by Brazier, seconded by Lynch that said petition be referred to the City Manager and staff for studv and recommendation, carried: Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting; aye by voice vote. Munger absent. Moved by Lynch, seconded by Lemon that Ordinance No. 379 relating to libraries, providing for the appointment of a Yakima Public Library Board of Trustees and amending the Yakima Municipal Code, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye on roll call. Munger absent. ORDINANCE NO. 379, AN ORDINANCE relating; to libraries; providing for the appointment of a Yakima Public Library Board of Trustees; authorizing the creating; of,a regional library; and amending Sections 7.44.020 and .030, and repealing Sections 7.44.040, .050 and .060 all "of the City of Yakima Municipal Code. An ordinance appropriating $41,608.00 from the unappropriated moneys in the Arterial Street Fund to the 1962 Budget for said Fund, having been read by the Clerk of the Council, was ordered laid on the table for one week to be read and considered by the Council at their next regular meeting on October 8, 1962. nth 1 1 1 1 1 OCTOBER 1, 1962 The next item of business being a resolution authorizing the execution of a revised agreement with the Yakima County Rural Library District for a Regional Library, Councilman Robinson pointed out that-:there is a matter of appointing members to the Board of Trustees of the Regional Library to be considered and MOVED that this resolution be set aside for one week or until Octobe 8, 1962. This motion was seconded by Councilman Lynch and was carried: Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye by voice vote. Munger absent. Moved by Robinson, seconded by Kurbitz that Resolution No. D -456 authorizing payment of $7.54 to Mrs. Anna Tanpe for damages resulting from a sewer backup, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, and Robinson voting aye on roll call. Munger absent. Discussion pointed out that this is one half of the amount claimed by Mrs Tappe. RESOLUTION NO. D -J56, A RESOLUTION authorizing the payment of $7.54 to Mrs. Anna Tappe. Moved by brazier, seconded by Kurbitz that Resolution No. D -457 denying payment of a claim for damages as filed by Andre' P. Charvet, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye on roll call. Munger absent. In discussion of this motion City Attorney Andrews explained that this claim as filed is so speculative he is recom- mending its denial and Councilman Robinson suggested that persons who, have filed claims against the city be notified as to the time and date said claim is to come before the Council for con- sideration in order that they may be heard. RESOLUTION NO. D -457, A RESOLUTION denying payment of a Claim for Damages filed against the City of Yakima by Andre' P. Charvet. Moved by Lynch, seconded by Brazier that the resolutions authorizing the execution of leases with Leroy Schreiner and with Leon Z. Rowley be set over to the next regular meeting of the Council on the 8th day of October, 1962: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye by voice vote. Munger absent. A Notice of Intention to Commence - Annexation Procedings having been filed with the City Clerk on the 28th day of September, 1962, by John G. Fairbrock, said notice describing certain property west of the present city limits to 44th Avenue between Summitview and Chestnut, and Mr. Fairbrook being present, the Council proceded to consider said notice. It was MOVED by Robinson, seconded by Lynch that said notice be received and that the owners of the property therein described, be required to assume their proportionate share of the City's existing indebtedness-: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting-eye by voice vote. Munger abserit. Discussion pointed out that areas now coming into the city would benefit from the November 6, 1962 Street Bond issue if it is approved by the electors and therefore the Council feels that new annexations must assume their,share of paying for the bonds. In accordance with Resolution -No. D -449 which adopted the 1963 Preliminary Budget for the City of Yakima and the notice "given' by. the ": � ity Clerk, .: Mayor Larson declared this meeting open for the hearing of any taxpayer either for or against all or any part of the proposed budget fdr 1963. Mrs,. Helen Gilbert, Librarian for the Yakima Valley Regional Library, asked the Co>>ncil to re- consider the Library Budget and appropriate the full two mills for their operation, stating that the matter of pensions for personel under the Statewide -City Employees Retirement System was a matter contracted by the City and not the Regional Library Board. Mrs. Lane;, a volunteer Library worker also spoke on behalf of the Library emphasising the need for technical books. Mr. Kenneth Groth, member of Firefighters Local 469 pointed out that the proposed Budget does not come up to the level suggested by the Citizens Advisory Group and requested explanation. Councilman Brazier indicated that those asking for additional services must come up with suggestions as to where the money is to come from for these additional items and further explained that we are attempting to maintain services now given on the money available. Don Carter suggested that money could be saved by not painting so many lines in certain cross walks and that the new signals at 32 and 40 Avenues on Summitview are too elaborate for the traffic they serve. Public Works Director Mayo explained that these signals have been installed to conform with certain state and national- traffic codes and are a part of the Arterial Street Improvements, 75% of which is bezng­paid from State Matching Funds or Gas Tax money. Councilman Lynch explained that the Business and Occupa- tional tax on utilities collected in 1962 may have to be returned if the court decision is in favor of the petition filed by Mr. Stephen H. Huza- and 4,400 citizens and that he is not objectin to raises but there is no money for them. Councilman Robinson agreed that steps should be taken to eliminate the business and occupational tax on utilities. Councilman Kurbitz also indicated that the business and occupation ,.tax is an/ unpopular tax and that it should not be imposed against) the will of the people. Mr. Wes Britt, anNinterested citizen, _stated that persons wort_ ing in government positions enjoy certain job security not enjoyed by non - government employees, Mr. Groth protested his remarks indicating that people should be paid for the work they do and not on the basis of who they work for. Mr. Jules Schockley, a member of the firefighters local, also protested Mr.;Britt:l's'.•remark. Mr. Stephen Huza protested the signal lights at 32 and 40 Avenues and discussed the matter of combining certain departments, indicating that the Civil Service for Fire and Police and for City Employees should be combined. He also protested the Council's actions in making application for federal funds for the Planning Department. Councilma Robinson indicated that the combining of the two Civil Services is being investigated but that. certain legal questions are involved. Mr. Wes,Britt having suggested a 20% cut in the proposed budget at a previous meeting of the Council, discussed and compared salaries paid by the City wit those paid by the County, indicating that city salaries are higher than those paid by the County. He pointed to the Finance Department and Legal Departments contending that the Finance Department Budget should be cut 25% in comparison with the County.Auditor, and that the City should not pay more than $8,400. for.an attorney in comparison with the Prosecuting Attorney's office and that outside legal firms should be retained for extra legal'work. Councilman Brazier and Robinson indicated that the City could not hire an attorney at this salary, that it had been tried without success. Mr. Britt referred to an anonymous expert whom he said would be willing to give the city services for a fee and who felt that he could reduce procedures in certain departments in-. cluding the police department thus eliminating.the need for additional personel. Mr. Britt forth stated that,eleeted Councilmen should be firm in setting city policy. Councilman Lynch expressed appreciation for the constructive criticism and comments made hsr persons present. Councilman Kurbitz expressed favor of giving only such service as can be paid for and suggested a 5% cut in the current expense budget and further stated that he is in favor of a major cut in the Planning Department. Councilman Robinson indicating that he is in favor of the proposed reductions as submitted by the City Manager which come out of travel, extra help, office supply and miscellaneo items. He further explained that these cuts would reduce the budget some $21,376.00 and the business and occupation tax on utilities can be reduced. All persons present having been heard, Mayor Larson explained that the hearing on the proposed budget will be continued on Wednesday evening at the hour of 7:30, P.M., October 3, 1962 in order that persons who can not attend day time Council meetings may be heard. r s r 1` 362 OCTOBER 1, 1962 The Council then returned to the regular agenda and considered the following estimates for work performed on city projects during the month of September, 1962. Munger absent. City Manager Smith reported that a new signal light has been installed at lst Avenue and Yakima Avenue and that the job of constructing an exit through the fence on East Yakima Avenue will be completed this week. He also informed the Council that Mr. H. G. Wells has been appointed chairma of the publicity committee for the Arterial Street Bond Issue -Rhich will be on the November 6, 196 ballot. The re being no further business to come before the Council at the hour of 5:35 P.M., it was MOVED by Brazier, seconded by Kurbitz that this meeting be recessed until the hour of 7:30 P.M. on Wednesday the 3rd day of October, 1962 for the purpose of continuing the hearing on the proposed bud,get for 1963: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting ave by voice vote. Munger absent. RECESSED MEETING, OCTOBER 3, 1962, 7:30 P.M. The.City Council met pursuant to recession, Councilman Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson, City Manager'Smith and City Attorney Andrews present on roll call. The invocation was -liven.by Councilman Munger. Mayor Larson declared the recessed meeting_ of the City Council open for the purpose of further considering the proposed budget for 1963. Mr. Ken Groth, member of the .fire fighters local, asked Council members for specific remarks on the proposed budget. Mayor Larson stated that he is in favor of the proposed budget. Councilman Lemon indicated that the. business and occupational tax on utilities should be reduced 1/2% and that he will strive to do away with the balance of this tax in succeeding budgets. Councilman Lvnch,stated that he has presented to each of the other councilmen, a letter settin-1 forth 13 or 14 �- ms for consideration and which he feels can be cut/, &that he is suggesting no wage increases which would cut the budget some 30,000. Councilman Brazier indicated that the proposed budget should not be cut without some planing, but, that he is not in favor of wage increases, he is not convinced that -all of the positions in the Finance Department are necessary -and that he is oposed to the budget for the Planning Department. Mr. Groth indicated that the field of licensing pin ball machines should be explored as a source of revenue. Councilman Robinson indicated that there is little chance. for license increase in this field. Mr. Wes. Mullenneix protested the elaborate signal lights at 32nd and 40th avenues, suggested that the Planning and Engineering Departments be cut back and protested the manner in which the Gas Company is allowed to leave streets after their installations. Public Works director Mayo answered Mr. Mull.eneix's questions and further explained that better cooperation and coordination is being worked out with all utilities through a committee made up of representa- tives of each company and the city which he hopes will do away vrith tearing up new.streets to in- stall utilities. With regard to protest on the Planning Department, Councilman Robinson explain- ed that if we are to have control of. obnoxious land uses, we must have a planning department and that it is to the best interest of the public to have our Comprehensive Plan, which is 5 years old updated immediately and that this is to be accomplished by using federal matching funds. Before the vda was.taken on this motion Councilman Lynch indicat ed that if it did not carry, he was prepared to offer a substitute motion which would cut some $60,000.00 from the proposed budget and again - stressed that this. would include no.salary increase,, which in itself would cut the budget some $30,000. Councilman Brazier indicated trhat he concurred with Coiancilma.n Lunch's proposal. Councilman Kurbitz again indicated that the business and occupation tax should be eliminated which would cut the current expense budget some 6%. Council- man Larson and Robinson pointed out that if such drastic cuts as suggested by Councilman Lynch were carried out, city operations would be damaged. Councilman Robinson then pointed to budgets passed recently for schools and other levels of government and stated that he hoped that persons - opposing the city's small increase have shown as much interest in budgets on these levels. At the hour of 9:05 P.M., all persons haveing been heard, it was MOVED by Brazier, seconded by Lemon that the Council again recess to the hour of 12:00 o'clock noon on Thursday the 4th day. of October, 1962,,for the purpose of considering and passing the ordinance adopting a budget - for 1963: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote. RECESSED MEETING, OCTOBER 4, 1962: 12:00 O'CLOCK NOON. The Citv Council met pursuant to recession for the purpose of considering an ordinance adopting a budget for the ensuing year and Councilmen Brazier, Kurbita, Larson, Lemon, Lynch, Munger. and Robinson, Citir Manager Smith and City Attorney Andrews were present on roll call. The invocation was given by Councilman Lynch. An ordinance adopting a budget for the City of Yakima, for the year of 1963, appropriating funds for the estimated expenditures, and fixing and levying; the amount of taxes necessary to balance the estimated revenue with the estimated expenditures, havirng•been 'read by the Clerk of the Council, it was MOVED by Lemon, seconded by Robinson that said ordinance be passed as read: carried, Larson, Lemon, Munger and Robinson voting aye on roll call. Brazier, Kurbitz and Lynch voting nay on roll call. There being no further - business to come before the Council, it was MOVED by Lemon, seconded by Kurbitz that we do now adjourn at the hour of 12:15 noon: carried, Brazier, Kurbitz, Larson, Lemon, Munger and Robinson voting aye by voice vote. Page 363- Councilman Kurbitz again indicated that the business and occupational tax which has been added in 1962 should be eliminated which would cut the Current Expense Budget some 6%. I
